HomeMy WebLinkAboutCC Res 2990 1980-07-14 I I I RESOLUTION NUMBER .:z qq 0 \ A RESOLUTION OF THE CITY COUNCIL OF THE CITY O~ SEAL BEACH REGARDING THE PROPOSED DISPOSITION OF CERTAIN REAL PROPERTY r' THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY FINDS, DETERMINES AND RESOLVES AS FOLLOWS: Section 1. That certain parcel of real property and the improvements thereon, more particularly described on Exhibit A attached hereto and by this reference incorporated herein, are no longer required for City purposes. The disposition of such real property shall be for the common benefit and for the benefit of the City. Section 2. The City Council hereby authorizes and approves the sale of such real property for the common benefit and for the benefit of the City, pursuant to the Notice Inviting Bids, attached hereto as Exhibit B and by this reference incorporated herein. The terms and conditions of the sale of such real property shall be as specified in such Notice Inviting Bids. Section 3. The City Clerk is hereby authorized and directed to cause such Notice Inviting Bids to be published once a week for two successive weeks prior to September 8, 1980 in the Seal Beach Journal and the Santa Ana Register. Description of the property is as follows: That portion of a 60 foot by 100 foot parcel of land described as Parcel 2 in a Final Order of Condemnation recorded in Book 7974, page 225 in Official Records, in the office of the County Recorder of said County, described as follows: "Beginning at the most easterly corner of said parcel; thence northwesterly 35.00 feet along the northeasterly line of said parcel to a line parallel with and 35.00 feet northwesterly from the southeasterly line at said parcel; thence southwesterly 35.00 feet along said parallel line to a line parallel with and 35.00 feet southwesterly from the northeasterly line of said parcel; thence southeasterly 35.00 feet along said last mentioned parallel line to the southeasterly line of said parcel; then northeasterly 35.00 feet along the southeasterly line of said parcel to the point of beginning". Terms of sale: All cash; all bids shall be accompanied by a cashier's check in an amount equal to at least ten percent (10%) of the amount of bid, representing a deposit for the purchase of the property. The balance of the purchase price shall be paid upon recordation of the grant deed. Title: Title is to be delivered free and clear of all liens and encumbrances except covenants, conditions, restrictions and easements of record, current real property taxes, if any, and a reservation of oil, gas and mineral rights below 500 feet from the surface of the land. Buyer shall receive a CLTA standard form policy of title insurance guarantying title in the amount of the purchase price. Documents verifying title to said property are available for inspection in the office of the City Clerk. The City of Seal Beach, California, hereby calls for sealed bids in writing for said described property to be received until 2:00 o'clock p.m., September 8, 1980 at the office of the City Clerk, City Administration Building, 211 - 8th Street, Seal Beach, California. At the direction and on behalf of the legislative body, the City Clerk shall open bids received in response to this notice and shall submit the same to the City Council at its next regular meeting, September 8,1980,7:00 o'clock p.m., whereupon said land shall be sold to the highest bidder, except that it may at that time or at any time to which the sale is continued, receive any higher bids and may, due to any irregularity in any bid, reject any and all bids failing to comply with the terms and conditions set forth for the purchase of said property. Property to be sold: Sunset Beach Water Tower (see attached site map) 2. Method of sale: Sealed b::d 3. Terms; payment of purchase price: a. Terms: All cash b. City shall pay for costs of title policy and documentary transfer tax, if any. b. Buyer shall pay for costs of preparing and recording grant deed. . Breach: If, for any reason other than nonperformance by City of its obligation to deliver a grant deed, City shall have the right to retain buyer's earnest money deposit as liquidated damages (it being understood that City's damages arising from buyer's nonperformance would be either extremely difficult or impractical to fix). In consideration therefore. City waives its right to proceed against the buyer for specific enforcement of the sale. I 7. Special conditions: a. Restoration of the water tower per the Orange County Environmental Management Agency "Plans for the Restoration of SUNSET BEACH WATER TOWER" shall commence within thirty (30) days following recordation of the deed; the tank shall be removed within thirty (30) days of acceptance of the bid; and the restoration completed within one hundred twenty (120) calendar days of commencement of work unless written extension is given by the City of Sel)l Beach. , b. Upon recordation of the grant deed the bidder shall submit a performance bond in the amount of $100,000.00 guaranteeing his performance under the terms and conditions of the City; and shall further submit a performance bond in the amount of $50,000.00 assuring that the premises shall be property Baintained for a period of five (5) years. c. Upon award of the bid by the City Council, an insurance policy shall be taken out insuring against liability in the amount of $1,000,000.00 and property damage in the amount of $200,000.00 with the City named as additional insured. I d. That the property will be deed restricted with a condition requiring that the support structure and tank be ~intained for thirty (30) years except for destruction by fire or Acts of God such as earthquake, floods, etc. e. An architectural committee appointed by the City shall review the restoration plans to assure that no substantial changes are made to the silhouette or appearance of the water tower. The architectural review committee shall report its findings to the City Council, who shall be the f1 na 1 author1 ty . .. Resolution Number Page Three ~ CONDITIONS OF SALE - SUNSET BEACH WATER TOWER 1 f. That all construction shall comply with City Codes. g. That if the property is not reconstructed in conformity with the conditions contained herein that it will revert to the City of Seal Beach. h. That any changes in the design of the tank will not increase its height more than four feet unless approved by the City. i. All construction shall be'of wood with the exception of windows and fittings. j. That it will be subject to the City rezoning the property as R-l to allow the construction of a single-family residence within the water tower structure, and subject to obtaining Coastal Comnrission approval. k. The City may waive any irregularity in any bid and may reject any and all bids. 1. All unsuccessful bidders shall have their checks of deposit returned immediately after award of the bid. m. Bids may be received in the Office of the City Clerk until 2:00 o'clock p.m., September 8, 1980 at which time they will be publicly opened. n. The City Council shall award the bid to the highest responsible bidder at the City Council meeting to be held September 8, 1980 at 7:00 o'clock p.m. I
