AGENDA ITEM ~t~~ A ORDINANCE NO. 818 AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, ADOPTING CHAPTER 10 A COM- PRISING SECTIONS 10 A-I THRU 10 A-6 OF THE CITY CODE ESTABLISHING AN APPOINTIVE LAW REVISION COMMISSION A ND PRESCRIBING ITS DUTIES AND FUNCTIONS THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN: Section 1: Chapter 10 A comprising Section 10 A-l thru Section 10 A-6, both InClUSIVe, of the Seal Beach City Code is hereby adopted as follows: CHAPTER 10 A LA W REVISION COMMISSION Section 10 A-1. Law Revision Commission Created The City Council pursuant to the provisions of A rticle VIII of the Charter of the City of Seal Beach does hereby create a law revis- ion commission to be known as the City Law Revision Commission, Section 10 A-2. Powers and Duties Generally It shall be the duty of the members of the City Law Revision Com- mission to review and study the existing City Charter, City Code and individual City Ordinances of the City of Seal Beach and to recommend to the City Council specific new enactments and appro- priate amendments and repeals of existing enactments in order that the laws of the City of Seal Beach may be: (a) Free from contradictions and inconsistencies, (b) More clear and understandable for all citizens. (c) Efficiently administered and at the same time fairly and justly applied and enforced, and (d) In harmony with ever changing limitations of the federal and state constitutions, and with financial participation, matching funds, and similar state and federal legislation. The City Law Revision Commission's responsibilities shall relate to technical, administrative, procedural and constitutional aspects of City enactments, Policy making legislative functions shall con- tinue to be exercised by an elected City Council whose members are directly responsible to the electorate. Section lOA -3, Composition and A ppointment of Members The City Law Revision Commission shall consist. of five members, appointed by motion of the City Council adopted by at least three ~ I I: I , ... Ordinance Number , . . affirmative votes, from the qualified electors of the City, none of whom shall hold any paid office or employment in the city government, Members of the City Law Revision Commission shall serve a term of four years and until their successors are appointed and qualified. If a vacancy shall occur otherwise than by expiration of term, it shall be filled by appointment for the unexpired portion of the term, The term of at least one member of the City Law Revision Commission shall expire on each year on July first or such other date as may be established by ordinance in accordance with provisions of the City Charter, Section 10 A-4, Terms of Office; Filling Vacancies The first commission to be appointed shall, at its first meet- ing, so classify its members by lot that one shall serve for one year, one for two years, one for three years, and two shall serve for four years, Their successors shall be appointed for terms of four years. If a vacancy shall occur otherwise than by expiration of term, it shall be filled by appointment for the unexpired portion of the term, Section 10 A -5. Presiding Officer; Meetings; Quorum; ReqUIred Vote; .H.ules of Procedure; Records The Law Revision Commission shall, as soon as practicable following the first day of July of each year, elect one of its members to serve as presiding officer at the pleasure of the Law Revision Commission, The Commission shall likewise elect one of its members to serve as presiding officer pro tempore (vice chairman) at the pleasure of the commission, The commission shall hold regular monthly meetings on the third Tuesday of each month in the City Council Chambers which shall be open to the public, and may adjourn or re- adjourn any regular meeting to a date and hour certain which shall be specified in the order of adjournment; when so ad- journed such adjourned meeting shall be a regular meeting for all purposes. If at any time any regular meetings fall on a holiday such regular meeting shall be held on the next business day, A majority of the members of the Law Revision Commission shall constitute a quorum to do business, but a less number may adjourn from time to timjl, in the absence of all the members of the Law Revision Commission from any regular meeting; the secretary may declare the same adjourned to a stated day and hour. Special meetings may be called at any time by the presiding officer of the commission, or by three members of the Law Revision Commission; by written notice delivered personally, or by mail, or by the secretary to each member of the com- mission at least three hours before the time specified for the proposed meeting, provided that a special meeting may be also validly held without the giving of such written notice if all members shall give their consent in writing, and such consent is on file in the office of the commission's secretary. ..." .... , ( I I . . The commission shall adopt rules for the transaction of business consistent with the City Charter and subject to approval of the City Council. The secretary shall keep a record of the commission's rules of business, resolu- tions, transactions, findings, and determinations, which rp.cord shall be a public record, Spction 10 A-5. Removal of Members; Vacation of Office Member; CompensatlOn Any member of the Law Revision Commission shall be s ubj ect to removal by motion of the City Council adopted by at least three affirmative votes, The office of any member of the Law Revision Commission shall be vacated if such member absents himself from three regular meet- ings of the commission, unless by permission of the com- mission, or if he is convicted of a crime involving moral turpitude or ceases to be an elector of the city, The Mem- bers of the law revision commission shall serve without compensation, but shall receive as expenses the sum of ten dollars per meeting, not to exceed thirty dollars per month, Section 2: The City Clerk of the City of Seal Beach is hereby directed to cause thIS ordinance to be posted as required by law, day of t!J;b;~J PASSED, APPROVED, AND ADOPTED this ,l~. ~TT: / 4$ Cff),,-//; erk STATE OF CALIFORNIA) ) ss.
