RESOLUTION NO. 00-17
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
00-2, PERMITTING THE CONSTRUCTION OF A COVERED
ROOF ACCESS STRUCTURE IN CONJUNCTION WITH THE
CONSTRUCTION OF A NEW SINGLE FAMILY DWELLING
AT A-59 SURFSIDE.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
Section 1. On April 12, 2000 Tony Ursino ("The Applicant") submitted an
application for Height Variation 00-2 with the Department of Development Services. The
applicant is proposing to construct a covered roof access structure (CRAS) leading to a roof deck
in excess of the height limit in conjunction with the construction of a new single family dwelling at
A-59 Surfside.
Section 2. Pursuant to 14 Calif Code of Regs. 9 15025(a) and 9 II.A of the
City's Local CEQA Guidelines, statThas determined as follows: The application for Height
Variation No. 00-2 is categorically exempt from review pursuant to the California Environmental
Quality Act pursuant to 14 Calif Code of Regs. 9 15303(a) (New Construction of Small
Structures), because the application is for the construction of three (3) or less single family
dwellings in an urbanized area; 9 15305 (Minor Alterations in Land Use Limitations) because the
request is for a minor alteration in land use limitations in an area with an average slope of less
than 20% and no changes in land use or density are involved; and, pursuant to 9 15061(b)(3),
because it can be seen with certainty that there is no possibility that the approval may have a
significant effect on the environment.
Section 3. A duly noticed public hearing was held before the Planning
Commission on May 17, 2000 to consider Height Variation 00-2.
Section 4.
The record of the hearing indicates the following:

(c) The subject property is described as Orange County Assessor's
Parcel Number 178-471-45 and is located within the private community of Surfside.
(d) The subject property is nearly rectangular in shape with a lot area of
1112 square feet (25' x 44.5').
(e) The surrounding land uses and zoning are as follows:
NORTH Residential housing in a RLD zone within the Surfside Colony and open
space located within the Seal Beach Naval Weapons Station in the Public Land
Use/Recreation zone (PLU/R).
SOUTH Beach in a Public Land Use/Recreation (PLU/R) Zone and the Pacific
Ocean
EAST & WEST Single family dwellings located in the Residential Low Density zone
(RLD) of Surfside.

(f) As of May 10, 2000, staff has received no written responses to its
mailed notice regarding Height Variation 00-2.
Section 5. Based upon the evidence in the record, including the facts stated in
94 of this resolution and pursuant to 9 28-2317(4) of the City's Code, the Planning Commission
hereby finds as follows:
(a) Height Variation 00-2 is consistent with the provisions of the
Land Use Element of the City's General Plan, which provides a "low density residential"
designation for the subject proper1y and permits single family residential uses. The use is also
consistent with the remaining elements of the City's General Plan as the policies of those elements
are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed use is
consistent with the General Plan.
(b) The proposed CRAS is architecturally in keeping with the
remainder of the structure, with the roofing materials and siding matching those of the remainder
of the structure.
(c) The proposed CRAS is appropriate for the character and integrity
of the surrounding neighborhood where a number of similar structures are located within the
immediate vicinity.
(d) No habitable living space is provided within the structure.
(e) Due to the relatively flat terrain in the vicinity of the proposed
structure, it does not significantly impair the primary view of any property located within 300 feet
of the subject property.
Section 6. Based on the foregoing, the Planning Commission hereby approves Height
Variation 00-2, subject to the following conditions:
1. HV 00-2 is approved for the construction of a covered roof access structure (CRAS)
leading to the roofdeck in excess of the height limit in conjunction with the
construction of new a single f.1mily dwelling at A-59 Surfside, Seal Beach.
2. All construction shall be in substantial compliance with the plans approved through
HV 00-2.
3. There shall be no habitable space permitted within the covered roof access structure.
4. This Height Variation shall not become efTective for any purpose unless an
"Acceptance of Conditions" form has been signed by the applicant in the presence of
the Director of Development Services, or notarized and returned to the Planning
Department; and until the ten (10) day appeal period has elapsed.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach
at a meeting thereof held on the l7'h day of May, 2000, by the following vote:

00-3 PERMITTING THE EXPANSION OF THE MASTER

BEDROOM AND ADDITION OF ABA THROOM BY
APPROXIMATELY 209 SQUARE FEET AT THE PROPERTY
LOCATED 241 I7tl'ST.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
Section 1. On April 26, 2000, Stacie Hill ("The Applicant") submitted an
application for Minor Plan Review 00-3 with the Department of Development Services. The
applicant sought to expand an existing master bedroom and add an additional bathroom by
approximately 209 square feet.
Section 2. Pursuant to 14 Calif. Code of Regs. 9 I5025(a) and 9 ILA of the
City's Local CEQA Guidelines, staff has determined as follows: The application for Minor Plan
Review No. 00-3 is categorically exempt from review pursuant to the California Environmental
Quality Act pursuant to 14 Calif Code of Regs. 9 l530I(e) (Existing Facilities), because it
involves an addition to an existing residential structure which increases the floor area by less than
50% and is less than 2,500 square feet in area; and, pursuant to S 1506 I (b )(3), because it can be
seen with certainty that there is no possibility that the approval may have a significant effect on
the environment.
Section 3. A duly noticed hearing was held before the Planning Commission
on May 17, 2000 to consider Minor Plan Review 00-3.
Section 4.

inadequate side yard setbacks and density.
(c) The subject property is described as Orange County Assessor's
Parcel Number 199-064-08 and is located in the Residential Medium Density (RMD) zone of Old
Town.

Section 5. Based upon the evidence in the record, including the facts stated in
94 of this resolution and pursuant to 9 28-2407 of the City's Code, the Planning Commission
hereby finds as follows:
(a) Minor Plan Review 00-3 is consistent with the provisions of the
Land Use Element of the City's General Plan, which provides a "medium density residential"
designation for the subject property and permits single- and multi-family residential uses. The use
is also consistent with the remaining elements of the City's General Plan as the policies of those
elements are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed
use is consistent with the General Plan.
Section 6. Based on the foregoing, the Planning Commission hereby approves
Minor Plan Review 00-3, subject to the following conditions:

1. Minor Plan Review 00-3 is approved for the property located at 241 17tl1 St. Specifically,
MPR 00-3 is approved for the expansion and remodel of the master bedroom and addition of
a bath by approximately 209 square feet.
2. All construction shall be in substantial compliance with the plans approved through MPR 00-
3.
3. This Minor Plan Review shall not become effective for any purpose unless an "Acceptance of
Conditions" form has been signed by the applicant in the presence of the Director of
Development Services, or notarized and returned to the Planning Department; and until the
ten (10) day appeal period has elapsed.
4. The garage needs to be 1 hour rated between the apartment and the garage area, as per
Uniform Building Code.
5. The Water Heater in the garage needs to be strapped to the wall, as per Uniform Building
Code.
6. All new GFI outlets must be installed in the garage.
7. The Garage electrical system must be completely rewired to meet current code.
8. Both the main house and the apartment unit must have new electrical service installed with
100 amp service.
9. A new subpanel must be installed in the main house.
10. The main house must have new GFI outlets installed in the kitchen and bedrooms, where they
currently have none.
I I. The garbage disposal needs to be rewired.
