HomeMy WebLinkAboutCC Ord 1011 1977-05-23 ORDINANCE NO. /0/1 I AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, ArljENDE'lG V!\RIOllS SEcnOtls OF CHAPTER 28, zo:m:G, OF THE CODE OF THE CITY OF SEAL BEACH. THE CITY COUNCIL OF THE CITY OF SE.l\L BEACH DOES HEREBY ORDAI~~ AS FOLLOWS: Section 1. Section 28-274, Article 2, Definitions, of Chapter 2R, Zoning, of the Seal Beach City Code is amended to read as follows: Sec. 280274. Stor~ "Story" means that portion of a building included between thE! surface of any floor and the surface of the next floor above it. If there is no floor above it, then the space between such floor and the ceiling above it shall be considered a story. If the finished floor level directly above a basement or ce11ar~is more than six feet above grade, such basement or ce11a~ shall be considered a story. If the distance between the floor and next floor above, floor and ceiling or finished slab and ceiling is less than five feet in vertical height, it shall not be considered a story for purposes of this definition. Section 2. Section 28-400(9)(b)(A) and 28-401(2)(b) shall be amended to read as follows and Section 28-402(5) shall be added to Article 4, Low Density Residential Zone, of Chapter 28, Zoning, of the Seal Beach City Code. I Sec. 28-400(9)(b)(A) Permi~ted Uses. Setback one (1) foot from property line and ten (10) feet from neighboring residence. or eitht (3) feet from neighboring residence with sound attenuation approved by City Staff. Sec. 28-401(2)(b) General Provisions, etc. Rear Yard abutti~g street 10' 10' 10' Sec. 28-402(5) Required Parkinq, e~c. Church parkin~. One space for each five fixed seats or one space for eac,-75 square feet of floor area used for assembly purposes and containing no fixed seats. Dimensions - 9' x 20'. Section 3. Section 28-506(6)(b) of Article 5, Special Provisions, etc. shall be amended to read as follows: Sec. 28-506(6)(b) General Reouirements. Permission and/or lease from Southern Pacific for use of S-P property, in addition to compliance with Section 28-505(4)(a) and (b). Section 4. Section 28-701(1)(d) of Article 7, Medium Density Residential Zone, shall be amended to read as follows: (d) t1inimum floor area for dwelling unit 700 sq. ft. I Section 5. Subparagraph (c) of Paragraph (2) of Sec. 28-701, General Drovisions, shall be amended by the addition of an asterisk following the yard dimension requirements for side yard abutting street or alley in District I. The following statement shall be included at the end of the subparagraph: * Exception: On lots of less than 37~' in width, an encroachment into the exterior side yard for the length of the garage will be permitted provided that a setback of 3 ft. is maintained. The intent of this provision is to provide an interior garage dimension of 18 feet. . . 'J, I I I ordinance Numb~r Section 6. Paragraph (2) of Sec. 28-801, General Provisions, shall be amended by the addition of an asterisk following the yard dimension required for side yard abutting street or alley in District I. The following statement shall be included at the end of the Section. * Exception: On lots of less than 37~' in width, an encroachment into the exterior side yard for the length of the garage will be permitted provided that a setback of 3 ft. is maintained. The intent of this provision is to provide an interior garage dimension of 18 feet. Section 7. Sec. 28-801(4), Minimum floor area, of Article 8, is hereby amended to read 600 sq. ft. for all Districts as minimum floor area. Section 8. Sec. 28-802(1), Parking requirements, of Article 8, is hereby amended to read 9' x 20' for all Districts as minimum interior dimension per parking space. Section 9. Sec. 28-1200, Permitted uses, of Article 12, is hereby amended by the addition of Paragraph 6.1: (6.1) Day Nurseries; Section 10. Sec. 28-1202(2) General provisions, etc., of Article 12, is hereby amended by deleting the 18 ft. requirement for a yard abutting an alley in District II. Section 11. Sec. 28-1202(4), General Provisions, etc., of Article 12, is hereby amended by decreasing maximum height for main building in District I to 30 feet. Section 12. Sec. 28-1203, Parking size and requirements, of Article 12, is hereby amended by the changes in the number of parking spaces for the following uses. All other uses remain the same. Financial Institutions, Professional Offices 1/250 sq. ft. Medical Offices and Pharmacies 1/200 sq. ft. 1/5 fixed seats or 1/75 sq. ft. of gross floor area without fixed seats Churches 1/1000 sq. ft. or 1 /l~ beds (most restrictive applies) Section 13. Sec. 28-1302(4), of Article 13, is hereby amended by decreasing maximum height for main building in District I to 30 feet. Hospital s Section 14. Sec. 28-1402(2), of Article 14, is hereby amended by decreasing the minimum yard dimension abutting side alley and rear alley for District VI to 4 feet. Section 15. Sec. 28-1402(4), of Article 14, is hereby amended by decreasing maximum height for main building in District I to 30 feet. Section 16. Sec. 28-1403, of Article 14, is hereby amended by deleting subparagraph te) of Paragraph (4). Secti'on 17. Sec. 28-2002(2), Uses permitted, of Article 20, is amended by the insertion of "County" between city and state. Section 18. Sec. 28-2204, Temporary real estate office, is amended by the addition of the following sentence at the end of the paragraph: . .' . . ~ I I I Ordinance ~umb~r With the approval of the Planning Commission, a temporary real estate office may be approved for one additional year. Section 19. Sec. 28-2208, Parking requirements for uses not specified, of Article 22, is amended to read as follows: Where the parking requirements for a use are not specifically determined, the parking requirements for such use shall be determined by the Planning Commission. Such determination shall be based upon the requirements. for the most comparable use specified. The findings in such matters shall be set forth by resolution citing the considerations upon which the decision is based. Such determination shall not become effective until affirmed by the City Council. Section 20. Sec. 28-2209(1)(b), Form and Access - Exceptions, is revised to read as follows: Exceptions: On lots of more than fifty feet in width and containing more than four dwelling units, a curb opening may be approved by issuance of a Conditional Use Permit in the following cases; when it is determined to provide the most efficient parking arrangement on site: Section 21. Sec. 28-2405, Commission may determine conditions for abatement, is revised to read as follows: When any nonconforming condition exists in any zone, other than the nonconforming use of land where no structure is involved, the planning commission may, after a public hearing, fix a date upon which the nonconforming building was established and determine conditions and time limits for abatement. Section 22.
