ORDINANCE NUMBER t?~r AN ORDINANCE OF TIlE CITY OF SEAL BEACH, CALIFORNIA, M1ENDING SECTIOHS 10-1.1 AND 10.2 OF ARTICLE I; DELETING SECTIONS 10-9, 10-10, 10-12, 10-13, 10-14, 10-15, 10-16, 10-17 AND 10-18 OF ARTICLE II; AMENDING SECTIONS 10-20, 10-21 OF ARTICLE III; AND ADDING SECTION 10-24.1 TO ARTICLE III, CHAPTER 10 OF THE SEAL BEACH CITY CODE RELATING TO GARBAGE AND RUBBISH, COLLECTION CHARGES THEREFOR AND CLEANING, MAINTENANCE AND UNSANITARY CONDITIONS IN CONNECTION THEREWITH. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 10-1.1 and Section 10-2 of Article I, Chapter 10 of the Seal Beach City Code are hereby amended to read as follows: Sec. 10-1.1 Service Provided by City. The city shall provide for the collection and removal from all property in the city of trash at regular intervals to be prescribed by the director of public works; however, any occupancy whi ch generates and produces in excess of .' one hundre_d (100): cubi,c yards of trash or the equivalent thereof per week, may request city permission to utilize a private collection service. Upon approval by the city and the obtaining of a city license, the private collector may service said occupant or owner of said property. Sec. 10-2. Containers--Required; specifications. All trash shall be placed for collection in metal or plastic containers or in containers of such other material as may be specified by the director of public works, each of which, together with the contents thereof, shall not exceed sixty-five (65) pounds in weight and in no event shall any such empty container weigh more than twenty (20) pounds, nor exceed thirty-five (35) gallons of capacity, provided, however, that a larger container may be used when approved by the director of public works. All trash containers shall be covered. The occupant of each residential or commercial occupancy shall be responsible for placing trash in accordance with this section, provided, however, that for multi- residential units, it shall be the responsibility of the property owner to provide an adequate number of trash containers for the use of tenants as determined by the director of public works. In the multi-residential zone, all trash containers shall bear the street address of the property served. Section 2. Article II, Sections 10-9 through 10-18 inclusive, Chapter 10 of the Seal Beach City Code shall be deleted. S~ction 3. Section 10-20, Article III, Chapter 10 of the Seal Beach City Code is hereby amended to read as follows: Sec. 1O~20. ,Fees--Residential. The monthly charge for the collection of trash from a single family dwelling shall be one dollar:a~d sixty cents ($1.60) per month. The monthly charge for the collection of trash fro~ multiple residential dwellings shall be one dollar and thi~ty cents ($1.39) for - each dwelling unit per month. The monthly charge for the collection of trash from a multiple family dwelling requesting the use of a three (3) cubic yard trash bin shall be twenty five dollars ($25.00) per month per bin. Section 4. Section 10-21, Article III, Chapter 10 of the Seal Beach City Code is hereby amended to read as follows: Sec. 10-21. Same--Commercial. (a) Trash Containers. A commercial estab1ishment shall be limited to no more than six (6) trash containers and the maximum capacity of each container shall not exceed thirty-five (35) gallons. Utilizing thirty-five (35) gallon trash containers, .' ... I I 1 Ordinarrce Number commercial establishments will be permitted no more than six (6) pickups per week. A commercial establishment which requires trash and garbage collection in excess of six (6) pickups per week for a maximum of six (6) thirty-five (35) gallon containers, must convert to a three (3) cubic yard trash bin for its trash and garbage collection. A minimum charge of six dollars ($6.00) per commercial establishment per month will be charged. For each thirty-five (35) gallon container used in excess of three (3), a charge of two dollars ($2.00) per month will be made in addition to the minimum charge of six dollars ($6.00) per month. The maximum charge for the use of six (6) thirty-five (35) gallon containers shall be twelve dollars ($12.00) per month. (b) Three Cubic Yard Bins. Monthly charges for a commercial establish- ment using three (3) cubic yard trash bins shall be based on the following rate schedule: Number of pickups (per week) '1 2 3 4 5 6 $20.00 x Number of Bins = Monthly Charge $25.00 x II II II = II U $30.00 x II II II = II II $35.00 x " " " = " " $40.00 x " " " = " " $45.00 x " " " = " " Each additional three (3) cubic yard bin, depending on the desired number of pickups, will be charged at the above rate. No prorating of charges for additional trash bins will be allowed. Commercial occupancies who share usage of trash containers or bins are responsible among themselves for the payment and reimbursement of all charges. Shared billing shall not be permitted. Section 5. The following section is hereby added to Article III, Chapter 10 of the Seal Beach City Code to read as follows: Sec. 10-24.1. Unsanitary conditions; duty to remove and abate unsanitary, unhealthful substances. It is the responsibility of each occupant and owner to maintain covers on all trash containers or bins, to keep same in a sanitary, healthful condition and to keep the area directly around the containers or bins in a clean, proper and sanitary manner. In the event the trash containers or bins or collection area are determined to be in an unhealthful, unsanitary condition by the director of public works, a "Notice to Clean" in accordance with Division 2, Sections 10-29 through 10-39 inclusive of this Chapter, shall be issued to the occupant or owner of the premises. Section 6. Effective date. This ordinance shall become effective thirty days after its adoption by the City Council. Section 7. Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person, firm, corporation or circumstance is for any reason held to be invalid or unconsti- tutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 8.
