ORDINANCE NUMBER 874
AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
ARTICLE 2, DEFINITIONS, AND SECTION 1835 OF
ARTICLE 18, AUTOMOBILE SERVICE STATIONS;
PERFORMANCE AND DEVELOPMENT STANDARDS, OF
ORDINANCE NO. 628, ZONING ORDINANCE; AND
REPEALING ORDINANCE NUMBER 828.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS:
Section 1. Article 2, Definitions, is hereby amended by the
addition of the following:
Sec. 237A. Free Standing Sign
A sign supoorted by a structural column or similar
upright permanently mounted in the ground.
Sec. 271A. Promotional Banner
A poster composed of cloth, paper, plastic or other
flexible material, used to display temporary
promotions.
Sec. 288A. Tire Display
A tire or group of tires placed outside the building
in the customer service area.
Sec. 291A. Trash Enclosure
Wall or fence, six feet in height surrounding the trash
bin and accessible by a gate of sufficient width to
allow the bin to be removed and which is constructed in
a manner and of materials that blend architecturally
and aesthetically with the main structure.
Section 2. Section 1835 of Article 18, Automobile Service Stations;
Performance and Development Standards, of Ordinance No.
628, is amended by the following revisions and additions.
A. Paragraph (A), Purpose and Intent, of Sec. 1835 of Ordinance
No. 628 is amended to read as follows:
The Automobile Service Station Standards are established
to allow the construction, operation and maintenance of
service stations so as to be compatible with other
permitted uses in the zone. It is recognized that
service stations warrant special consideration because
of several important elements of design and operation
that are unique and significant such as: total
dependence on vehicular traffic, distinctive physical
appearance, unenclosed nature of activities, and long
hours of operation. The standards are intended to
minimize any adverse effect on neighboring uses by the
application of standards for signs, landscaping, screening
and the location and nature of operating activities.

B. Paragraph (B), Uses Permitted" of Sec. 1835 of Ordinance
No. 628 is amended by the addition of the following:
Only vehicles being serviced, vehicles of employees
and/or service vehicles shall be parked or stored upon
the site. Wrecked or dismantled vehicles shall be
removed from the site within forty-eight (48) hours.
C. Paragraph (E), Exterior Displays and Trash and Storage, of
Sec. 1835 of Ordinance No. 628 is amended by the revision
of the second paragraph as follows:
Storage of parts or trash shall be within a building or
trash enclosure.
D. Paragraph (F), Signs, of Sec. 1835 of Ordinance No. 628 is
amended by the revision of sub-paragraphs (b) and (c) and
the addition of sub-paragraphs (f) and (g) as follows:
(b) For corner lots, two price boards, not exceeding
20 square feet each, may be located either at the
intersection or along the frontage of either street.
(c) For interior lots, one free standing price sign
not exceeding 20 square feet may be located along the
frontage road.
(f) Three (3) single faced promotional banners~'each
not to exceed 24 square feet each face, may be located
on permanent poles or building structures on the
premises.
(g) Only one face of double faced signs are included
in the total sign area.
E. Paragraph (I), Screening, of Sec. 1835 of Ordinance No.
628 is amended by revising the first paragraph under this
heading as follows:
A masonry screen wall shall be installed and maintained
along property lines where the premises abut areas zoned
for residential uses. 'Said wall shall be six (6) feet
in height, except within 20 feet of any ultimate street
right of way line, where the height shall not be less
than three and not more than three and one-half feet.
Where there is a difference in elevation on opposite
sides of the wall, the height shall be measured from
the highest elevation.
F. Sub-paragraph (4) of Paragraph (J), Landscaping, of Sec.
1835 of Ordinance No. 628 is amended to read as follows:
(4) Intersections: Landscaping along all streets and
boundaries shall be limited to a height of not more
than 3 1/2 feet within 20 feet of the point of
intersection of: . . . . . .
G. Paragraph (L), Discontinued Operation, shall be added to
Sec. 1835 of Ordinance No. 628 to read as follows:
When the intended use of any service station is
discontinued and said use is not re-established

within ninety days, any conditional use permit or
variance shall immediately become null and void,
and the buildings and structures shall be and are
hereby declared to be a public nuisance. In the
event that a ninety-day discontinuance can be shown
to cause an undue and unnecessary hardship, said
owner may apply for one (1) ninety-day continuance
by submitting facts sufficient to satisfy the
Planning Commission that a hardship exists.
Section 3. Ordinance Number 828 is hereby repealed.
