ORDINANCE NO. 990
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SEAL BEACH REPEALING ORDINANCE
NO. 897, CHAPTER 21, SUBDIVISIONS OF THE
CITY CODE AND ADOPTING A SUBDIVISION
ORDINANCE AS CHAPTER 21 OF THE CITY CODE.
THE CITY COUNCIL DOES ORDAIN AS FOLLOWS:
Sec. 1. Ordinance No. 897 is hereby repealed.
Sec. 2. The followin9 is hereby adopted as the Subdivision Code of the City of
Seal Beach as Chapter 21 of the Code of the City of Seal Beach.
CHAPTER 21
SUBDIVISIONS
Article 1. General Provisions
Sec. 21-1. Citation and Authority. This Code is to regulate the design and
improvement of the subdivisions and is adopted to supplement and implement the
existing State Subdivisions Map Act as last amended to and may be cited as the
Subdivision Code of the City of Seal Beach.

Sec. 21-2. Definitions. Whenever any words or phrases as used in this Code
are not defined herein but are defined in the Subdivision Map Act, such defini-
tions are incorporated herein and shall be d~emed to apply as though set forth
in this Code. Any other definitions not contained in this Code or the Sub-
division Map Act shall be those definitions contained in the Code of the City
of Seal Beach, the General Plan of the City of Seal Beach, the California Motor
Vehicle Code, the California Streets and Highways Code, the Government Code, or
Webster's Dictionary unless another meaning is clearly implied.
Sec. 21-3. Advisory AyenCy. The Planning Commission is designated as the
Advisory Agency that sha 1 make investigations and reports on the design and
improvements of any proposed division of real property for which a tentative
map is filed, and shall have the authority to impose requirements and con-
ditions upon such division of land. The Clerk of the Advisory Agency shall
be the Secretary of the Planning Commission. A tentative map shall be re-
quired for parcel maps and final subdivision maps. The Chief Building Official,
Planning Director, Public Works Director, and other department heads shall
advise and assist in making investigations and reports on tentative maps. The
Planning Commission shall include in its report a finding that the proposed
division of real property is consistent with the General Plan with exceptions
noted to comply with Sec. 65 402(a) of the Government Code.
Sec. 21-4. Appeal Board. The Appeal Board shall be the City Council of the
City of Seal Beach, California. The City Council shall also have the authority
to approve, conditionally approve, or disapprove all maps.
Article III. Procedures
Sec. 21-5. Tentative Maps. When a subdivision or parcel map is required by
this Code, a tentative map shall first be filed with the Clerk of the Advisory
Agency. Said map shall meet all the requirements for tentative maps required
by the Subdivision Map Act and this Code. The dedications and improvements ,
required for parcel maps shall be the same as for subdivisons and all dedications
shall be shown on the tentative maps.
Sec. 21-6. Filing of Tentative Map. Tentative parcel maps and subdivision
maps shall be filed with the Clerk of the Advisory Agency and shall be processed
in accordance with the, Subdivision Map Act and the provisions of this Code.
The subdivider shall file as many copies of the tentative map as may be required
by the Advisory Agency.
Minimum requirements for such tentative maps include:
(a) Tract number, if the proposed division of land is a subdivision as defined
in the Subdivision Map Act.

(b) Date, north point and scale.
(c) Sufficient legal description of land to define boundaries of proposed
division of land.
(d) A key map indicating the location of the proposed division of land in
relation to the surrounding area.
(e) The name and address of the record owner, the subdivider and the
civil en9ineer or licensed surveyor under whose direction the map was prepared,
includin9 the registration number of the engineer or surveyor.
(f) The eXisting topography of the land proposed to be divided using
contour intervals of not more than five feet (5'), and of not more than two feet
(2') where the grade of the land is less than five percent (5%). Contours of
adjacent land shall also be shown whenever the surface features of such land
affect the design and/or improvement of the proposed division. The tentative
map shall contain a statement by the person preparing the map stating the
source of contours shown on the map.
(g) The approximate location and outline to scale of each building or
structure on the property proposed for division. Buildings or structures on
adjacent property shall also be shown if such buildings or structures affect
the design of the proposed subdivision. Each building shown shall ~e identified
by house number or other identifying feature, including a notation on each
building or structure to be retained.
(h) The approximate location of all areas subject to inundation or storm
water overflow and the location, width, and direction 'of flow of each water
course.
(i) The approximate location of each area covered by trees with a state-
ment of the nature of the cover and the kind and approximate location of all
trees standing within the boundaries of proposed public right-of-way.
(j) The location, width, approximate grade and curb radii of all existing
and proposed streets and highways within and adjacent to the proposed subdivision.
(k) The width, purpose, and approximate location of all existing and pro-
posed easements or rights-of-way, whether public or private, within and adjacent
to the proposed subdivision,
(1) The approximate radius of each center line curve.
(m) The approximate lot layout; the approximate dimensions of each lot;
and the approximate location of all cut and fill slopes.
(n) Each street shown by its actual street name or by a temporary name or
letter for purpose of identification until the proper name of such street is
determined.
(0) The name or names of any geologist or soils engineer whose services
were required in tne preparation of the design of the tentative map,
(p) A geologic soils report prepared by a civil eny'illeer who is registered
by the State, based upon adequate test borings or excavations, unless the
Building Department shall determine that, due to the knowledge such department
has as to the soil qilalities of the soil of such subdivision or lot, no pre-
liminary analysis is necessary. If the nrelimin~rv ~oils renort i~~icates t~e
presence of critically expansive soils or other sOll problems which, if not
corrected, would lead to structural defects, the person filing the tentative
map shall submit a soils investigation of each lot in the subdivision, prepared

Sec. 21-12. Requirements. As a condition of approval of a final map or
parcel map, the subdivider shall dedicate land, pay a fee in lieu thereof,
or both, at the option of the City as determined at the time of tentative
map approval for park or recreational purposes based on a fee of $175.00
per person or a dedication of 0.004 acres of land per person estimated to
reside in the proposed subdivision. The number of persons estimated to re-
side in a proposed subdivision shall be calculated based on 3.8 persons per
single family, 1.9 persons per mobile home unit, and 2.4 persons per multiple
family unit. The above fee in lieu of dedication is based on the current
estimated value of single family residential land.
Where private open space for park and recreational purposes is provided in
a proposed subdivision and such space is to be privately owned and main-
tained by the future residents of the subdivision, partial credit, not to
exceed 50% may be given against the requirements of land dedication or pay-
ment of fees in lieu thereof if the City Council finds that it is in the
public interest to do so and provided that the use of the Private open space
is restricted for park and recreational purposes by recorded covenant, which
runs with the land in favor of the future owners of the property and which
cannot be defeated or eliminated without the consent of the City or its
successors.
Sec. 21-13. Improvements. The subdivider at his sole expense shall provide
the following minimum improvements when appropriate.
(1) Water distribution supply lines for fire protection and a domestic
water supply, including water meters, to each lot.
(2) Sewage collection system.
(3) Adequate drainage of the subdivision including any necessary storm
drai ns.
(4) Adequate circulation within or to the subdivision including streets,
highways, or alleys.
(5) Adequate grading and surfacing of streets, highways, ways and alleys.
(6) Curbs and gutters, cross gutters and sidewalks.
(7) Survey monuments.
(8) Fire hydrants at locations designated by the City Engineer.
(9) Street name signs, at locations designated by the City Engineer.
(10) Barricades and safety devices as determined to be necessary by the
City Engineer.
(11):Ornamental street lights as determined to be necessary by the City
Engi neer.
(12) Underground electrical and. communications distribution systems,
(13) Solid perimeter fencing six feet in height around the entire
subidivision.
(14) Traffic regulatory signs as required by the City Engineer.
(15) Street trees as required by the City Engineer or the payment of a
fee in lieu thereof.
(16) A system of bicycle trails as required by the City Engineer.
(17) Landscaping of public open space as required by the City Engineer.

by a civil engineer who is registered in the State, which shall recommend
corrective action which is likely to prevent structural damage to each
dwelling proposed to be constructed on the expansive soil. The Building
Department shall approve the soils investigation if it determines that
the recommended action is likely to prevent structural damage to each
dwelling to be constructed and shall require that the approved recommended
action be incorporated in the construction of each dwelling as a condition
of the building permit. Appeal from such determination shall be to the
Board of Building and Fire Code Appeals.
If the Superintendent of the Building Department finds that a written
geological report is necessary to determine whether the property to be
divided is subject to an existing or potential geological hazard, the
person filing the tentative map shall submit such a report to the Advisory
Agency.
(q) At its option, the Advisory Agency may require all proposed
dedications or offers of dedication to be made by deed,
Such information may be furnished separately from the map itself.
The Advisory Agency may waive any of the foregoing requirements whenever
the Advisory Agency finds that the type of subdivision is such that
compliance is unnecessary or that other circumstances justify the waiver.
The Advisory Agency may require such additional drawings, data, or other
information as are deemed reasonably necessary.
Sec. 21-7. Survey and Record Data. If a Parcel Map is required such map
shall be based either upon a field survey made in conformity with the Land
Surveyors Act or be compiled from recorded or filed data when sufficient
survey information exists on filed maps to locate and retrace the exterior
boundary lines of the parcel map if the location of at least one of these
boundary lines can be established from an existing monumental line.
Sec. 21-8. Tentative Map Processing Fee. Every person submitting a tentative
or final map shall pay a processing fee in an amount prescribed by Resolution
of the City Council.
Sec. 21-9. Tentative Parcel and Subdivision Map expiration extensions.
Upon application of the subdivider filed prior to the expiration of the approved
or conditionally approved tentative map, the time at which such map expires may
be extended by the Advisory Agency for a period not exceeding two (2) years.
If no application is filed by the subdivider the expiration date may be ex-
tended by the Advisory Agency for a period not exceeding eighteen (18) months.
In granting an extension, new conditions of approval may be imposed and existing
conditions may be revised.
Sec. 21-10. Dedications. As a condition of approval of a Subdivision or
Parcel Map the Advisory Agency may require the dedication or irrevocable offer
of dedication of real property within the subdivision for streets, alleys, in-
cluding access rights and abutters rights, drainage, public utility easements
and other public easements.
Park and Recreation Dedications and Fees
Sec. 21-11. Puraose. Pursuant to the authority granted by Section 66477 of
the Government Co e of the State of California, park and recreational facilities
requiring dedication of land and/or payment of a fee are hereby required by
this Code. Such requirements shall be consistent with the recreational element
of the General Plan of the City of Seal Beach.

(18) Any other improvements required by the City Council as a condition
of approval of the subdivision
Subdivision improvements shall conform to the latest plans and specifications
included in the "City of Seal Beach Standard Plans and Specifications for
Pub 1 i c Improvements", "County of Orange Standard Street and Hi ghway Pl ans",
"Orange County Water Works Districts Standard Specifications", and "Orange
County Sanitation District Standard Details"; Three copies of the above
improvement standards, specifications, and details shall be maintained on
fil e in the offi ce of the City Cl erk.
Sec. 3. The City Clerk shall certify to the adoption of this
