I I I . .. . ~ ORDINANCE NUMBER 9~3 AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING SECTION 7-38, CHAPTER SEVEN, SEAL BEACH CITY CODE, RELATING TO HOLIDAYS AND DAYS OFF. THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Section 7~38, Chapter 7, Seal Beach City Code, shall be amended to read as follows: (a) Police Delartment. Every full time employee of the police department who 15 c assified as a safety,member of the Public Employees Retirement System shall be granted fifty~six (56) hours off each calendar year in lieu of holidays. The Chief of Police, in conformance with this section and any supplementary regulations of the personnel officer, shall schedule such time off in lieu of holidays consistent with department work load and the best personnel practices and scheduling practices. Such time off with pay in lieu of holidays shall be in addition to regularly scheduled days off each year and in addition to vacation with pay as specified in this section. (b) Other employees. Every full time employee of the City, except employees of the police department and the fire department who are classified as safety members of the Public Employees Retirement System, shall be granted the following holidays with pay: New Year's Day (January 1) Washington's Birthday (Third Monday in February) Memorial Day (Last Mondar in May) Independence Day (July 4) Labor Day (First Monday in September) Veterans Day (Fourth Monday in October) Thanksgiving Day (Fourth Thursday in November) Christmas Day (December 25) A total of eight (8) holidays annually. In the event one of the aforementioned holidays falls on a Saturday, the preceding Friday shall be observed as a holiday. In the event one of the aforementioned holidays falls on a Sunday, the following Monday shall be observed as a holiday. Notwithstanding the provisions of this subsection, an employee of the City who generally is assigned to an eight (8) hour day on a five (5) day week basis or other similar schedule of work and when it is necessary for such employee to be scheduled for work on holidays, such employee shall be granted eight (8) days off with pay each calendar year in lieu of the above-designated holidays. An employee of the City who generally is assigned to a ten (10) hour day on a four (4) day week basis or other similar schedule of work and when it is necessary for such employee to be scheduled for work on holidays, such employee shall be granted eight (8) days off with pay each calendar year in lieu of the above-designated holidays. Such holidays off with pay as designated herein shall be in addition to Saturdays and Sundays or one hundred four (104) days in lieu thereof and shall be in addition to vacation with pay as specified in this section. ... Every employee of the Fire Department, who is classified-as-a safety member of the Public Employees Retirement System and who is assigned to fire suppression, fire fighting, dispatching or similar duties, who is on duty fifty-six (56) hours per week, shall be granted four (4) shifts of twenty-four (24) hours each off with pay in lieu of holidays. The Fire Chief, in conformance with this section and any sup- plementary regulation of the personnel officer, shall schedule such days off in lieu of holidays consistent with departmental work load and the best personnel and SCheduling practices. Such days off with pay in lieu of holidays shall be in addition to regularly scheduled days off (in lieu of Saturdays and Sundays) and vacation with pay as specified in this section. (d) E~lOyees not'eligible. An employee of the City classified as a provisiona employ~ hourly employee, part time employee or seasonal employee shall not be eligible for holidays or days off in lieu of holidays with pay. (e) Effective date. For the purpose of computing and granting holidays with pay, this section shall become effective January 1, 1974. Section 2. Severability. If any section, subsection, sentence, clause, phrase, or por.tion of this ordinance, or the application thereof to any person, firm, corporation or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this ordinance and each section, sub- section, sentence, clause, phrase or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. Section 3. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be posted as required by law.
