ORDINANCE NO. 9'1- AN ORDINANCE OF THE CITY OF SEAL BEACH, AMENDING AND REPEALING CERTAIN SECTIONS OF CHAPTER 13 PERTAINING TO MOTOR VEHICLES AND TRAFFIC AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY ORDAINS AS FOLLOWS: Section l. Code of the City 'as follows: Section 13-3 of Article 1 of Chapter 13 of the of Seal Beach, California is hereby amended to read "Section 13-3. Same--Bicycle. The word, BICYCLE, for the purpose of this Chapter, shall mean and include any device upon which a person may ride, which is propelled by human power through a system of belts, chains, or gears and which has wheels at least twenty (20") inches in diameter and a frame size of at least fourteen (14") inches." Section 2. Section 13-14 of Article 1 of Chapter 13 Code of the City of Seal Beach, California is hereby amended as follows: of the to read "Section 13-14. Same--pedestrian. A PEDESTRIAN is any person who is afoot or who is using a means of conveyance propelled by human power other than a bicycle." Section 3. Section 13-17 of Article 1 of Chapter 13 of the Code of the City of Seal Beach, California is hereby amended to read as follows: "Section 13-17. Same--Stop or Stand. STOP or STAND when prohibited shall mean any cessa- tion of movement of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in com- pliance with the direction of a pOlice officer or official traffic control device or signal." Section 4. Article 1 of Chapter 13 of the Code of the City of Seal Beach, California is hereby amended by adding Section 13-19.1 thereto, which shall read as follows: "Section 13-19.1. Bicycle Riding on Sidewalks. The City Engineer may post signs permitting bicycle riding on sidewalks and locations where riding on the street would be extremely hazardous. Any person may ride or operate a bicycle on sidewalks where signs have been posted by the City Engineer pursuant to this Section." I (' I I 1 .-, '. -' Ordinance No. 9t:o.3 Page Two Secti@n 5. Riding or Driving Vehicles on Sidewalk. '~o person shall operate or move a motor vehicle upon a sidewalk excepting over permanently constructed driveways and except as may be necessary to enter or leave adjacent property and excepting when it ia necessary for any temporary purpose to drive a loaded vehicle across a sidewalk; provided further, that said sidewalk area be substantially protected by wooden planks two inches thick, and written permission be previously obtained from the City Traffic Engineer. Such wooden planks shall not be permitted to remain upon such sidewalk area dur- ing the hours from 6:00 P.M. to 6:00 A.M." "Section 6. Section 13-30 of Article I of Chapter 13 of the Code of the City of Seal Beach, California is hereby repealed. Section 7. Section 13-34 of Article I of Chapter 13 of the Code of the City of Seal Beach, California is hereby amended to read as follows: "Section 13-34. Report of Damage to Certain Property. (a) The driver of any vehicle or the person in charge of any animal involved in an accident resulting in damage to any property including vehicles, shall immediately stop at the scene of the accident and shall then and there either: 1. Locate and notify the owner or person in charge of such property of the name and address of the driver and owner of the vehicle involved, or; 2. Leave in a conspicuous place on the vehicle or other property damaged a written notice giving the name and address of the driver and of the owner of the vehicle involved and a statement of the circumstances thereof; and shalt', without unnecessary delay, notify the police department of the city wherein the collision occurred. (b) Any person who parks a vehicle which, prior to the vehicle again being driven, becomes a runaway vehicle and is involved in an accident resulting in damage to any property, attended or unattended, shall comply with the requirements of this Section, relating to notification and . reporting." Secton 13-86 of Article VIII of Chapter 13 of the Code of the City of Seal Beach, California is repealed. Curb Markings to Indicate No Stopping and Parking Regulations. (a) The City Traffic Engineer is hereby authorized, subject to the provisions and limitations of this Chapter, to plac~, and when required herein shall place, the follow- ing curb markings to indicate parking or standing regula- tions, and said curb markings shall have the meanings herein set forth. 1. Red shall mean no stopping, standing or park- ing at any time, except as permitted by the Vehicle Code, and except that a bus may stop in a red zone marked or signed as a bus zone. 2. Yellow shall mean no stopping, standing or parking at any time between 7:00 A.M. and 6:00 P.M. of any day except Sunday for any purpose other than the loading or unloading of passengers or materials, pro- vided that the loading or unloading of passengers shall not consume more than three minutes, nor the loading or unloading of materials more than twenty minutes. 3. White shall mean no stopping, standing or parking for any purpose other than the loading or unloading of passengers, or for the purpose of depositing mail in an adjacent mailbox, which shall not exceed three minutes. Such restrictions shall apply between 7:00 A.M. and 6:00 P.M. of any day except as follows: A. When such zone is in front of a hotel or mailbox, the restrictions shall apply at all times. B. When such zone is in front of a theater, the restrictions shall apply at all times, except when such theater is closed. C. When such zone is established as a taxi- cab stand, pursuant to Section 13-103 of this Code, the three minute restriction for taxicabs and automobiles for hire will be increased to forty minutes. 4. Green curb markings with time limits stenciled thereon shall mean no standing or parking for a period of time longer than indicated, and in no case longer than twenty-four minutes, between 9:00 A.M. and 6:00 P.M. on any day, unless otherwise indicated by signs. (b) When the City Traffic Engineer, as authorized under this Section, has caused curb markings to be placed, no person shall stop, stand or park a vehicle adjacent to any such legible curb marking in violation of any of the provisions of this Section. It is hereby determined upon the basis of an engineering and traffic survey, that the speed permitted by State law upon the fOllowing streets is less than is necessary for safe opera- tion of vehicles thereon by reason of the designation and sign- posting of suqh streets as through highways and by reason of widely spaced intersections, and it is hereby declared that the prima facie speed sHall be as hereinafter set forth on those streets or parts of streets herein designated, when signs are erected giving notice thereof: Name of Street or Portion Affected Declared Prima Facie Speed Limit Section 13. Section 13-123 of Article XI of Chapter 13 of the Code of the City of Seal Beach is hereby amended to read as follows: "Section 13-123. Decrease of State Law Maximum Speed. It is hereby determined upon the basis of an engineering and traffic survey that the speed permitted by State law out- side of business and residence districts as applicable upon the following streets, is greater than is reasonable,or safe under the conditions found to e~ist upon such stree~s; and it is hereby declared that the prima facie speed limit shall be as herein set forth on those streets or parts of streets herein designated, when signs are erected giving notice thereof. All streets and portions of streets within the incorporated limits of the City are declared to have a prima facie speed limit of twenty-five miles per hour except: ' (a) Any State or federal highway posted with a speed limit by authority of that jurisdiction. (b) Any street or portion of street, when signs are erected designating a greater speed, under authority of Council resolution or ordinance; in which case, the post~d speed will be considered prima facie. (Ord. No. 575.) , Section 14. Section 13-124 of Article XI of Chapter 13 of the Code of the City of Seal Beach is hereby amended to read as follows: "Section 13-124. Decrease of State Law Speed Between Districts. Reference is hereby made to the following portions of streets where the State speed iaw of fifty-five miles per hour' is applicable for a d-istance of not exceeding two thousand feet in length between districts, either business or residence, and it IS hereby determined upon the basis of, an engineering and'traffic investigation that the speed permitted by State law upon the fotlowing described portions of such street~ which are not State highways is greater than is reasonable or safe under the conditions found to exist upon the described portions of such streets, and it is hereby declared that the prima facie speed limit shall be as herein set forth on these portions of streets herein designated when signs are erected giving notice thereof: Portion of Street Affected Not Exceeding 2,000 Feet Between Districts Declared Prima Facie Speed Limit (j t/ PASSED, APPROVED AND ADOPTED THIS , 1975.
