RESOLUTION NO. ;( 7) 1 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL CONDITIONALLY APPROVING TENTATIVE TRACT MAP NO. 10081. ,~i'HEREAS , an application was duly filed by Montecito Eight. a limited partnership, 9461 Grindlay Street, Cypress for Tentative Tract Map No. 10081; and the property is presently described as Lot 5, Tract No. 9458 and is more commonly known as 12550 Montecito Road, Seal Beach; and WHEREAS, the proposal is to convert a nine unit apartment building into a nine unit co~dominium in the R-3 zone; and i~iHEREAS , ,}mEREAS, on October 5, 1977, the Planning Commission considered the proposed Tentative Tract Map and recommended to City Council, conditional approval of the Tract Map; and ~WHEREAS, the City Council makes the following findings regarding the Tract Map: 1. The site is physically suitable for development; the land is flat and it is located in a developed area with exist- ing streets, utilities, residences and commercial activities located adjacent to the project site. 2. The site is suitable for the proposed density of development; other projects of similar density have been constructed and are compatible. with the area. 3. The design of the subdivision will not cause substantial environmental damage. . 4. The design of the subdivision is not likely to cause serious public health problems because all the necessary utiliites and services are available for the project. 5. The design of the subdivision will not conflict with ease- ments, acqlJi red by the publ i c at 1 arge for access tl1rough, or use of, property within the proposed subdivision because no easements acquired by the pUblic at large are located on the project site. 6. The discharge of waste from the proposed subdivision into the existing community sewer system will not violate existing requirements prescribed by the local regional water quality control board pursuant to Division 7 of the Water Code. 7. No residents will be displaced by the project because no units a~e occupied. 8. The project is exempt from the provisions of C.E.Q.A. "<;l-(()W, THEREFORE BE IT RESOLVED that the City Council does hereby approve ;~entative Tract Map No. 10081 subject to the following conditions: 1. . Payment of in lieu subdivision fees be paid to the city for recreational purposes. These fees are to be paid for the conversion of the apartment units into condominiums prior to the issuance of occupancy permits for the units. 3. Installation of three new fire hydrants and upgrading of two existing fire hydrants to city standards to the satisfaction of the Fire Chief. 4. Installation of emergency access pass through gates in locations specified by the Fire Chief in the rear wall. 5. Installation of automatic garage door openers on all garages. 6. landscaping plans to be submitted to the satisfaction of the staff.
