AN ORDINANCE OF THE CITY OF SEAL BEACH,
CALIFORNIA, ADOPTING CHAPTER 7 B COM-
PRISING SECTIONS 7 B-1 THRU 7 B-6 OF THE
CITY CODE ESTABLISHING AN APPOINTIVE
ENVIRONMENTAL QUALITY CONTROL BOARD
AND PRESCRIBING ITS DUTIES AND FUNCTIONS
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN:
Section 1: Chapter 7 B comprising Section 7 B-1 thru Section 7 B-6, both
mcluslve, of the Seal Beach City Code is hereby adopted as follows:

CHA PTER 7 B
ENVIRONMENTAL QUALITY CONTROL BOARD
Section 7 B-1.
Environmental Quality Control Board Created
In order to better meet and cope with the grave environmental and
pollution problems facing the City of Seal Beach and its inhabitants,
the City Council, pursuant to the provisions of A rticle VIII of the
City Charter, does hereby create an appointive board to deal with
the problems of controlling the quality of the environment to be known
as the City Environmental Quality Control Board.
Section 7 B-2.
Powers and Duties Generally
It shall be the duty of the members of the City Environmental Quality
Control Board to:
(a) Study the environment of the City of Seal Beach and investi-
gate all actual and any potential threats to be continued main-
tenance of a high quality, clean environment for the City and
its inhabitants,
(b) Report to the City Council, to other city boards, commissions
and departments, and to other public and private agencies and
groups its recommendations for affirmative steps that may be
taken to maintain and improve the quality of the environment of
the City of Seal Beach and of its inhabitants, and
(c) Report to the City Council, to other city boards, commissions
and departments, and to other public and private agencies and
groups its recommendations for legislation and for other action
that could or might curtail or limit those activities which appear
to be an actual present threat, or which may become a potential
threat in the future, to the maintenance of a high quality, clean
environment for the City of Seal Beach and for its inhabitants. and
(d) To perform such other duties as mp.y, from ~ime to time, be
properly assigned or delegated to it by the City Council.
Section 7 B-3.
Composition and Appointment of Members
The environmental quality control board shall consist of five members,
appointed by motion of the City Council adopted by at least three

affirmative votes, from the qualified electors of the City, none
of whom shall hold any paid office or employment in the city
government. Members of the environmental quality control board
shall serve a term of four years and until their successors are
appointed and qualified, If a vacancy shall occur otherwise than
by expiration of term, it shall be filled by appointment for the un-
expired portion of the term, The term of at least one member of
the environmental quality control board shall expire on each year
on July first or such other date as may be established by ordinance
in accordance with provisions of the City Charter,
Section 7 B-4. Terms of Office; Filling Vacancies
The first board to be appointed shall, at its first meeting, so
classify its members by lot that one shall serve for one year,
one for two years, one for three years, and two for four years,
Their successors shall be appointed for terms of four years,
If a vacancy shall occur otherwise than by expiration of term,
it shall be filled by appointment for the unexpired portion of the
term,
Section 7 B-5.
Presiding Officer; Meetings; Quorum;
Requlred Vote; Rules of Procedure;
Records
The environmental quality control board shall, as soon as practi-
cable following the first day of July of each year, elect one of its
members to serve as presiding officer at the pleasure of its mem-
bers, The board shall likewise elect one of its members to serve
as presiding officer pro tempore (vice chairman) at the pleasure
of the board.
The board shall hold regular monthly meetings on the first and third
Thursdays of each month in the City Council Chambers which shall
be open to the public, and may adjourn or re-adjourn any regular
meeting to a date and hour certain which shall be specified in the
order of adjournment; when so adjourned such adjourned meeting
shall be a regular meeting for all purposes, If at any time any
regular meetings fall on a holiday such regular meeting shall be
held on the next business day.
A majority of the members of the environmental quality control board
shall constitute a quorum 10 do business, but a less number may ad-
journ from time to time, in the absence of all the members of the
environmental quality control board from any regular meeting; the
secretary may declare the same adjourned to a stated date and hour.
Special meetings may be called at any time by the presiding officer
of the board, or by three members of the environmental quality con-
trol board; by written notice delivered personally, or by mail, or
by the secretary to each member of the board at least three hours
before the time specified for the proposed meeting, provided that a
special meeting may be also validly held without the giving of such
notice if all members shall give their consent in writing, and such
consent is on file in the office of the board's secretary.

The board shall adopt rules for the transaction of business consis-
tent with the City Charter and subject to approval of the City

Council. The secretary shall keep a record of the board's rules
of business, resolutions, transactions, findings, and determina-
tions, which record shall be a public record.

Section 7 B-6. Removal of Members; Vacation of Office
Member; CompensatlOn
,

A ny member of the environmental quality control board shall be
subject to removal by motion of the City Council adopted by at
least three affirmative votes. The office of any member of the
environmental quality control board shall be vacated if such
member absents himself from three regular meetings of the board,
unless by permission of the board, or if he is convicted of a crime
involving moral turpitude or ceases to be a elector of the city,
The members of the environmental quality control board shall
serve without compensation, but shall receive as expenses the
sum of ten dollars per meeting, not to exceed thirty dollars per
month,
Section 2: The City Clerk of the City of Seal Beach is hereby directed to
cause thIS ordinance to be posted as required by law,
