I ORDINANCE NUMBER t r 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, REGULAT,ING THE USE OF CERTAIN DESIGNATEO PROP.ERTY, DECLARING THE URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY, WHEREAS, The planning Commission of the City of Seal Beach has been studying the question of the best and most proper use of that 7.85 acre parcel of land described in Exhibit A, attached and made a part hereof by reference; and WHEREAS, The Planning Commission has indicated to this city Council that its study of this question is as yet unfinished: NOW, THEREFORE, the City Council of the City of Seal Beach, california, does hereby ordain as follows: Section 1. No development on that 7.85 acre parcel of land des- cribed in Exhibit "A", attached hereto and made a part hereof by reference, shall be permitted for a period of four (4) months from the effective date of this ordinance. I Section 2. This ordinance shall take effect and be in force immediately upon its adoption as an emergency ordinance: facts constituting its urgency are as follows: In order to preserve the public peace, health and safety since it is essential to properiy evaluate the use of the declining asset of available open space in the immediate neighborhood of the subject property prior to its further depletion. Section 3. The city Clerk shall certify to the passage and adop- tion of this ordinance as an emergency ordinance, and shall cause the same to be posted as required by law. Highest and Best'Use of 7.85 acre Bixby Parcel and City Council Ordinance No. 878. en:August l4, 1972, the City Council adopted Ordinance No. 878 which provided ... tour-month moratorium on the' issuance of building permits on the 7.85 acre Bixby'parcel to allow the Planning Commission to stu~ the highest and best ~~~ ~d zoning of that property. The Planning Commission has studied all previous actions by both the Planning tommlssion and City Council on the subject property. The Commission invited comments from the audience with regard to the property, contacted the Naval Air Station, Los Alamitos, regarding their proposed activities that could aftect the property, and invited comments from the property owner of their proposed uses of the property. A stu~ was conducted to determine. the effect ot potential development ot the property under its present zone of R-3, Multi- Family Residential. The Planning Commission voted to continue the stu~ ot the highest and best use and zoning ot the property and has requested that the City Council extend the moratorium for an additional four months in order that the Commission might complete their stu~. Should the City Council desire to continue the moratorium on development of the 7.85 acre site, an emergency ordinance is included for your consideration.
