OROINANCE NO. ~
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA, AMENDING CHAPTER 5 OF
THE CODE OF THE CITY OF SEAL BEACH RELATING TO
BUILDING AND SAFETY. AND ADOPTING BY REFERENCE
THE NATIONAL ELECTRICAL CODE, 1981 EDITION, THE
UNIFORM BUILDING SECURITY CODE, THE 1981
ACCUMULATIVE SUPPLEMENT AND 1980 CODE CHANGES
TO THE 1979 UNIFORM BUILDING CODE.
II THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 5 of the Code of the City of Seal Beach, California is
amended to read:

"Sec. 5-1. Codes adopted by reference. The below listed codes are
adopted by reference as the Buildin9 and Safety Code of the City of Seal Beach.
(A) Uniform Building Code, 1979 Edition, including the appendix.
(B) Uniform Mechanical Code, 1979 Edition.
(C) Uniform Plumbing Code, 1979 Edition.
(D) Uniform Swimming Pool Code, 1979 Edition.
(E) Uniform Housin9 Code, 1979 Edition.
(F) Uniform Cdde from the Abatement of Dangerous Buildings, 1979 Edition.
(G) Uniform Sign Code, 1979 Edition.
(H) Dwelling Construction Under the Uniform Building Code, 1979 Edition.
(I) One & Two Family Dwell)ng Code, Accumulative Supplement, 1979 Edition.
(J) National Electri~al Code, 1981 Edition.
(K) , Uni form Bui 1 di ng':.Code. Standards, 1979 .Edi ti on.
(L) Uniform Fire Code;-1979' Edition.
(M) Uniform Wiring Code, 1978 Edition.
(N) Uniform Solar Energy Code, 1979 Edition.
(0) . Uniform Building Security Code.
(P) 1981 Accumulative Supplement to A,B,K,O,L.
(Q) 1980 Code Changes to the 1979 Uniform Building Code.
Three copies of each of the above codes have been deposited and shall be
maintained by said City Clerk for use and examination by the public."
All amendments to Codes adopted herein by reference shall be considered
as part of this Code.
Sec. 5-6 is redesignated as Section 5-6A and the title thereof changed
to read:
"Sec. 5-6A. Permits - Not Required for the FOllowing:
(1) Structures placed in public streets, alleys and sidewalks,
except those regulated by Chapters 44 and 45; Uniform
Building Code. (Public Works Permit required);
(2) Buildings or structures owned by the Federal Government,
the State, the County, or by a public school district;
(3) Work done by employees of the City on city-owned or leased
structures;

(4) Waterfront and marine structures. (Public Works Permit required);
(5) Masonry planter boxes not more than eighteen inches in height;
(6) Fences less than forty-two inches in height above grade;
(7) Unroofed walks, driveways and slabs on private property;

(12) Installation or removal of a household type or single unit system
or refrigeration that is self-contained and hermetically sealed,
a single type of refrigeration of twenty-two cubic feet capacity
or less, N.E.M.A. rating, that is self-contained, that employs
no other type of refrigerant than freon or methyl chloride, a
single unit type of refrigeration of fifteen cubic feet capacity
or less, N.E.M.A. rating, that employs sulphur dioxide refrigerant;
(13) ,Pools not over 1'6" in depth, where there is no electrical or
plumbing installation;
(14) Any portable heating appliance;
(15) Any portable ventilating equipment;
(16) Any portable comfort cooling unit;
(17) Any steam, hot or chilled water piping within any comfort heating
or cooling equipment regulated by this Code;
(18) Replacement of any component part or assembly of an appliance
which does not alter its original approval and complies with
other applicable requirements of this Code;
(19) Any portable evaporative cooler;
(20) Any refrigeration equipment which is a part of the equipment
for which a permit has been issued pursuant to the requirements
of this Code;
(21) Any unit refrigerating system;
(22) Repair work as follows: The stopping of leaks in drains, soil,
waste or vent pipe; provided however, that should any trap,
drainpipe, soil, waste or vent pipe be or become defective and
it becomes necessary to remove and replace the same with new
material in any part or parts, the same shall be considered as
such new work and a permit shall be procured and inspections made
as hereinbefore provided;
(23) Clearing of stoppages or the repairing of leaks in pipes, valves,
or fixtures, when such repairs fo not involve or require the
replacement or rearrangement of valves, pipes or fixtures."
And, a new Sec. 5-6 is added to said Code to read:
"Sec. 5-6. Permits. It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert,
or demolish, equip, use, occupy or maintain any building or structure or cause or
permit the same to be done without a valid permit. Refer also to Chapter 3, "Permits
and Inspections" of the Uniform Building Code regarding exempted work."
Sec. 5-33. Uniform Building Code, 1979 Edition, Chapter 55, Sec. 5504 is
hereby corrected and amended to read:
"Sec. 5504. Pool Fences." Pools to be completely fenced, gates to have
latches. Every swimming pool, pond or other body of water eighteen (18) inches or
more in depth at any point shall be surrounded by a fence or wall not less than six
(6) feet in height measured on the exterior side. No such fence or wall shall be
constructed and maintained with openings or projections such that a toddler or small
child may gain a foothold and climb over. Openings between vertical members shall
not exceed four (4) inches, and the distance between horizontal members, accessible
from the exterior, shall not be less than four feet, six inches (4'6")

Fences or walls shall be located a sufficient distance from any structure,
shrubbery or tree, or hillside grade which tould be used to assist a child to
scale the fence or wall. Gates and door openings through such enclosures shall be
self-closing and self-latching with release located on the pool side as to prevent
release from the exterior. A self-latching tumbler lock may be installed so that
the gate can be opened from the exterior with a key. Exception: When approved
by the Building Official, public swimming pools under continuous supervision may
be operated with gates or doors unlocked. Except for single family residences, the
fence and walls shall be so locked as to allow access to all living units without
entering the pool enclosure. The fence or walls shall serve to isolate the pool
from other activities and structures and shall be located within fifty (50) feet
of the pool. Gates in such enclosures shall be located in view of the pool.
A building wall without doors may be used as part of such pool enclosures when
within fifty (50) feet of the pool. For single family residences, access to the
main front door shall not be through the swimming pool enclosure. The swimming
pool enclosure for single family residences may include that dwelling walls with
windows and doors.
Sec. 5-6. Uniform Building Code, 1979 Edition, Chapter 33, Section 5602
is hereby corrected and amended to read:
"Sec. 5602. Scope. The provisions of this chapter shall apply to
enclosed Group R, I and J Occupancies regulated by this Code. Groups A, B, C,
0, E, F and G should comply with the intent of this chapter. However, other laws,
insurance requirements, owner operations and other considerations may provide
other security arrangements. Exception: The requirements shall not apply to _____
enclosed Group J Occupancies having no openings to an attached building or which
are completely detached."
Sec. 5-37 is hereby deleted.

"Sec. 5-42. Exception for "R" Occupancy in Special Cases" is hereby
corrected and amended to read: "The following shall apply to "R" Occupancies
with 1000 square feet of floor area or less, containing not more than two bedrooms
having no natural gas fired appliances, having no fixed window security guards,
and provided with a private security system for the community. In addition, this
section shall apply only to planned adult communities, constructed prior to 1966
in which each individual dwelling unit us equipped with an approved smoke detector
device."
Sec. 5-43 is hereby deleted.
Section 4. The City Clerk shall certify to the passage and adoption of this
ordinance by the City Counci ~ the City of Seal Beach and cause the same to be
published as re~ired by la. T~j.s 0 dinance shall take effect and be in full
