HomeMy WebLinkAboutCC Ord 1022 1977-11-14 \ 1 1- I . ~ ". , . -0 ORDINANCE NO. ~~~~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH ADOPTING PLANNED UNIT DEVELOPMENT PUD-2-77 FOR DEVELOPMENT OF 5.1 ACRES FOR 80 TOWNHOUSES AND RECREATIONAL COMPLEX, TRACT NO. 9783. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. Planned Unit Development PUD-2-77 for development of 5.1 acres for 80 townhouses and recreational complex, Tract No. 9783, zoned R-3, High Density Residential, is hereby adopted with development criteria and conditions listed below. Section'2. The development criteria for Planned Unit Development PUD-2-77 are as follows: A. The development shall be in substantial compliance with the development conditionally approved by Planning Commission Resolution No. 1079. B. The tract map for PUD-2-77 shall be in substantial compliance with the tract map conditionally approved by Planning COlnmission Resolution No. 1080. C. Appro~al of PUD-2-77 shall be subject to approval of Tentative Tract Map and Final Tract Map No. 9783 referenced in Item B above. D. Minimum development criteria as follows: (1) Site size: 5.1 acres (2) Maximum number of units: 80 (3) Recreational complex containing: 15' x 36' swimming pool or a spa; 20' x 20' meeting room, rest rooms for men and women (4) Streets: Private streets (5) Building Height and Stories: Not to exceed 30 ft. or two stories (6) Parking: Two-car garage for each unit, 18 ft. wide x 20 ft. deep interior dimensions (7) Guest Parking: 1 space for each 7 units minimum (8) Private Patio: 1 for each unit. 15' x 21' minimum. (9) Unit Setbacks: (a) The setback adjacent to Unit No. 22 on Marina Drive to be reduced from 15 ft. to 10 ft. (b) The setback adjacent to Unit No. 1 be modified from zero to 3 ft. (c) The walkways between Units 4 and 5 and Units 13 and 14 be increased from 5 ft. to 6 ft. Cd) The setback adjacent to Unit No. 62 on Marina Drive be reduced from 15 ft. to 12 ft. ~., . 1 .1 I ordinance Number -, ", , " (e) The setback adjacent to Lot No. 82 be increased from 4 ft. to 7 ft. (f) The setback for units 62 through 82 on First Street be increased to an average of 18 ft. with a minimum of a 15 ft. setback; with a 3 ft. or greater reduction in the width of the central greenway (10) Unit Size: 1300 sq. ft. minimum (11) Fences: 6 ft. max. height separating patio areas from adjacent lot or common area 42" max. height adjacent. to the San Gabriel River property line (.12) Architectural Projections: 24" at front and/or rear of each unit. No projections into sideyard or passageways (13) Automatic Garage Door Openers: On all garages (14) Landscaping: All common areas not devoted to streets, alleys, walkways or the recreational complex. Section 3. Additional conditions for Planned Unit Development PUD-2-77 are as follows: 1. The vehicular turning radius provided to the garages should comply with the prescribed intent of the zoning ordinance and be to the satisfaction of the city staff, therefore the planters in the alleys should be eliminated or modified. 2. Guest parking spaces shall be striped and the remainder of the project's streets and alleys posted with "no parking" signs. 3. Lighting is to be provided on garages, in the greenway and walkways to satisfaction of the staff. 4. All existing large trees to be boxed, where possible, and replanted in the new development, to the satisfaction of the staff. 5. Landscaping plans shall be provided to the satisfaction of the staff. 6. Emergency vehicle access to be provided at each end of the central greenway to the satisfaction of the Fire Chief. 7. Installation of fire hydrants (City East Bay Ranger Series) at locations specified by the Fire Chief and to the satisfaction of the Fire Chief. 8. Installation of Class "C" roofs on all units or as specified by the Fire Chief. 9. Developer to attempt to obtain a license from the Flood Control District to provide a 6 ft. emergency access way along the property line adjacent to the San Gabriel River. 10. The Covenants, Conditions and Restrictions for the project shall be submitted to the staff and City Attorney for review and approval prior to recordation. . 1 I I Ordinance Number. " .' 11. Mail boxes shall be provided in compliance with U. S. Postal Service. 12. All wood siding above 15 feet in height to have one-hour fireproofing behind siding to the satisfaction of the Fire Chief. 13. Developer shall provide a siltation and erosion control program for the construction phase of the project. 14. All on-site and off-site water, sewer, storm drain, street, street lighting and utility improvements shall be constructed as required by the City Code and shall be to the satisfaction of the City Engineer, including but not limited to the following: a. Easements shall be provided for all on-site water facilities inclu~ing water meters. b. All condominium units and trailer spaces shall have individual water meters. c. All water facilities shall be deeded to the City. d. Sewer service shall be maintained to the existing development on the south side of Marina Drive. e. Ownership and main-enance of on-site sewers shall be the responsibility of the property owner. f. Provide a stub sewer connection to the right-of-way of Marina Drive with sufficient capacity to serve future development on the property bounded by the San Gabriel River, Marina Drive, First Street and the beach. Grant the rights to said capacity to the City of Seal Beach. g. No additional on-site drainage will be allowed to drain onto First Street or Marina Drive. h. Ownership anJ maintenance of on-site storm drains shall be the responsibility of the property owner. i. Provide underground street lights where not already provided. j. Provide sidewalks for all adjacent streets. k. All utilities shall be underground. 1. Property owner shall landscape and maintain those portions of the street parkway not used for sidewalk. Landscaping shall be to the satisfaction of the City Engineer. Section 4. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published as requi'red by law.
