CALIFORNIA, REGULATING NEWS RACKS AND
AMENDING THE CODE OF THE CITY OF SEAL
BEACH, CALIFORNIA TO ADD A NEW CHAPTER

THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. The Seal Beach Municipal Code is
hereby amended by adding thereto Chapter lIB, to read
as follows:
CHAPTER lIB
NEWS RACKS
Sec. lIB-I. Definitions.
(a) Newsrack. As used in this Chapter news-
rack shall mean any self-service or coin-operated box,
container, storage unit or other dispenser installed,
used, or maintained for the display or sale of any
written, photographic, or printed material, including,
but not limited to, newspapers or news periodicals.
(b) Street. As used in this Chapter street
shall mean all that area dedicated to public use for
public street purposes and shall include, but not be
limited to, roadways, parkways, and alleys.
(c) Roadway, As used in this Chapter roadway
shall mean that port1on of a street improved, designed,
or ordinarily used for vehicular travel.
(d) Parkway. As used in this Chapter parkway
shall mean that area between the sidewalks and the curb
of any street, and where there is no sidewalk that area
between the edge of the roadway and the property line
adjacent thereto. Parkway shall also include any area
within a roadway which is not open to vehicular travel.
(e)

mean any individual, partnership, firm, association, corpora-
tion or other legal entity.
Sidewalk. As used in this Chapter sidewalk
surface provided for the exclusive use of
(g) Custodian. As used in this Chapter custodian
shall mean any person or persons who have the responsibility
of placing, servicing or maintaining a coin vending newsrack
machine by depositing and/or removing material from said
machine and/or by collecting monies from said machines.

Sec. IlB-2. Installation, Use, Maintenance.
.
(a) No person shall install, use or maintain any
news rack or other structure which projects onto, into or over
any part of the roadway of any public street, or which rests,
wholly or in part, upon, along or over any portion of the
roadway of any public street.
(b) No person shall install, use or maintain any
news rack which in whole or in part rests upon, in or over
any public sidewalk or parkway when such installation, use
or maintenance endangers the safety of persons or property,
or when such site or location is used for public use, or
when such newsrack unreasonably interferes with or impedes
the flow of pedestrian or vehicular traffic, including any
legally parked or stopped vehicle, the ingress into or egress
from any residence or place of business, or the use of poles,
posts, traffic signs or signals, hydrants, mailboxes, or
other objects permitted at or near said location, or when
such news rack interferes with the cleaning of any sidewalks
by the use of mechanical sidewalk cleaning machinery. Not-
withstanding any other provision of this subsection, no
news rack shall be placed, installed, used or maintained:
(1) Within ten (10) feet of the point of inter-
section of the edge of a marked crosswalk and the curb-
line;
(2) On or within fifteen (15) feet of any
sidewalk return at any street corner;
(3) On those sidewalks that have been
designated as official bicycle routes;
(4) Within fifteen (15) feet of any fire
hydrant, fire call box,police call box or other
emergency facility;
(5) Within fifteen (15) feet of any drive-
w~;
(6) Within five (5) feet of any light standards,
trash receptacles, traffic signal control boxes, .mail
boxes, water meters and gas meters;

(7) Within six (6) feet of any bus bench;
(8) Within five (5) feet ahead and twenty five
(25) feet to the rear of any designated bus stop;
(9) Within five (5) feet of any curb which
has legally been painted yellow, white or green for
the purpose of regulating parking;
(10) In any location whereby the cross space
of the passageway of pedestrians on the sidewalk is
reduced to less than five (5) feet;

(11) Within three (3) feet of the imaginary
lines th~t could be formed by extending the width
of the entrance to a structure along lines perpen-
dicular to the edge of the curb or its vertical
extension;
(12) Within three (3) feet of any area improved
with lawn, flowers, shrubs or trees or within three
(3) feet of any display window of any building abutting
the sidewalk or parkway or in such manner as to impede
or interfere with the reasonable use of such window
for display purposes;
(13) In any manner so as to obstruct or impede
access to the sidewalk, or a person going to or from
an automobile.
Sec. 11B-3. Standards.
Any newsrack which in whole or in part rests upon,
in or over any public sidewalk or parkway, shall comply with
the following standards:
(a) Size. No newsrack shall exceed four (4) feet
in height, thirty (30) inches in width, or two (2) feet in
thickness,

(b) Location. Newsracks shall only be placed near
a curb or adjacent to the wall of a building. Newsracks placed near
the curb shall be placed no less than eighteen (18) inches nor more
than twenty-four (24) inches from the edge of the curb. Newsracks
placed adjacent to the wall of a building shall be placed parallel
to such wall and not more than six (6) inches from such wall. No.
newsrack shall be placed or maintained on the sidewalk or parkway
opposite a news stand or another newsrack unless it is more than
one hundred (100) feet from the nearest opposite news stand or
newsrack.

(c) Attachments. No newsrack shall be chained,
bolted or otherwise attached to any property not owned by
the owner of the newsrack, or to any permanently fixed object,
without submitting written permission from the owner of the
property or object to the City of Seal Beach. Newsracks may be
chained or otherwise attached to one another; however, no such
group of news racks which extends more than nine (9) feet may
be joined together in this manner, and a space of no less than
three (3) feet shall separate each group of newsracks so attached.
No newsrack or group of attached newsracks allowed under this
subsection shall weigh, in the aggregate, in excess of one hundred
twenty-five (125) pounds when empty.
(d) Frames. All newsracks shall be situated on a
frame and casing that meets the standards on file with the
City of Seal Beach, and which are open to public inspection. The
frames and casings shall be placed in accordance with all
provisions and standards adopted by the City of Seal Beach.
Sec. 11B-4. Advertising.
No newsrack shall be used for advertising signs or
publicity purposes other than that dealing with the display,
sale or purchase of the written, photographic, or printed

material, including, but not limited to, newspapers or news
periodicals, sold therein.
Sec. llB-5. Harmful Matter or Offensive Material.
(a) No person shall sell offer for sale, or keep
or maintain for sale any Harmful Matter, as such term ~s
defined in Section 313, Chapter 7.6, Title 9, Part 1 of the
Penal Code of California, in any news rack on any public
sidewalk unless such sale or offer of sale is made or such
matter is kept or maintained in the presence and under the
supervision of an adult person authorized to prevent the
purchase of such matter by a minor.
(b) No person shall sell, offer for sale, or
keep or maintain any written, photographic or printed
material including, but not limited to, newspapers or
news periodicals in any newsrack or on any sidewalk in such
manner as to expose to the public view any photograph,
cartoon or drawing, contained within such publication,
displaying any of the following:
(1) The genitals, pubic hair, buttocks,
natal cleft, perineum, anal region or pubic
hair region of any person other than a child
under the age of puberty;
(2) Any portion of the breast, at or below
the top of the areola thereof, of any female
person other than a child under the age of puberty.
Section llB-6. Maintenance.
(a) Each news rack shall be maintained in a
clean, neat and attractive condition so as not to becQme
mechanically inoperable or have cracked or broken coverings
or casings. The news rack shall be painted or covered with
a protective coating so as to keep it from rust.
(b) No issue or edition o~ any publication shall
be allowed to remain in any news rack for a period in excess
of four (4) days past the date the next issue is published
or disseminated, whichever is sooner.
(c) No news rack shall remain in a condition
wherein it does not contain the publication which it is
designed to disseminate for a period of five (5) days or
longer.
Sec. llB-7. Identification.
(a) Within thirty (30) days after this Ordinance
becomes effective, every person or custodian who places
or maintains a news rack in the City of Seal Beach shall
have his or its name, address and telephone number affixed
thereto in a place where it may be easily seen. If the
person or custodian is a corporation, then the name, address
and telephone number of the distributor must be affixed in
a place where it can be easily seen.

(b) .Within thirty (30) days after this Ordinance
becomes effective, if any coin vending newsrack machine is
not properly identified as to the owner or custodian thereof,
a copy of Sec. llB-7 of the Seal Beach Municipal Code shall
be sent by certified mail, return receipt requested, to the
publisher of the publication sold in the machine, and a copy
of said section will be posted on said machine,
Sec. llB-8. Indemnification.
Every person or custodian who places a news rack
on public property in the City of Seal Beach shall file a
written statement with the City Clerk satisfactory to the
City Attorney, whereby he agrees to indemnify and hold
harmless the City, its Officers, Directors or Employees
from all loss, liability or damages, including expenses and
costs, for bodily or personal injury and for prope~ty damage
sustained by any person as a result of the location, install-
ation, use, maintenance, removal or storage of such newsrack
within the City.

Sec. llB-9. Business License Required.
It shall be unlawful for any person or.custodian,
whether as a principal or agent, clerk or employee, either
for himself or for any other person or body corporate or as
an officer of any corporation or otherwise, to place or
permit the placement of any publication in a newsrack
within the City of Seal Beach unless either the said person
or custodian or the publisher of any written, photographic
or printed material stored or dispensed in a news rack has
a valid business license with the City.
Sec. llB-10. Notice, Removal, Storage.
(a) Notice. If any public officer designated by
the City Manager determines that a newsrack is installed,
used or maintained in violation of the provisions of this
Chapter or that a newsrack displays offensive matter in
violation of the provisions of this Chapter, he shall take
reasonable steps to notify the owner or custodian thereof
as follows:
(1) The newsrack is in violation of the
provisions of this Chapter for reasons set forth
in said notice, and

(2) The owner or custodian must within one
day of receipt of notice remove the news rack or
the offensive matter, or
(3) The owner or custodian must within one
day of receipt of notice request the City Manager
to set a public hearing within five (5) days to
determine upon sworn testimony whether the news-
rack, or the offensive matter displayed within it,
violates the provisions of this Chapter, and

(4) The public officer shall remove the news-
rack or the offensive matter and store it as provided
in subsections (b) and (c) unless the owner or custodian
removes the newsrack or the offensive matter pursuant
to part (2) of this subsection or requests the public
hearing pursuant to part (3) of this subsection. .
(b) Removal, After complying with the notice
requirements prov~ded for in sLhsection (a), the public
officer shall remove the newsrack or the offensive matter
displayed within it unless the owner or custodian removes
the newsrack or ~~e offensive matter displayed within it or
requests the public hearing as provided in subsection (a),
If the City Manager determines at said public hearing that
the newsrack or the offensive matter displayed within it vio-
lates the provisions of this Chapter, the owner or custodian
of the newsrack or the public officer shall immediately remove
the newsrack or the offensive matter displayed within it.

(c) Storage, If the public officer removes the
newsrack or the offensive matter displayed wiL~in it, he
shall store the newsrack or such matter in any convenient
place designated by the City Manager. The owner or custodian
of the newsrack may reclaim the newsrack or such matter from
the officer within thirty (30) days of its removal by him.
Upon failure of the owner or custodian, following notice,
to claim such newsrack or the matter ,displayed within it and
pay the expenses of storage within thirty (30) days after
such removal, .such newsrack or matter shall be deemed to
be unclaimed property in possession of the City and may be
disposed of pursuant to law. The fee for such removal and
storage shall be fixed by the City Council by resolution.
(d) Special Procedure. In the case of violations
of this Chapter relat~ve to (1) restrictions upon attachments
of newsracks to property other than that owned by the owner
of the newsrack, or to fixed objects or to each other; or
(2) location of newsracks, any public. officer designated
by the City Manager may as an alternate to the procedure
specified in subsections (a), (b) and (c), remove such
attachment and/or move such rack or racks in order to re-
store them to a legal condition, after taking reasonable
steps to notify the own~r.

~~lB-ll, Penalty,
Any person, firm or corporation violating any of the
provisi.ons of this Chapter shall be deemed guilty of a misdemeanor,
and each such person, firm or corporation, shall be.deemed
guilty of a separate offense for each and every day or portion
thereof during which any violation of any of the provisions of
this Chapter is committed, continued, or permitted, and upon
conviction of any such violation such person shall be punishable
by a fine of not more than $500, or by imprisonment in the City
or County jail for not more than six moritlls, or by both such
fine and imprisonment,
