", ORDINANCE NO. 1010 AN ORDINANCE OF THE CITY OF SEAL BEACH ADOPTING BY REFERENCE, THE UNIFORM FIRE CODE, 1976 EDITION, COMPILED BY THE INTER- NATIONAL CONFERENCE OF BUILDING OFFICIALS AND THE WESTERN FIRE CHIEFS ASSOCIATION; AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 5-1(1) of Article I of Chapter 5 of the Code of the City of Seal Beach, California, is hereby deleted, and subsection 5-l(M) is redesignated as 5-l(L). Section 2. Section 9-1 of Article 1 of Chapter 9 of the Code of the City of Seal Beach, California, is hereby amended in its entirety to read: "Section 9-1. Uniform Fire Code - Adoption "The Uniform Fire Code, 1976 Edition, as prepared by the International Conference of Building Officials and the Western Fire Chiefs Association, is hereby adopted as the Uniform Fire Code of the City of Seal Beach. Said Code may be referred to as the 'Fire Code'. "Three (3) copies of said Fire Code have been depos- ited with the office of the City Clerk of the City of Seal Beach and shall be at all times maintained by said Clerk for use and examination by the public." Section 3. Section 9-2 of Article I of Chapter 9 of the Code of the City of Seal Beach, California, is hereby amended in its entirety to read: "Section 9-2 Same - Definitions. "For the purposes of the Uniform Fire Code adopted by Section 9-1 of the Code of the City of Seal Beach, California, the following words and phrases shall have the meanings respec- tively ascribed to them by this Section:, "(a) 'Municipality' means the City of Seal Beach. "(b) 'Corporation Counsel' "means the attorney for the City of Seal Beach. "( c) 'Chief Of The Bureau Of Fire prevention' means the Fire Marshal or the appointed head of the Bureau of Fire Prevention." . Section 4. Section 9-3 of Article I of Chapter 9 of the Code of the City of Seal Beach, California, is hereby amended in its entirety to read: "Section 9-3 Same - Amendments. "Notwithstanding the provisions of Section 9-1 of the Code of the City of Seal Beach, the Uniform Fire Code, adopted thereby, is amended by amending Sections 1.422, 12.101, 12.102, l3.30l(c) and 30.101, and adding Sections 10.103(f) and (g), 10.114, 13.209, 13.316, 13.317, 13.318, 13.319, 30:121, 30.122, 30.123, 30.124, 30.125, 30.126, 30.127 and 30.128 to read: -1- Ordinance Number I. '. . .1 ~ ... . I "Section 1.422 'Tank' shall mean a vessel con- taining more than 60 gallons. 'Tank Vehicle' shall mean any vehicle other than railroad tank cars and boats, with a cargo tank mounted thereon or built as an integral part thereof used for the transportation of flammable or combustible liquids, LP Gas, or hazardous chemicals. Tank vehicles include self-propelled vehicles, and full trailers and semi- trailers with or without motive power and carrying part or all of the load. 'Tent' or 'Tent House' shall mean any shelter cover- ing an area in excess of two hundred (200) square feet wherein canvas, or other pliable material is used for any part of any exterior wall or roof, and which is supported in any manner except by air or the contents it protects. 'Test Blasting Cap No.8' shall mean one containing two grams of a mixture of 80 percent mercury fulminate and 20 percent potassium chlorate, or a cap of equivalent strength. 'Thermal Insecticidal Fogging' shall mean the use of insecticidal liquids which are passed through thermal fog generating units where they are, by means of heat, pressure and turbulence, transformed and discharged in the form of fog or mist that is blown into the area to be treated. I "Section 10.103(f). Turnstiles. No turnstiles or similar devices shall be installed or used inside any building used for commercial, business or public assem- blage purposes, nor any other device that shall tend to trap any person within the building. "Section 10.103(g). Clear Passageways. In all occupancies where checkout stands or other similar under- size openings are used, there shall be provided adjacent thereto: a clear passageway or opening to such exit or exits as determined by the occupant load exiting require- ments of the Uniform Building Code of the City of Seal Beach. At no time shall such exit or passageway be obstructed in any manner. "MALLS. "Section 10.114. "(a) General. Every mall shall be provided with exits directly to the exterior as required by the Building Code. I "b) The clear and unobstructed exit width on each side of the mall shall be as required by the Uniform Building Code but in no case be less than 10' wide. The clear area shall be defined, identified and maintained in a manner approved by the Fire Chief. "(c) No display, side show, exhibition or promotional activity or similar use shall be permitted in the center -2- I I I Ordinance Number , , '.. , , area of the mall unless there is first obtained from the Fire Chief a permit to conduct such activity. Included with each permit application shall be a floor plan delin- eating the exact area to be used and showing location of all displays. "(d) All the conditions of Article 26 of this Code shall be applicable when the mall is used for other than, and/or in addition to an exit. . "( e) Not more than 30' between 10' wide cross-aisles shall be permitted except as required or permitted by the Fire Chief. "(f) All flammable material used as, or in conjunction with, a display, side show, exhibition, promotional activity or similar use which would tend to increase the fire and panic hazard shall be maintained in a flame retardant condition or similarly protected in a manner approved by the Fire Chief. "(g) No use shall be permitted which by its nature will impede free and unobstructed exiting due to people congregating to witness or participate. "(h) The use of flammable liquid, liquefied petroleum gas, flammable bottled gases and other materials presenting an unusual fire hazard shall not be permitted as a part of, or in conjunction with, any mall, display, side show, exhibition, promotional activity or other similar use except as permitted by the Fire Chief. "(i) All automatic fire sprinkler systems shall be provided with approved alarm and valve supervision. "Section 12.101. (b) 'Dangerou~ Fireworks' means all fireworks included in Section 12503, Part 2, Division 11 of the Health and Safety Code of the State of California. "Section l2.l0l. (c) 'Safe and Sane Fireworks' means any fireworks not designated as 'Dangerous Fireworks,' except that in all cases only end fuses may be used. "Section 12.102. "(a) The manufacture of fireworks within the juris- dictional area is prohibited except under special permits as are required by this chapter. "(b) The transportation of fireworks within the jurisdictional area is prohibited except under special permits as required by this chapter. "( c) It shall be unlawful for any person to use or explode any fireworks including safe and sane fireworks, as defined by Section 12504 of the Health and Safety Code; provided the Chief of the Fire Department shall have the power to grant permits for supervised public displays of fireworks by a person licensed by the state for the public display of fireworks or for the use of fireworks by artisans in pursuit of their trade. -3- Ordinance Number "., " I "Every such use or display shall be of such character and so located, discharged or fired, as in the opinion of the Fire Chief after proper investigation, is not hazardous to property or a danger to any person. "Except as provided in this article of the Uniform Fire Code and in this chapter, it shall be unlawful for any person to possess, store, offer for sale, expose for sale or sell at wholesale or retail, transport, use or explode any fireworks. "(d) Applications for permits for the public display of fireworks shall be made in writing at least twenty (20) days in advance of the date of the display and shall be filed with the Chief of the Fire Department. After such privilege shall have been granted, possession, use and distribution of fireworks for such display shall be lawful for that purpose only. No permit granted hereunder shall be transferable. "The Fire Chief may impose any condition on the granting of such permit for the public display of fireworks as he determines is necessary to insure that the use or explosion of such fireworks will not be hazardous to property or endanger any person. "Section 13.209. I "Street numbers shall be placed on both the front and rear on those buildings determined by the Fire Chief to require such. Numbers are to be maintained in such a manner as to be plainly visible, easily read, and not hidden from view by trees, shrubs, bushes and other obstructions on the property, with a contrasting color from the background. The location of numbers is subject to the approval of the Fire Chief. "FIRE HYDRANTS AND WATER SYSTEM. "Section l3.30l(c). "(c) All premises where a building or portion of a building is hereafter constructed, or a commercial or manufacturing use is established, shall be provided with a public fire hydrant system capable of supplying sufficient fire flow as determined by the Fire Chief. I "When any portion of the building protected is in excess of 150 feet from a water supply on a public street, there shall be provided, when required by the Chief, on-site fire hydrants and mains capable of supplying the required fire flow. "Water supply may consist of reservoirs, pressure tanks, elevator tanks, water mains, or other fixed system capable of supplying their required fire flow. In setting the requirements for fire flow, the Chief may be guided by the standard published by the Insurance Services Offices, 'Guide for Determination of Required Fire Flow'. -4- I I I Ordinance Number , . " " "All required fire hydrants shall be installed and operable prior to the initiation of construction of any permanent structure using combustible materials. "The Fire Chief shall specify the type, location and minimum discharge of all required fire hydrants. "To facilitate fire suppression operations, no building, or portion of building, shall be constructed more than two hundred (200) feet from an improved public street unless access through an area or private roadway is provided. Such area or roadway must be a minimum of fourteen (14) feet in width, surfaced to support fire apparatus, have a vertical clearance of not less than fourteen (14) feet, and terminate in a forty (40) foot cul-de-sac or hammer- head turning area. No building or portion thereof shall encroach more than two (2) feet upon this required access width clear to sky. All required access areas and/or roadways shall be maintained clear at all times. "AUTOMATIC FIRE EXTINGUISHING SYSTEMS. "Section 13.316. "Approved automatic fire extinguishing systems shall be installed and maintained in operable condition as specified in this section in the following locations: "(a) In (Group B, Division 2) B-2 occupancies used for retail sales, wholesale sales, factories and workshops using combustible goods, when the building is over 12,000 square feet in a single floor area or more than two stories in height. "(b) Throughout bowling alleys over 6,000 square feet in area. "(c) exceeding excess of Throughout all drinking or dining establishments 6,000 square feet or having an occupant load in 150. "(d) Throughout all A-I through A-4 occupancies having a stage or enclosed platform. "(e) Throughout all structures having A-I through A-4 occupancy with an occupant load of more than fifty (50) above the first story. "(f) Throughout all buildings or structures with a usable floor area that is fifty-five (55) feet above grade or containing four (4) or more stories. "(g) Throughout all R-I occupancies when the floor area above the second floor regardless of area separation walls, exceeds 5,000 square feet or when the total number of units in anyone structure exceeds fifty (50). "In all cases set forth above, the respective increases for area and height specified in Sections 506 and 507 of the Uniform Building Code shall be permitted. -5- Ordinance Number " "REQUIREMENTS FOR HOODS AND DUCTS. "Section 13.317. I "(a) All hoods and ducts, where required for cooking surfaces by the Uniform Mechanical Code, 1976 Edition, except in dwellings and apartments, or any commercial cooking equipment, shall be equipped with an approved automatic fire protection system. All associated cooking units served by a common hood or duct shall have automatic fire protection. All systems shall be installed and maintained in accordance with this code and in accordance with the specifications of the approving agency. "(b) Hoods, ducts and associated cooking equipment with grease filters shall be made to conform with the require- ments of this section. "(c) All equipment shall be installed and maintained as per N.F.P.A. Pamphlet #96. R(d) Hoods, ducts and associated cooking equipment in- stalled prior to the effective date of this article and section, shall be made to conform with the requirements of this section, within three (3) years of Fire Code adoption. RREQUIREMENTS FOR CERTAIN HIGH RISE BUILDINGS. "Section l3.318. I "The following requirements apply to buildings having floors used for human occupancy located 55 feet or more above or below the level of Fire Department vehicle access and shall be in addition to other, applicable requirements of the Code of the City of Seal Beach. "(a) Sprinkler System: Sprinkler protection con- forming to, and hydraulically designed, using the para- meter set forth in Uniform Building Code Standards Chapter 38 (to be based on Chapter 8 of N.F.P.A. 13-1972) and the following: "(I) Shut off valves and water flow devices shall be provided on each floor in addition to actuating local alarms on the floor upon which the water flow is detected. Such valves shall be super- vised by a continuously manned control station or by a central station. "(2) A sprinkler system shall be looped between stand pipe risers at the bottom, top and mid-height of all buildings with a maximum of twenty stories served by any loop. At each loop level there shall be check valves. I "(3) Piping may be copper or steel with no minimum size of pipe required. Solder connections may be used if not less than 95% tin and 5% antimony. -6- Ordinance Number 0(4) Pitching of lines is not required. "(5) A minimum of two fire pumps, independently driven, shall be provided and sized for the sprinkler demand, and for a minimum 500 gallons per minute Fire Department standpipe operation. I 0(6) An on-site supply of water equal to a twenty minute demand or 15,000 gallons on a combined sprinkler and standpipe, whichever is the smaller, shall be provided. This supply shall be available automati- cally, if the principal supply fails. "(7) Operation of the sprinkler system shall acti- vate the voice communications system. "(b) Fire Alarm: A manual alarm box shall be located adjacent to exits into stairway shafts and in every elevator lobby. The box shall be connected to the central control station and to the voice communications system as required by Sections (d) and (e). This system shall be designed in accordance with provisions of N.F.P.A. 71, 72-A, or 72-B). I O(c) Fire Detectors: An approved system which will provide for automatic detection of products of combustion other than heat shall be installed in every mechanical equipment room and in the return air portion of every air conditioning and mechanical ventilation system that serves floors other than the floor on which the equipment is located. Detectors set to operate within the limits of Uniform Building Code Standard Number 43-6 or for greater sensitivity shall be located at each opening into the vertical shaft. "(d) Voice Alarm System: Both the detection system and the fire alarm system shall activate a voice alarm system capable of being operated from the central control station on both a general and selective basis and dependent upon the compartmentation involved. The alarm shall be designed to be heard by all occupants within elevators. An approved elevator lobby detector shall be connected to the system. "(e) Voice Communication System: There shall be two separate approved continuously electrically supervised voice communication systems: one for Fire Department communication system and the other a public voice communi- cation (address) system between the central control station and the following areas. "(I) Elevators, elevator lobbies, corridors, and stairways. "(2) Every office area exceeding 1,000 square feet in area. I 0(3) When combined Each dwelling unit and hotel guest room. approved, the Fire Department system may be with the public voice communication system. -7- Ordinance Number I "(f) Central Control Station: A central control station for Fire Department operations shall be provided in a location approved by the Fire Department. It shall contain the voice communication systems panel; fire detection and alarm system panels; status indicators and controls for elevators; air handling systems; a public telephone; sprinkler valve; water flor detectors and standby power controls. n(g) Smoke Control: Natural or mechanical ventilation for the removal of the products of combustion shall be provided in every story and shall consist of one or more of the following: I "(1) Panels or windows in the exterior wall which can be oened from an approved location other than the fire floor. Such venting facilities shall be provided at the rate of at least 20 square feet per 50 lineal feet of exterior wall in every story, and distributed around the perimeter at not more than 50 foot intervals. Such panelS shall be clearly identified as required by the Fire Department. Tempered glass may be used in lieu of openable panels. "(2) When fire sprinklers are installed in compliance with Section (a), the mechanical air handling equipment may be designed to assist smoke removal. Under fire conditions, the return and exhaust air shall be moved directly to the outside without recirculation to other sections of the building. "(3) A shaft through which smoke and heat can be mechanically vented to the outdoors. The size of the shaft shall be uniform throughout and of such dimen- sions as to provide six (6) air changes per hour in the largest area served anywhere in the building. Openings into the shaft shall be protected with an automatic single piece shutter located as high in the room as possible and designed to vent the entire compartment. "(4) Any other design which will produce equiva- lent results. "(h) Elevators: At least one elevator in each bank available for Fire Department access to any floor shall be provided. The elevator shall open into a lobby, which may serve additional elevators, and shall be separated from the remainder of the building by 2-hour fire-resistive construction. The elevator may be within a smokeproof enclosure. I "(i) Standby Power and Light: A permanently installed standby power generation system conforming to Uniform Building Code Standard Number 18-1 (to be based on N.F.P.A. 70-1971) shall be provided. The system shall be equipped with suitable means for automatically starting the generator set upon failure of the normal electrical service and for -8- Ordinance Number automatic transfer and operation of all required electrical functions at full power within sixty seconds of such normal service failure. System supervision with manual start and transfer features shall be provided at the central control station. I "An on-premise fuel supply sufficient for not less than five hours full demand operation of the system shall be provided. All power, lighting, signal, and communication facilities provided under the requirements of this section shall be transferable to the standby power system. The power requirements shall be determined so as to provide service to, but not limited to, the following: "(I) Fire Alarm System. "(2) Exit and other emergency lighting. "(3) Fire protection equipment. "(4) Mechanical ventilation required by this section. "(5) Fire Department elevator. "(6) Voice communication system. "(j) Seismic Consideration: In seismic zone 3 the anchorage of the following mechanial and electrical equipment required by this section shall be designed in accordance with Chapter 23 of the Uniform Building Code. I "(I) Elevator drive and suspension systems. "(2) Standby power and lighting facilities. "(3) Fire pumps and other fire protection equip- ment. "(k) Exits: All stairway doors which are to be locked from the stairway side shall have electric strikes which can be automatically unlocked upon a signal from the central control station. Emergency telephone shall be provided at not less than every fifth floor in each required stairway with directional signs at each floor. "REQUIREMENTS FOR CERTAIN MULTIPLE RESIDENTIAL DWELLINGS, HOTELS, MOTELS, AND OTHER BUILDINGS. "Section 13.319. "(a) Every structure or portion thereof used for residential occupancy containing three or more dwelling units and two or more stories in height but having less than sixteen dwelling units, shall have installed therein an approved fire detection or products of combustion system, unless an automatic sprinkler system is installed. I "(b) Every structure or portion thereof used for hotel or motel occupancy containing less than twelve guest rooms and two or more stories in height, shall have -9- Ordinance Number '.' I installed therein, an approved fire detection or prOducts of combustion system, unless an automatic sprinkler system is installed. An approved fire detection or products of combustion system, has detectors sensitive to any of the products of combustion, except that detectors sensitive to heat only are not acceptable; has detectors that are inter-connected with a local alarm system that is clearly audible in all sleeping areas when all intervening doors are closed; has detectors installed in approved locations and in an approved manner. Applicable section of N.F.P.A. Number 74 will be used for approval of said systems. Equipment shall be approved by California State Marshal. "(c) Every structure or portion thereof used for residential occupancy containing sixteen or more dwelling units and two or more stories in height, shall have installed therein an approved supervised fire detection products of combustion system, unless an automatic sprinkler system is installed. "(d) Every structure or portion thereof used for hotel or motel occupancy containing twelve or more guest rooms, and two or more stories in height, shall have installed therein an approved supervised fire detection products of combustion system, unless an automatic sprinkler system is installed. I "(e) An approved supervised fire detection products of combustion system, has detectors sensitive to any of the products of combustion, except that detectors sensi- tive to heat only are not acceptable; has detectors interconnected with a local alarm system that is clearly audible in all areas of the structure when all intervening doors are closed and transmits a signal to the fire alarm headquarters of the Fire Department; has detectors in- stalled in approved locations and in an approved manner; and has a signal or intercommunicating system used for no other purpose than fire warning. "PERMIT REQUIRED. "Section 30.10l. nNo person shall erect or maintain any tent, tent house, air supported structure or similar structure intended for commercial purposes or as a place of public assemblage without first obtaining a permit to do so from the City Council. The City Council may grant a permit to erect such a tent or air supported structure and to maintain such tent or structure for a period not to exceed thirty (30) days. "STORAGE, SALE OF MERCHANDISE. I "Section 30.l2l. nNo goods, wares or merchandise shall be stored or held for sale in any tent or air supported structure except for the purpose of conducting and holding a circus, -10- Ordinance Number " carnival, wild west show, rodeo or other similar show or exhibition, or when the storage or sale of such goods, wares or merchandise is merely incidental to the purpose for which such tent or air supported structure is erected or used. I "WIRING. "Section 30.122. "All electric wiring shall be in compliance with the ordinances of the City of Seal Beach and must be approved by the Building Official. "LIGHTING. "Section 30.123. "No lighting shall be used other than incandescent lamps except with the approval of the Building Official. "APPLICATION TO ERECT. "Section 30.124. I "Every application for permission to erect a tent or air supported structure in the City of Seal Beach shall be in writing and in such form and contain such information as may be required by the City Council. Such application shall contain the approximate dimensions of the tent or structure, its proposed location, the distance from the nearest structure and the purpose for which it is to be used. Such application shall be signed by both the applicant and the owner of the property upon which such tent or structure is proposed to be erected, or the duly authorized representatives of said applicant and property owner. "FILING OF APPLICATION. REPORT FROM FIRE CHIEF. "Section 30.125. I liThe application shall be filed fourteen (14) days prior to the next scheduled City Council meeting with the City Clerk who shall forward copies of such application to the Fire Chief for investigation and a report determining whether the erection and maintenance of the tent or air supported structure proposed to be erected and maintained will create an unreasonable hazard to life or property, or adversely affect adjacent property or the residents of the neighborhood. -11- Ordinance ,N1,1mbl!!r, .' .1 nThe Fire Chief shall make a report recommending approval or disapproval of such application, together with his reason therefor and transmit said report to the City Council. The City Council may, in its discretion, grant permission for the erection of such tent or structure, and impose any condition necessary to safeguard the health, welfare, safety and morals of the residents of the City. I "REVOCATION OF PERMIT. "Section 30.l26. "The City Council may revoke any permit granted for the erection or maintenance of a tent or air supported structure prior to the expiration of the period for which the permit was issued when applicant fails to comply with any condition to the issuance of such permit, or when the health, welfare, safety or morals of the residents of the City, or any portion thereof, are adversely affected by the continued use or presence of such tent. Upon revoca- tion of any such permit, the person to whom the permit was issued shall, within the time specified by the City Council, remove such tent or structure. "PERMIT FEES. nSection 30.127. I liThe sum of $100 shall be paid to the City at the time the application for a permit under this Article is filed with the City Clerk. If said application is denied, the sum of $75 shall be refunded to the applicant, and the sum of $25 shall be retained by the City to reimburse said City the expense of investigating and processing such application. "BOND REQUIRED. nSection 30.128. "No tent or air supported structure permit shall be issued unless the applicant therefor first files with the City Clerk a cash bond of $100 to guarantee the removal of the tent or structure and all equipment, and to guarantee that the premises shall be cleaned within forty eight (48) hours after the expiration or revocation of the tent or structure permit, and a surety bond of $100,000 per person and $300,000 per accident, etc. unless deleted by City Council. Upon failure of aplicant to remove such tent or structure and equipment and to clean the premises, the cash bond, or any part thereof shall be used for such purpose. I "Upon certification of the Fire Chief that the tent or structure and all equipment have been removed and that the premises are clean, the cash bond, or any part thereof not usep to pay for the cost of such work, shall be returned to the applicant." -12- I I I Ordinance Number " Section 5. Sections 9-4 through 9-8.1 of Article II of Chapter 9 of the Code of the City of Seal Beach, California are hereby repealed. Section 6. Section 9-3.4 of Article I of Chapter 9 of the Code of the City of Seal Beach, California, is hereby amended by adding thereto a new Paragraph (c) to read: "(c) The Fire Marshal shall be in charge of the Bureau of Fire Prevention and shall be appointed by the Chief of the Fire Department of the City of Seal Beach." (1) The sales area and the area within a 50 foot radius thereof shall be cleared of all weeds, debris, and combustible or 'fire hazardous materials before sales commence and shal I be maintained in such con- dition so long as sales continue; the area shal I be graded or leveled to such a degree that no holes or hazards exist before sales commence and shal I be maintained in such condition throughout the sales period. (2) Sales and other operations shal I be prohibited between the hours of 10:00 p.m. and 8:00 a.m, (3) No person shall sleep or cook within the structure or in vehicles, or on the premises of the fireworks stand where fireworks are dispensed, stored or handled. (13) Fireworks sales structures shall not be constructed or placed on the approved ,sites before June 20th and shall be removed on or be- fore July 10th. (14) Each stand shal I be equipped with a sufficient number of trash con- tainers to adequately contain the trash generated from the opera- tion of the stand; al I contaIners must be of metal. (15) There sha II be at least one (1) exit for each three (3) peop Ie working in the stand. (16) There shall be a maximum of twelve (12) feet with no obstructions to an exit. (17) Each stand must be under twenty-four (24) hour survei fiance by an adult from 'w'lthin 100 feet of stand as long as fi reworks are stored in "the s"trucTure. (IB) No stand shall 'be permitted in a location which, in the opinion of the City Council, wo~ld cause or tend to cause vehicular traffic congestion. As a part of this requirement the City Council may de- termine that off-street parking is required for both attendants and customers of the stand.
