A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH CONDITIONALLY APPROVING
TENTATIVE TRACT MAP 9458.
WHEREAS, an application was duly filed by State-Wide Developers, 9461
Grindlay Street, Cypress, for Tentative Tract Map 9458; and
WHEREAS, the proposal is to subdivide 1.88 acres of land zoned R-3,
High Density Residential, into 8 lots, each containing one
nine-unit building with a total of 72 units in the project,
in the Rossmoor Center; and
WHEREAS, after the preparation of an initial study the city staff
determined that a Negative Declaration would fulfill the
requirements of the California Environmental Quality Act,
because the project site is located in a parking lot, in
a developed area, with adequate street carrying capacity,
and readily available utilities, and will not have a substantial
negative effect upon the environment; and
WHEREAS, on September 1, 1976, the Planning Commission has conditionally
approved the tract map and recommended that the City Council
conditionally approved the Tentative Tract Map; and
WHEREAS, on September 1, 1976, the Planning Commission considered the
question of park land dedication or in lieu fee payment and,
based upon the small size of the subdivision, in a commercial
shopping center, determined that the recreation fees should
be paid in lieu of dedication of park lands; and
WHEREAS, on September 13, 1976, the City Council discussed items
related to Tentative Tract Map 9458 and referred certain
matters to the Planning Commission and Environmental Quality
Control Board requesting additional information; and
WHEREAS, on September 23, 1976, the Environmental Quality Control Board
met and determined that the initial study and Negative
Declaration for the project were sufficient and recommended
to the City Council that in lieu fees be required rather than
the dedication of land for park and recreational purposes;
and
WHEREAS, on October 6, 1976, the Planning Commission met and reviewed
the items referred to it by the City Council and made certain
recOl1lllendations to the City Council (see Exhibit "A"); and
WHEREAS, the proposed project is consistent with the General Plan and
complies with the type of use and density prescribed for this
site, and will provide for variation in life style for residents
within the area; and
WHEREAS, the site is physically suitable for development; the land is
flat and it is located in a developed area with existing streets,
utilities, residences, and commercial activities located adjacent
to the project site; and
WHEREAS, the site is suitable for the proposed density of development;
other projects of similar density have been constructed and
are compatible with the area; and

WHEREAS, the design of the subdivision will not cause substantial
environmental damage because the project site is presently a
paved parking lot in a developed area; and
WHEREAS, the design of the subdivision is not likely to cause serious
public health problems because all the necessary utilities
and services are available for the project; and
WHEREAS, the design of the subdivision will not conflict with easements,
acquired by the public at large for access through, or use of,
property within the proposed subdivision because no easements
acquired by the public at large are located on the project
site; and
WHEREAS, the discharge of waste from the proposed subdivision into the
existing community sewer system will not violate existing
requirements prescribed by the local regional water quality
control board pursuant to Division 7 of the Water Code;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal
Beach does hereby condi'tionally approve Tentative Tract Map No. 9458
subject to the following conditions:
1. Driveway easements to be recorded; shown on the final tract
map and be submitted to the City Attorney for approval.
2. Payment of in lieu subdivision fees be paid to the City for
recreational purposes. Said fee to be paid prior to City's
issuance of building permits for construction of the project.
3. Installation of three new fire hydrants and upgrading of two
existing fire hydrants to City ,standards to the satisfaction
of the Fire Chief.
4. Installation of emergency access pass through gates in locations
specified by the Fire Chief in the rear wall.
5. Installation of automatic garage door openers on all garages.
6. Landscaping plans to be submitted to the satisfaction of the
staff.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Seal Beach hereby directs the City Clerk to file a Notice of Determination
for this project with the County Clerk containing the following determinations:
1. The project has been approved by the lead agency,
2. The project will not have a significant effect on the
environment, and
3. A Negative Declaration was prepared for this project pursuant
to the provisions of the:.California Environmental Quality Act.
