HomeMy WebLinkAboutCC Ord 949 1975-01-13 ~ .' . . -- -. -' I ORDINANCE NUMBER. qL.jCj AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING SECTION 7-38, SUBSECTIONS (a) AND (b), RELATING TO "HOLIDAYS AND DAYS OFF" AND SECTION 7-40 RELATING TO "SICK LEAVE" OF CHAPTER SEVEN OF THE SEAL BEACH CITY CODE. THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES ORDAIN AS FOLLOWS: I Section 1. Section 7-38, Subsection (a), Chapter Seven, of the Seal Beach City Code shall be amended to read as follows: Sec. 7-38. Holidays and Days Off. (a) Police Department. Every full time employee of the Police Department who is classified as a safety member of the Public Employees Retirement System (PERS) shall be granted fifty-six (56) hours off each calendar year in lieu of holidays with the exception of those safety members working a five day/forty hour work week. The Chief of Police, in conformance with this section and any supplementary regulations of the personnel offir.er, shall schedule such time off in lieu of holidays consistent with department work load and the best personnel practices and scheduling practices. Such time off with pay in lieu of holidays shall be in addition to vacation with pay as specified in this section. Those employees of the Police Department classified as safety members under the Public Employees Retirement System (PERS) working a five day/forty hour work week shall be granted the following holidays with pay: New Year's Day (January 1) Washington's Birthday (Third Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4) Labor Day (First Monday in September) Veterans Day (Fourth Monday in October) Thanksgiving Day (Fourth Thursday in November) Christmas Day (December 25) A total of eight (8) holidays annually. I (b) Other employees. Every full time employee of the city, except employees of the Police Department and the Fire Department who are classified as safety members of the Public Employees Retirement System, shall be granted the following hOlidays with pay: New Year's Day (January 1) Washing~on's Birthday (Third Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4) Labor Day (First Monday in September) Veterans Day (Fourth Monday in October) Thanksgiving Day (Fourth Thursday in November) Christmas Day (December 25) Optional Holiday (To be determined annually) A total of nine (9) holidays annually. , Ordinance Nufnber . . . ',,- I In the event one of the aforementioned holidays falls on a Saturday, the preceding Friday shall be observed as a holiday. In the event one of the aforementioned holidays falls on a Sunday, the fOllowing Monday shall be observed as a holiday. Notwithstanding the provisions of this subsection, an employee of the city who generally is assigned to an eight hour day on a five day week basis or other similar schedule of work and when it is necessary for such employee to be scheduled for work on holidays, such employee shall be granted eight days off with pay each calendar year in lieu of the above-designated holidays. An employee of the city who generally is assigned to a ten hour day on a four day week basis or other similar schedule of work and when it is necessary for such employee to be scheduled for work on holidays, such employee shall be granted eight days off with pay each calendar year in lieu of the above-designated holidays. Such holidays off with pay as designated herein shall be in addition to Saturdays and Sundays or one hundred four days in lieu thereof and shall be in addition to vacation with pay as specified in this section. I Section 2. Section 7-40, Chapter Seven, of the Seal Beach City Code shall be amended to read as follows: Sec. 7-40. Sick Leave - Definitions. Sick leave is hereby defined to mean the absence from duty of an employee because of illness, or exposure to a contagious disease or death in the inunediate family, "lnunediate family" shall mean the spouse, the father, mother, son, daughter, brother, sister, grandparents, or dependent relatives of the employee. Provided, however, that employees of the Police Department classified as safety members of the Public Employees Retirement System (PERS) and full time employees classified as miscellaneous members of the Public Employees Retirement System (PERS) shall be granted three days "bereavement leave" with pay in the event of death in the inunediate family as defined above. The bereavement leave is not chargeable to or accumulated as sick time. Section 3. Effective date. This ordinance shall become effective thirty (30) days after its adoption by the City Council. I Section 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person, firm, corporation or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. ..~J I~\Wr I I I " ..e,.:~ .
