RESOLUTION NO.~~~
A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING
TENTATIVE TRACT MAP #11444
WHEREAS, an application was duly filed by Marina View Terrace, 1163 La Rosa
Road. Arcadia for Tentative Tract Map #11444; and
WHEREAS. the property is described as a portion of Lot 13, Block 101,
Tract 698 and is located at the southeast corner of First Street
and Marina Drive; and
WHEREAS, the proposal is to construct a five-unit condominium; and
WHEREAS, on July 1.1981, by Resolution #1232. the Planning Commission approved
and recommended to City Council approval of Tentative Tract Map
#11444; and
WHEREAS. the City Council makes the following findings regarding the tract
map;
1) The site is physically suitable for existing development; the
land is flat and it is located in a developed area with existing
streets, utilities, residences, and commercial activities
located adjacent to this site.
2) The site is suitable for the present density of development;
other projects of similar density have been constructed and
are compatible with this area.
3) The design of the subdivision will not cause substantial
environmental damage.
4) The design of the subdivision is not likely to cause serious
public health problems because all necessary utilities and
services presently serve the project.
5) The design of the subdivision will not conflict with easements.
acquired by the public at large for access through. or use of,
property within the proposed subdivision because no easements,
acquired by public at large are located on the project site.
6) The discharge of waste from the subdivision into the existing
community sewer system will not violate existing requirements
prescribed by the local regional water quality control board
pursuant to Division 7 of the Water Code.
7) The project is consistent with the City's General Plan
NOW. THEREFORE. BE IT RESOLVED that the City Council does hereby approve
Tentative Tract Map #11444 subject to the following:
1) Payment of in lieu park fees of $70,501.00 prior to
issuance of building permits.
2) Compliance with "conditions of approval" contained in staff
report.

The project, if approved as proposed, should be required to meet the
following staff recommended conditions of approval: - ,.~
1) Remove existing substandard curb (3" height) on First Street and
replace with standard height curb.
2) Existing curb return shall be replaced to City standards and shall
include a wheel chair ramp.
3) Remove existing sidewalk on First Street and replace with new
sidewalk to match the grade of the new curbing. New walk shall be
located adacent to the curb.

The Planning Commission is concerned about potential safety problems
associated with a sidewalk adjacent to the street and with the
aesthetics of one section of sidewalk not matching the remainder of
the street.)
4) All entrance controls and driveways shall be designed per City
standards and subject to the approval of the City Engineer.
5) Restriping on Central Avenue/Marina Drive will be required to permit
access to this property. Restriping work shall be completed at the
developer's expense.
6) Engineered street plans shall be submitted for City Engineer's approval
for the curb construction on First Street.
7) Roof drains shall be designed and installed per City standards and
subject to the approval of the City Engineer.
8) Existing traffic signal push button for westbound pedestrian traffic
shall be relocated to the signal pedestal.
9) All concrete removed in the construction of utility connections shall
be replaced per City standards.
10) The developer shall dedicate a corner cutoff at the intersection of First
Street and Central Avenue.
11) Undergrounding of utilities shall be required on Central Avenue and
First Street alley per the Municipal Code.
12) Upgrade existing Second Street fire hydrant to City standard "Eastbay
4" and 21".
POLICY RESOLUTION #1162
Planning Commission Policy Resolution #1162 contains standards for new
construction condominiums. A review of the project shows compliance in
all areas as follows:
a) Compliance with zoning - project meets all minimum zoning standards.
b) 120 sq. ft. of private storage per unit. .
c) Minimum 950 sq. ft. unit size.
d) 200 sq. ft. of private open space per unit (except Unit 2 with 192 sq. ft.)
e) Separate utility lines and meters for each unit - provided.

f) Separate hot water heaters - provided.
g) Separate laundry facilities -'provided
h) Automatic garage door openers - provided
i) CC and R's provided; yet to be approved by City attorney.
The project as proposed meets all known City zonin9 regulations.

SUBDIVISION PARKLAND FEES
The City's subdivision ordinance requires land dedication or payment of
fees in lieu thereof as a condition of each subdivision. The in-lieu
fee for this 5-unit tract will be $70,501.00. The land value of $35.97
per square feet was determined from the April 9. 1981 sale of the property
for $450.000.
PLANNING COMMISSION ACTION
.
On July 1.1981, by Resolution #1232. the Planning Commission approved and
recommended to City Council approval of Tentative Tract Map 11444.
RECOMMENDED ACTION
It is recommended that Tentative Tract Map #11444 be approved by City
Council adoption of the attached Resolution.
