WHEREAS, Section 28-2202 of the City zoning regulations permits the Planning Commission to clarify ambiguity regarding permitted uses; and WHEREAS, a determination is required regarding the sale of fresh produce at horticultural nurseries; and WHEREAS, on October 7,1981, by Resolution 1241, the Seal Beach Planning Commission determined that fresh produce sales is not a permitted use in a nursery; and WHEREAS, the City Council makes the following findings: l. A horticultural nursery is a retail place of business wherein live plants, flowers and products necessary for the propagation and display of plants are sold. 2. A nursery is defined by Webster as "an area where plants (as trees and shrubs) are grown for transplanting, for use as stocks for budding and grafting, or for sale.: 3. The sale of fresh produce is not normally found in horti- cultural nurseries but is normally found in a retail grocery store in urban areas. NOW, THEREFORE, BE IT RESOLVED that the Seal Beach City Council does hereby determine that sales of fresh produce is not a permitted use by right in a horticultural nursery. PASSED, APPROVED AND ADOPTED by the City Council at a regular meeting thereof held on the 1981, by the following vote: AYES: Councilmember(s) NOES: Councilmember(s) ABSENT: Councilmember(s) of the City of Seal Beach day of Mayor ATTEST: City Clerk
