Council with respect are as follows: The purposes and intent of the City to the Surfside Redevelopment Project A. To eliminate the conditions of blight existing in the Surfside Redevelopment project; B. To prevent the recurrence of blighting conditions within the Surfside Redevelopment Project; C. To provide for the construction of public improvements and to improve the quality of the environment in the Surfs ide Redevelopment project for the benefit of the Project Area and the surrounding community. Section 2. The Redevelopment Plan for the Surfs ide Redevelopment Project (the -Redevelopment Plan-), attached hereto as Exhibit A, is incorporated herein by this reference. S@ction 3.. Based upon the various reports and other information provided to the City Council, the City Council hereby finds and determines that: A. The Surfs ide Redevelopment Project is a blighted area, the redevelopment of which is necessary to effectuate the public purposes declared in the Community Redevelopment Law of the State of California (Health and Safety Code Sections 33000, et seq.). B. The Redevelopment Plan would redevelop the Surfs ide Redevelopment Project in conformity with the Community Redevelopment Law and in the interest of the public peace, health, safety and welfare. C. The aqoption and carrying out of the Redevelop- ment Plan for the Surfs ide Redevelopment Project is economically sound and feasible. I I I I I Ordinance N~mbe~ "I'~~ 82-~~o939 -, D. The Redevelopment Plan for the Surfside Redevelopment Project conforms to the General Plan of the City of Seal Beach insofar as such General Plan is applicable to the Surfs ide Redevelopment Project. E. The carrying out of the Redevelopment Plan for the Surfs ide Redevelopment Project would promote the public peace, health, safety and welfare of the City of Seal Beach and would effectuate the purposes and policies of the Community Redevelopment Law. r. Even though there are no plans for th6 acquis- ition of housing facilities at the present time within the Surfside Redevelopment Project, the Redevelopment Agency of the City of Seal Beach has a feasible method or plan ~or the relocation of families and persons which may be displaced from the Surfs ide Redevelopment Project if the Redevelopment Plan may result in the temporary or permanent displacement of any occupants of housing facilities in the Surfs ide Redevelopment Project. G. Even though there are no plans for the acquis- ition of housing facilities at the present time within the Surfs ide Redevelopment Project, there are or are being provided in the Surfs ide Redevelopment Project or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons who may be displaced from the Surfs ide Redevelopment Project, decent, safe and sanitary dwellings equal in number to the number of and available to such displaced families and persons and .reasonably accessible to their places of employment. H. The inclusion in the Surfs ide Redevelopment Project of any lands, buildings or improvements which are not detrimental to the pUblic health, safety, or welfare is necessary for the effective redevelopment of the area of which they are a part; any such area included is necessary for effective redevelopment and is not included for the . purpose of obtaining the allocation of tax increment revenues from such area pursuant to California Health and Safety Code Section 33670 without other substantial justification for its inclusion. I. Section 4. Even though there are no plans for the acquisition of housing facilities at the present time within the Surfs ide Redevelopment Project, based upon the various reports and other information provided to the City Council, the City Council is satisfied permanent housing facilities will be available within three years from the time occupants of the Surfs ide Redevelopment Project may be displaced and that pending the development of such facilities, there will be available to such occupants who may be displaced adequate temporary housing facilities at rents comparable to those at the time of displacement. Section 5. Based upon the reports and information provided to the City Council, the City Council is convinced that the effect of tax increment financing will not cause a severe financial burden or detriment on any taxing agency deriving revenues from the Surfs ide Redevelopment project. ~ U . ~ASSED. DEFINITIONS "Agency. means the Redevelopment Agency of the City of Seal Beach. "City" means the City of Seal Beach. "City Council" means the City Council of the City. "Project Area" means Surfside Redevelopment Project, more particularly described in Section I. "Redevelopment Law" means the Community Redevelopment Law, California Health and Safety Code Sections 33000. et seq. "Redevelopment Plan" means this Redevelopment Plan for the Project Area. B. Limitation on the Amount of Taxes Which May Be Allocated II to the Aqency The amount of taxes which may be allocated to the Agency from the Project Area shall not exceed $1,000,000. A Statement Describing the Approximate Number of II Dwelling Units in the Territory in the Project Area There are currently 250 dwelling units in the project Area. A Statement Describing the Property to be Devoted to Public Purposes in the Project Area The property to be devoted to public purposes in the Project Area includes all public streets and rights-of- way which may be used for vehicular and/or pedestrian traffic and all other public improvements, public and private utilities typically found in public rights-of- way, aS,well as the improvements set forth in Paragraph B of the Introduction to the Redevelopment Plan. - --, ~ ~ I .,--'-\ --- Ordinance Number ~ WLS78':'l4A ' 82-~~6939 XVI. The Proposed Method of Pinancinq the RedeveloPMent of II Territorv in the Project Area The Agency may issue bonds and expend the proceeds from their sale in carrying out the redevelopment of the Project Area. The Agency may finance the redevelopment of the Projeet Area ~ the issuance of bonds payable from taxes allocated to the Agency pursuant to Section II above or ~ any other legally available means. A Limitation on ~he Amount of Bonded Indebtedness Payable from Taxes Allocated to the Agency from the Project Area Which May Be Outstanding at Any One ~ The amount of bonded indebtedness to be repaid in whole or in part from taxes allocated to the Agency pursuant to Section II above which can be outstanding at one time shall not exceed $400,000 without an amendment to this Redevelopment Plan. Dwelling Units Destroyed or Removed from the Low and Moderate Income Sousing Market Khenever dwelling units housing persons and families of low or moderate income are destroyed or removed from the low and moderate income housing market as part of the redevelopment of the Project Area, the Agency shall, within four (4) years of such destruc- tion or removal, rehabilitate, develop, or construct or cause to be rehabilitated, developed, or constructed for rental or sale to persons and families of low or -- moderate income an equal number of replacement dwel- ling units at affordable housing cost within the Project Area or within the City. Payment to Taxing Agencies The Agency may pay to any taxing agency which levies a property tax in the Project Area, an amount it deems appropriate to alleviate any financial bur~en or detriment caused to any taxing agency by the redevelop- ment project contemplate~ by the Re~evelopment Plan. The Lease of Sale of Real Property The Agency shall sell or lease all real property I - . acquired by it in the Project Area except property conveyed to it by the City. The Agency bas no intention to acquire real property other than that which is necessary, appropriate or incidental to the installation of the improvements set forth in Paragraph B of the .' Safeguards To provide adequate safeguards to ensure that the provisions of the Redevelopment Plan will be carried out and to prevent the recurrence of blight in the Project Area, all real property sold, leasea, -oT conveyed by the Agency, as well as property subject to " ' owner participation agreements, shall be made subject to the provisions of the Redevelopment Plan by leases, aeeds, contracts, agreements, declarations or restric- tions, provisions of the zoning ordinance of the City, conditional use permits, and ,other Federal, state and local laws, rules and regulations. Where appropriate, as determined by the Agency, such documents or portions thereof shall be recorded in the office of the Recorder of the County of Orange. Retention of Controls The Agency or City Council may tmpose further restric- tions and controls on the land leased or sold by the Agency for such periods of ttme and under such condi- tions as deemed necessary to effectuate tbe purposes of the Redevelopment Law. ~he Agency bas no intention to acquire real property other than that which is necessary, appropriate or incidental to the installa- tion of the improvements set forth in Paragraph B of the Introduction to the Redevelopment Plan. Non~iscrimination All property in tbe territory in the Project Area is hereby subject to the restriction tbat there shall be no discrimination or segregation based upon race, color, creed, religion, national origin, sex, marital status or ancestry, in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoyment of property in such territory. All property sold, leased, conveyed, or subject to a participation agreement shall be made expressly subject by appro- priate ~ocuments to the restriction that all deeds, leases, or contracts for the sale, lease, sublease or other transfer of land in such territory sba11 contain such non~iscrimination and nonsegregation clauses as may be required by law. All deeds, leases or contracts for the sale, lease, sublease or other transfer of any land in such territory shall contain tbe nondiscrtmination clauses prescribed in the Redevelopment Law. -~-_._- ,I ~.__.- Ordinance Number ~ WLS7B-22A 82-446939 XXIV. Other Covenants, Conditions, Restrictions Prescribed by the City Council Tbe redevelopment of tbe Project Area sball be carried out in accordance witb any otber covenants, conditions, or restrictions as may be hereafter prescribed by City Council. I I I , < Ordinance Number ~ . . WLS78-23A 82-~~6939 I XXV. Partici~ation in the Redevelopment of the Territorv in the Project Area. Each person desiring to become a participant in the redevelopment of the territory in the Project Area shall enter into an owner participation agreement with the Agency pursuant to which the participant agrees to rehabilitate, develop, or use the property in conformance with the Redevelopment Plan and subject to such other provisions as may be provided by the Agency. In such agreements, participants who retain real property shall join in the recordation of such documents as determined I by the Agency. I Ordinance NUr.1ber 1131 . WLS78-2U 82-1t~6939 XXVI. Redevelopment of the proiect Area If the Owners rail to Participate as Agreed. In the event that an owner of property in the Project Area fails to participate as agreed, the Agency may acquire such property by any available means or may take any other action to ensure that redevelopment is carried out pursuant to the provisions of the Redevelop- ment Plan. The Agency has no intention to acquire real property other than that which is necessary, appropriate or incidental to the installation of the improvements set forth in Paragraph B of the Introduc- tion to the Redevelopment Plan.
