Home My WebLink AboutCC Res 3113 1981-11-09 I I I RESOLUTION NO. .fJ / / ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH ADOPTING A COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CON- TRACT WITH THE COUNTY OF ORANGE IN APPLYING FOR FUNDS FOR NEIGHBORHOOD HOUSING REHABILITATION UNDER THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 WHEREAS, the City of Seal Beach has chosen to apply for a grant under Title I of the Housing and Community Development Act of 1974; and WHEREAS, the City has entered into a Cooperation Agreement with the County of Orange to make application for funding under the Seventh Year of the Program; and WHEREAS, this contract for Neighborhood Housing Rehabilitation further. defines the responsibilities of the two parties. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach does hereby approve the contract attached hereto as Exhibit "A" and authorizes the Mayor to enter into the contract on behalf of the City, PASSED, APPROVED AND ADOPTED by the City Council California, at a meeting thereof held on the 1981, by the following vote. WHEREAS, COUNTY and CITY previously entered into a Cooperation Agreement, dated September 25, 1979, in which both parties agreed to cooperate in the undertaking, or assist in the undertaking, of community development and housing assistance activities, and WHEREAS, the CITY has submitted to the COUNTY an application for funding of a project(s) hereinafter described, and WHEREAS, the COUNTY has entered into separate agreement dated July 14, 1981, with the U.S. Department of Housing and Urban Development (hereinafter designated as HUD) to fund said project(s) under the Housing and Community Development Act of 1974 and 1977. WHEREAS, the COUNTY has established a Home Improvement Program and has entered into individual agreements to administer said program with HUD, California State Department of Housing and Community Development, and a local lending institution, and " 25 'WHEREAS, the CITY has requested COUNTY to implement the CITY's Housing and 26 Community Development project entitled Housing Rehahilitation and funded from Block 27 Grant funds (Gl3.)) for ($25,000.00). 28 NOW, THEREFORE, IT IS MUTUALLY AGRF.ED by and between the parties that the -1- . I: 10 11 20 -~ ( ( Contract No. C26689 Resolution Number 1 following provisions listed as well as all applicable Federal, State and County 2 laws and regulations including the attached SPECIAL PROVISIONS, identified as .. 3 4 EXHIBIT "A", are part of this Contract. The COUNTY will implement the Housing Rehabilitation Project described ' 5 6 7 . 0.". .~ herein as project, to provide low-interest loans, deferred payment loans, or grants' ", for home improvement of privately owned properties in the CITY's target area (see. attached map Exhibit "B"), in accordance with the COUNTY's Home Improvement Program (see Exhibit "c" of this Contract) as approved and amended from time to time by, the Board of Supervisors. The project is to primarily benefit low and moderate income families. 2. The total project funds available for,loans or loan subsidies and 12 administrative costs hereinafter provided for in Section 6 of this Contract 13 will not exceed Twenty-Five Thousand Dollars and no/l00 ($25,000.00). 14 3. It is agreed by all parties that all funds shall be expended prior 15 to October 31, 1982. In the event that all funds for this project are not expended 16 by October 31, 1982, this Contract shall be subject to termination at the discretion 17 of the COUNTY. 18 4. The CITY agrees to advertise the program and to provide outreach 19 efforts in the community on an ongoing basis to promote loans or loan subsidies 5. The CITY agrees to provide appropriate office space to the COUNTY including a desk and a telephone. 23 6. The CITY agrees to pay administrative charges for costs incurred by ," 24 COUNTY staff which shall not exceed 20% of the total project funding amount stated 25 in Section 2 of this Contract. 26 7. Funds will also be used to administer a lIUD 312 Program, and other 27 funding sources once approved by the Board of Supervisors for the program, may 28 be added to this Contract by mutual consent of the Director of COUNTY's -2- . 5 6 7 8 19 10 -~ ( ( Contract No. C26689 Resolution Number 1 2 3 Environmental Management Agency and the CITY. 4 8. Neither COUNTY nor any officer nor employee thereof shall be responsi~l~,. ., , .... ..... . ~ .... for any damage or liability occurring by reason of any action or omission of CITY oi-'i,.:';, . . .. .:'.':Ji~ its agents, associates, contractors, subcontractors, materialmen, laborers, or any. .', :.~~~~' other persons, firms, or corporations furnishing or supplying work service, materials, ~ '-~ .t. " or supplies in connection with CITY's performance of this Contract and from any and all claims and losses accruing or resulting to any persons, firm or corporation for personal injuries or property damage resulting from or as a consequence of, CITY's performance of this Contract under or in connection with any work, authority or jurisdiction delegated to CITY under this Contract. It is also 11 12 13 14 understood and agreed that, pursuant to California Government Code Section 895.4, CITY shall fully indemnify, defend and hold COUNTY harmless from any liability imposed for injury (as defined by California Government Code Section 810.8) occurring by reason of any action or omission of CITY under or in connection with any work, 15 authority or jurisdiction delegated to CITY under this Contract. CITY shall act in 16 an independent capacity and not as officers, employees or agents of COUNTY. 17 9. Neither CITY nor any officer nor employee thereof shall be responsible 18 for any damage or liability occurring by reason of any action or omiss~on of COUNTY 19 under or in connection with any work, authority or jurisdiction not delegated to CITY 20 under the terms of this Contract. It is also understood and agreed that, pursuant ~.
