AN EMERGENCY ORDI NANCE OF THE CITY OF SEAL
BEACH PROVI DING FOR APPLI CATION OF CALIFORNIA
VEHICLE CODE AND CHAPTER 13 OF THE SEAL BEACH
MUNICIPAL CODE THROUGH CERTAIN PRIVATE ROADS
BY ADDING CHAPTER 13, ARTICLE XIII TO THE MUNICIPAL
CODE.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN
AS FOL LOWS:
Section 1. Chapter 13 of the Municipal Code is hereby amended by
adding the following language:
Article XIII
PRIVATE ROADS
Section 13-150. Application of Provisions of Chapter 13 to Private
Roads. Wherever pursuant to Section 21107.5 and/or 21107.7 of the

Vehicle Code of the State, the City Council does by Ordinance apply the pro-
visions of the Vehicle Code to privately owned and maintained roads, the
provisions of this Chapter 13 of the Municipal Code shall likewise be applied
to such private roads.
Section 13-151. Enforcement of the Provisions of this Chapter and the
Vehicle Code on Privately Owned and Maintained Roads. The City Council of
the City of Seal Beach hereby finds and determines that the following are
privately owned and maintained roads which are not generally held open for
use of the public for purposes of vehicular traffic, but by reason of their
proximity to or connection with highways, the interests of the residents
residing along such roads and the motoring public will be best served by appli-
cation of provisions of the Vehicle Code of the State of California to such

roads, to-wit:
SURFSIDE AVENUE, PACIFIC AVENUE, SEAL WAY, AND
PHILLIPS AVENUE~

Section 13-152. Pursuant to the Provisions of Section 21107.7
the City Council of the City of Seal Beach hereby declares that the pro-
I visions of this Chapter and the Vehicle Code of the State of California shall
apply to the aforementioned privately owned and maintained roads. The City
Council further finds and determines that it shall provide law traffic and law
enforcement on said streets and that said streets shall be subject to all the
provisions of this Code and the Vehicle Code of the State; and except as here-
in provided, the City of Seal Beach shall not be deemed to assume any
responsibility or liability for the maintenance or care of said privately owned
and maintained streets.
Section 2. The City Council hereby declare that this is an urgency
Ordinance effective forthwith and that the facts constituting the urgency consist
of the following:

At the present time motor vehicles are being operated on such
privately owned and maintained roads in such manner as to en-
danger the lives and property of the persons in the immediate
vicinity.
Section 3. SEVERABILITY. If any section, subsection, sentence,
clause, phrase, or portion of the ordinance, or the application thereof to any
person, firm, corporation or circumstance, is for any reason held to be
invalid 01" unconstitutional by the decision of any court of competent juris-
diction, such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council of the City of Seal Beach hereby declares
that it would have adopted this ordinance and each section, subsection,
sentence, clause, phrase, or portion thereof, irrespective of the fact that any

one or more section, subsection, sentence, clause, phrase or portion be
declared invalid or unconstitutional.
Section 4. The City Clerk shall certifY to the passage and adoption
