IMPLEMENTING THE ENVIRONMENTAL QUALITY
ACT OF 1970 AND AMENDING THE CODE OF THE
CITY OF SEAL BEACH
THE CITY COtm::IL OF THE CITY OF SEAL BEACH DOES ORDAIN AS
FOLLOWS:
Section 1. The Code of the City of Seal Beach
is hereby amended by adding a Chapter 7c to read as follows:
CHAPTER 7c: ENVIRONMENTAL IMPACT REPORTS

Sec. 7c-l. The criteria and procedures utilized
in preparation, review and consideration of environmental
impact reports as required by the Environmental Quality Act
of 1970 (Public Resources Code Section 21000 et ~.) or by
this code shall be as specified by resolution-of~e City
Council of the City of Seal Beach. No person shall perform
any activity requiring an environmental impact report without
first complying with the provisions of the chapter and the
resolution or resolutions adopted by the City Council.
Sec. 7c-2. Prior to a public hearing to consider
an environmental impact report for a project proposed by other
than the local agency, a fee of Fifty Dollars ($50.00) shall
be paid by the applicant. This fee will be used to help offset
the cost of the public hearing.
Sec. 7c-3. A deposit, the amount of which will be
determined by the Director of Planning, shall be made at the
time the application for a project requiring an environmental
impact report is fired. The deposit shall be in an amount
necessary to cover the City's estimated costs of preparing
and evaluating the environmental impact report. The deposit
shall not be less than $250.00 and in no case exceed the sum
of $10,000.00. When the City's costs in the preparation or
the evaluation of the environmental impact report exceed the
amount of the deposit the applicant shall pay the difference
prior to the issuance of any ~ermits or other entitlements
from the City. When the City s costs in the preparation and
evaluation of the environmental impact report are less than the
amount of the deposit the City shall refund the balance of the
deposit to the applicant.
Sec. 7c-4. Charges to cover the expense of
compilation, analysis and review of environmental factors
required in the preparation and evaluation of an environmental
impact report for a project proposed by other than the local
agency shall be paid by the applicant for services in
accordance with the following schedule:

Sec. 7c-5. Before issuing any building permit
for a structure or series of structures to be developed as
a single development unit which has not otherwise been re-
quired to be the subject of an environmental impact report
and which has a valuation of in excess of $ 500.000.00 ,
the City Engineer shall require that an environmental impact
report on the structure or structures be prepared pursuant to
this chapter, in order to insure that the policies and purposes
of the Environmental Quality Act and of this chapter are
satisfied.
