I I I , RESOLUTION NUMBER ~t?~~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 4TH DAY OF NOVEMBER, 1980, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW . WHEREAS, A Special Municipal Election was held and conducted in the City of Seal Beach, California, County of Orange, on Tuesday, November 4, 1980, as required by Ordinance Number 1088 of the City of Seal Beach, WHEREAS, Notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed, and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law and charter cities; and WHEREAS, Pursuant to Resolution Number 2997,said special election was consolidated with the Statewide General Election held on said date, that the precincts, polling places, and officers of election for the Special Municipal Election were the same as those provided for in said Statewide General Election; and WHEREAS, Said Special Municipal Election was called for the purpose of submitting to the qualified voters of said city, a ballot measure hereinafter set forth relating to a Special Safety Services Tax. WHEREAS, Said ballot measure was known on the Statewide General Election ballot as Proposition "0" and read as follows: PROPOSITION "0" "Shall the Ordinance authorizing the Seal Beach City Council to levy a special Safety Service Tax annually for the next four years to preserve YES current Police, Fire and Paramedic service levels and collectible from residential, commercial and vacant real property owners in the City be adopted by the City Council as Municipal Ordinance Number NO 1087; and shall the proceeds of such tax (estimated as follows: 1981/82 - $760,729; 1982/83 - $1,046,770; 1983/84 - $1,373,582; and 1984/85 - $1,735,348) be added each year to the City's legal spending limit as established by Article XIII-B of the California Constitution?" I I I Page Two - Resolution Number ~ti~~ WHEREAS, The Registrar of Voters, County of Orange, has certified as to the results of the canvass of said Special Municipal Election consolidated with the Statewide General Election held November 4, 1980 attached as "Exhibit A" showing the whole number of votes cast in the City to be 16,309; and that the votes cast for and against the measure is: Proposition "0" YES 5124 NO 9145 WHEREAS, The number of votes given in each precinct for and against the measure is attached as "Exhibit B", NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach, California, hereby declares pursuant to the results given in the above certification that a majority of the qualified voters voting on said measure relating to a Special Safety Service Tax did not vote in favor thereof, and that said proposition was not carried and Ordinance Number 1087 shall not be deemed adopted and ratified, BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this resolution, shall enter same in the official records of the City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City at which the same is passed and adopted, PASSED, APPROVED and ADOPTED by the City Council of the Ctt~ of Seal Beac Califor ia, at a meeting thereof held on the ~~ day of , 1980, by the following vote: AYES: Councilmember NOES: Councilmembers ABSENT: Councilmembers 'l:!~~4/ .
