Section 1.
Council with respect
are as follows:
The purposes and intent of the City
to the Surfside Redevelopment Project
A. To eliminate the conditions of blight existing
in the Surfside Redevelopment project;
B. To prevent the recurrence of blighting conditions
within the Surfside Redevelopment Project;
C. To provide for the construction of public
improvements and to improve the quality of the environment
in the Surfs ide Redevelopment project for the benefit of the
Project Area and the surrounding community.
Section 2. The Redevelopment Plan for the Surfs ide
Redevelopment Project (the -Redevelopment Plan-), attached
hereto as Exhibit A, is incorporated herein by this reference.
S@ction 3.. Based upon the various reports and
other information provided to the City Council, the City
Council hereby finds and determines that:
A. The Surfs ide Redevelopment Project is a
blighted area, the redevelopment of which is necessary to
effectuate the public purposes declared in the Community
Redevelopment Law of the State of California (Health and
Safety Code Sections 33000, et seq.).
B. The Redevelopment Plan would redevelop the
Surfs ide Redevelopment Project in conformity with the
Community Redevelopment Law and in the interest of the
public peace, health, safety and welfare.
C. The aqoption and carrying out of the Redevelop-
ment Plan for the Surfs ide Redevelopment Project is economically
sound and feasible.

D. The Redevelopment Plan for the Surfside
Redevelopment Project conforms to the General Plan of the
City of Seal Beach insofar as such General Plan is applicable
to the Surfs ide Redevelopment Project.
E. The carrying out of the Redevelopment Plan for
the Surfs ide Redevelopment Project would promote the public
peace, health, safety and welfare of the City of Seal Beach
and would effectuate the purposes and policies of the
Community Redevelopment Law.
r. Even though there are no plans for th6 acquis-
ition of housing facilities at the present time within the
Surfside Redevelopment Project, the Redevelopment Agency of
the City of Seal Beach has a feasible method or plan ~or the
relocation of families and persons which may be displaced
from the Surfs ide Redevelopment Project if the Redevelopment
Plan may result in the temporary or permanent displacement
of any occupants of housing facilities in the Surfs ide
Redevelopment Project.
G. Even though there are no plans for the acquis-
ition of housing facilities at the present time within the
Surfs ide Redevelopment Project, there are or are being
provided in the Surfs ide Redevelopment Project or in other
areas not generally less desirable in regard to public
utilities and public and commercial facilities and at rents
or prices within the financial means of the families and
persons who may be displaced from the Surfs ide Redevelopment
Project, decent, safe and sanitary dwellings equal in number
to the number of and available to such displaced families
and persons and .reasonably accessible to their places of
employment.
H. The inclusion in the Surfs ide Redevelopment
Project of any lands, buildings or improvements which are
not detrimental to the pUblic health, safety, or welfare is
necessary for the effective redevelopment of the area of
which they are a part; any such area included is necessary
for effective redevelopment and is not included for the .
purpose of obtaining the allocation of tax increment revenues
from such area pursuant to California Health and Safety Code
Section 33670 without other substantial justification for
its inclusion.
I. 'The elimination of blight and the redevelopment
of the Surfs ide Redevelopment Project could not be reasonably
expected to be accomplished by private enterprise acting

alone without the aid and assistance of the Redevelopment
Agency of the City of Seal Beach.
Section 4. Even though there are no plans for the
acquisition of housing facilities at the present time within
the Surfs ide Redevelopment Project, based upon the various
reports and other information provided to the City Council,
the City Council is satisfied permanent housing facilities
will be available within three years from the time occupants
of the Surfs ide Redevelopment Project may be displaced and
that pending the development of such facilities, there will
be available to such occupants who may be displaced adequate
temporary housing facilities at rents comparable to those at
the time of displacement.
Section 5. Based upon the reports and information
provided to the City Council, the City Council is convinced
that the effect of tax increment financing will not cause a
severe financial burden or detriment on any taxing agency
deriving revenues from the Surfs ide Redevelopment project.

THE REDEVELOPMENT PLAN
FOR THE
SURFS IDE REDEVELOPMENT PROJECT
INTRODUCTION
A. DEFINITIONS
"Agency. means the Redevelopment Agency of the City of
Seal Beach.
"City" means the City of Seal Beach.
"City Council" means the City Council of the City.
"Project Area" means Surfside Redevelopment Project,
more particularly described in Section I.
"Redevelopment Law" means the Community Redevelopment
Law, California Health and Safety Code Sections 33000.
et seq.
"Redevelopment Plan" means this Redevelopment Plan for
the Project Area.
B. PURPOSES AND OBJECTIVES
The purposes and objectives of the Redevelopment Plan
are to remove blighting influences in the Project Area
by the installation and construction of improvements to
prevent further erosion of a public beach.

Allocation of Taxes.

Taxes, if any, levi.~ upon taxable property in the
territory describea in Section I, above, each year by
or for the ben~fit of the State of California, any city,
county, city and county, aistrict, or other public
corporation (hereinafter sometimes callea -taxing
agencies.) after the effective aate of the Orainance
approving this Redevelopment Plan, shall be aivided as
follows:
(a) That portion of the taxes which would be proaueed
by the rate upon which the tax is levied each year by
or for each of the taxing agencies upon the total sum
of the assessed value of the taxable property in the
territory described in Section I as shown upon the
assessment roll used in connection with the taxation of
such prcperty by such taxing agency, last equalized
prior to the effective date of such Ordinance, shall be
allocatea to ana when collectea shall be paia to the
respective taxing aqencies as taxes by or for saia
taxing agencies on all other property are paia (for the
purpose of allocating taxes levied by or for any taxing
agency or agencies which did not include such territory

excess of such amount shall be allocated to and when
collected shall be paid into a special fund of the
Agency to pay the principal of and interest on loans,
moneys advanced to, or indebtedness (whether funded,
refunded, assumed, or otherwise) incurred by the Agency
to finance or refinance, in whole or in part, the
redevelopment project. Onless and until the total
assessed valuation of the taxable property in the
territory described in Section I exceeds the total
assessed value of the taxable property therein as shown
by the last equalized assessment roll referred to in
subdivision (a), all of the taxes levied and collected
upon the taxable property in such territory shall be
paid to the respective taxing agencies. When such
loans, advances, and indebtedness, if any, and interest
thereon, have been paid, all moneys thereafter received
fram taxes upon the taxable property in such territory
shall be paid to the respective taxing agencies as
taxes on all other property are paid.

III. Limitation on the Amount of Taxes Which May Be Allocated II

Agency from the Project Area shall not exceed $1,000,000.

IV. A Limit on the Establishment of Loans, Advances and
Indebtedness
No loans, advances, or indebtedness to be repaid from
the allocation of taxes described in Section II above,
shall be established or incurred by the Agency beyond a
period net to exceed two (2) years from the effective
date of the Ordinance adopting the Redevelopment
Plan.

XIII. A Statement Describing the Limitation on ~ype, Size,
Height, Number and Proposed Use of BuildinQs in the

determined by the Zoning Ordinance of the City of Seal
Beach and other applicable Pederal, state and local
laws, rules and regulations.

Public Purposes in the Project Area
The property to be devoted to public purposes in the
Project Area includes all public streets and rights-of-
way which may be used for vehicular and/or pedestrian
traffic and all other public improvements, public and
private utilities typically found in public rights-of-
way, aS,well as the improvements set forth in Paragraph
B of the Introduction to the Redevelopment Plan.

XVI. The Proposed Method of Pinancinq the RedeveloPMent of II

The Agency may issue bonds and expend the proceeds from
their sale in carrying out the redevelopment of the
Project Area. The Agency may finance the redevelopment
of the Projeet Area ~ the issuance of bonds payable

II XVII. A Limitation on ~he Amount of Bonded Indebtedness

XVIII. Dwelling Units Destroyed or Removed from the Low and
Moderate Income Sousing Market
Khenever dwelling units housing persons and families
of low or moderate income are destroyed or removed
from the low and moderate income housing market as
part of the redevelopment of the Project Area, the
Agency shall, within four (4) years of such destruc-
tion or removal, rehabilitate, develop, or construct
or cause to be rehabilitated, developed, or constructed
for rental or sale to persons and families of low or

Project Area or within the City.

XIX. Payment to Taxing Agencies
The Agency may pay to any taxing agency which levies a
property tax in the Project Area, an amount it deems
appropriate to alleviate any financial bur~en or

XXI. Safeguards
To provide adequate safeguards to ensure that the
provisions of the Redevelopment Plan will be carried
out and to prevent the recurrence of blight in the
Project Area, all real property sold, leasea, -oT
conveyed by the Agency, as well as property subject to

owner participation agreements, shall be made subject
to the provisions of the Redevelopment Plan by leases,
aeeds, contracts, agreements, declarations or restric-
tions, provisions of the zoning ordinance of the City,
conditional use permits, and ,other Federal, state and
local laws, rules and regulations. Where appropriate,
as determined by the Agency, such documents or portions
thereof shall be recorded in the office of the Recorder
of the County of Orange. The Agency has no intention
to acquire real property other than that which is
necessary, appropriate or incidental to the installation
of the improvements set forth in Paragraph B of the
Introduction to the Redevelopment Plan.

XXII. Retention of Controls
The Agency or City Council may tmpose further restric-
tions and controls on the land leased or sold by the
Agency for such periods of ttme and under such condi-
tions as deemed necessary to effectuate tbe purposes
of the Redevelopment Law. ~he Agency bas no intention
to acquire real property other than that which is
necessary, appropriate or incidental to the installa-
tion of the improvements set forth in Paragraph B of
the Introduction to the Redevelopment Plan.

XXIII. Non~iscrimination
All property in tbe territory in the Project Area is
hereby subject to the restriction tbat there shall be
no discrimination or segregation based upon race,
color, creed, religion, national origin, sex, marital
status or ancestry, in the sale, lease, sublease,
transfer, use, occupancy, tenure or enjoyment of
property in such territory. All property sold,
leased, conveyed, or subject to a participation
agreement shall be made expressly subject by appro-
priate ~ocuments to the restriction that all deeds,
leases, or contracts for the sale, lease, sublease or

XXV. Partici~ation in the Redevelopment of the Territorv in
the Project Area.
Each person desiring to become a participant in the
redevelopment of the territory in the Project Area
shall enter into an owner participation agreement with
the Agency pursuant to which the participant agrees to
rehabilitate, develop, or use the property in conformance
with the Redevelopment Plan and subject to such other
provisions as may be provided by the Agency. In such
agreements, participants who retain real property shall
join in the recordation of such documents as determined

XXVI. Redevelopment of the proiect Area If the Owners rail
to Participate as Agreed.
In the event that an owner of property in the Project
Area fails to participate as agreed, the Agency may

ment Plan. The Agency has no intention to acquire
