A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA OPPOSING ADOPTION OF PROPOSED
SENATE BILL 164 WHICH WOULD MANDATE COMPULSORY AND
BINDING ARBITRATION FOR USE IN LABOR DISPUTES
INVOLVING LOCAL GOVERNMENT FIRE AND POLICE EMPLOYEES.
any plan imposing compulsory and binding arbitration removes the
ability of locally elected officials to make decisions on a primary
budgetary consideration; and
SB 164 would set up a three-member arbitration panel to choose a
package of benefits from final offers presented by both parties
to negotiations in impasse proceedings; and
SB 164, if adopted, would leave final decisions as to wages and
benefits for fire and police personnel with a non-elected board
which would not be accountable to the citizens of Seal Beach; and
arbitration would be compu;.sory upon reaching impasse in negotiations
and would, therefore, reduce the incentive on the part of employees
groups to reach agreement through negoti at ions; and
compulsory binding arbitration would afford a means to circumvent
the will of the locally elected representatives; and
the City Council of the City of Seal Beach, h~, in the past, gone
on record in opposition to any legislation whith would mandate
compulsory and binding arbitration;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach,
California, does hereby oppose adoption of proposed SB 164 which would mandate
compulsory and binding arbitration.
BE IT FURTHER RESOLVED that copies of this resolution be sent to State Senator
Dennis Carpenter, Assemblyman Dennis Mangers, and members of the State Senate
Committee on Governmental Organization, and all cities in Orange County.
