HomeMy WebLinkAboutCC Res 2903 1979-08-13 I I I ,. - . . RESOLUTION NUMBER .2 9 t:J 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH CONDITIONALLY APPROVING TENTATIVE TRACT MAP 10732. WHEREAS, an application was duly filed by the Golden Rain Foundation, P. O. Box 2069, Seal Beach, and Presley of Southern California, P. O. Box 2200, Newport Beach, for Tentative Tract Map No. 10732; and WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, the property is described as a 5.51 acre site and is located at the southwest corner of Seal Beach Boulevard and Golden Rain Road (legal description on file with the City); and . the proposal is for a tentative tract for 126 condominium units in the R-3 Zone; and an environmental assessment of the project has been completed and a Negative Declaration prepared which meets the requirements of CEQA: and on July 18, 1979, the Planning Commission approved and recommended to City Council approval of Tentative Tract Map 10732 by Resolution Number 1190; and ' City Council makes the following findings regarding Tentative Tract Map No. 10732: 1. A Negative Declaration has been prepared for this project which did not reveal any major adverse impacts which have not been mitigated. 2. The proposed map and improvements for a multiple residential subdivision are consistent with the City's General Plan which designates property as multi-residential zoning. ' 3. The project complies with the type of use and density prescribed for this site in the City's General Plan and zoning ordinance which designates the property for multi-residential use. 4. The site is physically suitable for development; the land is flat; is in a developed area with existing streets and utilities located adjacent to the project site. 5. The 5.51 acre site is suitable for the proposed density of development. 6. The design of subdivision will not cause substantial environmental damage. 7. The design of the subdivision is not likely to cause serious public health problems because all the necessary utilities and services are available for the project. 8. The design of the subdivision will not conflict with easements acquired by the public at large for access through, or use of, property within the proposed subdivision. " 9. The discharge of waste from the proposed subdivision into the existing community sewer system will not violate existing requirements prescribed by the local regional water quality control board pursuant to Division 7 of the Water Code. '. ,. I Resolution Number , ' . I NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve Tenta- tive Tract Map 10,732 subject to the following conditions: 1. The full in-lieu park fees be paid for the project and that these funds be used to acquire land and/or construct new park facilities as soon as adequate funds are obtained. Said fees are to be paid prior to issuance of building permits for any aspect of this project. 2. The developer shall comply with the accompanying conditions. Open parking shall be striped and the remainder of the street posted with "No Parking" signs or painted red. 2. Elevator design requirements to meet needs of handicapped and wheel chair occupants to satisfaction of City Fire Department. 3. Landscaping plans to be provided to Staff. Size and quantity of plants used to satisfy landscaping element of plan must be acceptable to City Engineer. 4. The Covenants, Conditions and Restrictions for the project shall be submitted to the Staff and City Attorney for review and approval prior to recordation. CC&R's shall contain a provision that pro- vides each unit with only one assigned covered parking space. 5. Glazing Code requirements be upgraded one step so that all windows indicating Code 3 would become Code 2 installations, all Code 2 windows shown would become Code 1. Code 1 windows shown would remain Code 1. 6. A final Tract Map shall be prepared in accordance with the requirements of the California State Subdivision Map Act and Chapter 21 of the City of Seal Beach Municipal Code. 7. Dedication of easements for water line purposes to the City of Seal Beach. 8. Dedication of vehicular access rights to Seal Beach Boulevard from this tract to the City of Seal Beach. 9. Developer shall submit an engineered Grading and Drainage Plan to the City Engineer for review and approval. 10. Developer shall submit an engineered Water Plan to the City Engineer for review and approval. 11. The Uniform Fire Code Section 13.301 requires a fire road access if a building or portion of a building is more than 200 feet from an improved public street. Building No.2 on the southeast side and Building No.3 on the east side do not meet Fire Department access due to the block wall on Seal Beach Boulevard. The access fire road can be a landscaped-type sidewalk, but designed for Fire Department emergency vehicles as specified in the Uniform Fire Code. 12. A looped water system with a fire flow of 2,000 GPM minimum flow. Approximately six hydrants will be required on Burning Tree Lane and on on-site locations depending on the fire road configurations. The Uniform Fire Code Section 13.316G requires an automatic fire extinguishing system (sprinklers) in this occupancy. ~Iet standpipes with 75 feet of rubber-lined hose, adjustable nozzles in cabinets with extinguishers are required and should be considered in the water system design. Exterior lighting and lighting in parking garage of sufficient illumination to provide safety to elderly individuals with visual impairment. . 13. 14.
