" ORDINANCE NUMBER~ AN ORDINANCE OF THE CITY OF SEA~ JEACH, CALIFORNIA, AMENDING SECTIONS 7-40 AND 7-44, CHAPTER SEVEN, OF THE SEAL BEACH CITY CODE RELATING TO "SICK LEAVE." THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Section 7-40, Chapter Seven, of the Seal Beach City Code shall be amended to read as follows: Sick leave is hereby defined to mean the absence from duty of an employee because of illness, or exposure to a contagious disease, or death in the immediate family. "Immediate family" shall mean the spouse, the father, mother, son, daughter, brother, sister, grandparents or dependent relatives of the employee. Section 2. Section 7-44, Chapter Seven of the Seal Beach City Code shall be amended to read as follows: Section 7-44. Emplo)rees in positions or classes of positions designated by resolution of the City Council as performing services four days per week (ten hours per day) or five days per week (eight hours per day), shall be allowed to accumulate sick leave as follows: Sick leave for miscellaneous employees shall be accumulated at the rate of eight (8) hours per month to a maximum of nine hundred (900) hours; sick leave for employees who are members of the Seal Beach Firefighters Association shall be accumulated at a rate of twenty-four (24) hours per month without limit; sick leave for employees who are members of the Seal Beach Police Officers Association shall be accumulated at a rate of ten (10) hours per month without limit. Sick leave shall be charged at the rate of one (1) day for each work day an employee is absent on sick leave; provided the absences of one-half (~) day or less shall be charged at the rate of no less than two (2) hours against the employee's total. Section 3. Effective date. This ordinance shall become effective thirty 130) days after its adoption by the City Council. Section 4. If any section, subsection, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person, firm, corporation or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that anyone or more sections, subsection, sentence, clause, phrase or portion be declared invalid or unconstitutional.
