RESOLUTION NO. 3/3/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING TENTATIVE PARCEL MAP NO. 82-100l I WHEREAS, an application was duly filed by Ponderosa Homes, 2082 Business Center Drive, Irvine for Tentative Parcel Map #82-l00l; and WHEREAS, the property is described as a portion of the Hellman Specific Plan area and is located north of Marina Hill (legal description on file); and WHEREAS, the proposal is to subdivide the Hellman Specific Plan area into three residential parcels, two roads, two parks and one oil pro- duction site; and I WHEREAS, the purpose of the parcel map is to provide a method to: purchase residential land, purchase road rights-of-way and to convey park- land to the City of Seal Beach; and WHEREAS, on February 3, 1982, by Resolution #l25l, the Seal Beach Planning Commission unanimously approved and recommended to City Council approval of Tentative Parcel Map #82-l001; and WHEREAS, the City Council makes the following findings regarding the map: l) An environmental impact report was prepared on the project which showed no significant environmental effects which could not be mitigated. The City Council finds that all feasible mitigation measures identified in the environmental impact report which are applicable to the project, will be undertaken. 2) A Specific Plan was prepared on this project and adopted by the City Council. 3) The project is considered consistent with the City's General Plan because the General Plan shows a variety of land uses, densities, roads and parks for the site which can be imple- mented with the parcel map. 4) The project is consistent with the City's Redevelopment Plan in that land uses, densities and intensities shown on the Redevelopment Plan are the same as those on the approved tract map that concurs with the currently proposed parcel map. 5) The site is physically suitable for the proposed development because the environmental impact report studies found no problems that could not be mitigated. 6) The site is suitable for the proposed density of development because the City's infrastructure is capable of accepting the proposed density of development. All studies contained in the environmental impact report show that the proposed densities can be accommodated. I 7) The design of the subdivision is not likely to cause substantial environmental damage as all mitigating measures contained in the environmental impact report to protect the environment and prevent environmental damage will be implemented. 8) The design of the subdivision is not likely to cause serious public health problems because all necessary utilities and services are available to serve the project. ~ , I I I , .' Resoiutio~ No. .:3/3/ Page Z ----- 9) The design of the subdivision will not conflict with ease- ments, acquired by the public at large for access through, or use of, prope.rty within the proposed subdivision because all easements will be adequately preserved and maintained or new easements created. lO) The discharge of waste from the subdivision into the existing community sewer system will not violate existing requirements prescribed by the local regional water quality control board pursuant to Division 7 of the Water Code because the require- ments will be met by implementing the approved tract map. NOW, THEREFORE, BE IT RESOLVED, THAT the City Council does hereby approve Tentative Parcel Map #82-l00l, subject to the attached conditions shown as Exhibit "A". Resolution Number . .' EXHIBIT "A" ENGINEERING DEPARTMENT CONDITIONS OF APPROVAL PARCEL MAP #82-l00l I 1. An irrevocable offer to dedicate Parcel "C" and Parcel liD" for street purposes shall be offered to the City on the final parcel map. The offer to dedicate shall include a temporary construction easement and permanent slope easement as required by the City Engineer. 2. The exact location and configuration of the fault zone shall be as designated in the revision to the rpeort on "Evaluation of Surface Faulting Potential" by Medall, Aragon, Worswick & Associates, Inc. dated December 14, 1981. 3. Conform to the requirements of the Orange County Sanitation District as specified in the District's letter dated January 26, 1982. 4. The final determination as to the location of the power transmission lines shall be to the satisfaction of the City Council. I
