Home My WebLink AboutCC Ord 821 1970-11-02 I I I ~ , :' - ORDINA NCE NO. 1~ J AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, PROHIBITING, TEMPORARILY, THE ISSUANCE OF BUILDING PERMITS FOR CONSTRUCTION OF NEW STRUCTURES OR MAJOR IMPROVEMENTS WITHIN THE PROJECT BOUND- ARIES OF THE RIVERFRONT REDEVELOPMENT PROJECT OF THE REDEVELOPMENT AGENCY OF THE CITY OF SEA L BEA CH, AND DECLARING THE URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY THE CITY COUNCIL OF THE CITY OF SEA L BEA CH DOES HEREBY ORDA IN: Section 1. J The City Council of the City of Seal Beach hereby finds and determines that in the original consideration and adoption of the Redevelop- ment Plan of the Riverfront Redevelopment Project of the Redevelopment Agency of the City of Seal Beach, absolutely no investigation, study, evalu- ation or consideration was made or given to the possible adverse, or even catastrophic, effects that the implementation of the Project Plan might have upon the quality and purity of the environment and ecology of the community of Seal Beach and of its inhabitants, and upon the quality of life as it exists in this community. Section 2. The City Council of the City of Seal Beach hereby finds and determines that any further implementation of the Project Plan at the present time, or before a comprehensive study and evaluation of the possible effects of such implementation upon the environment and ecology of life in the Seal Beach community, creates and presents a clear, immediate and urgent risk and danger to the health, safety and general welfare of the inhabitants of the community by creating contamination and pollution and further contamination and pollution of the air, water and land, and by placing inordinate burdens upon, and over taxing, the presently existing and available public facilities of the community that furnish public services, police and fire protection, public utilities, water, and treat and dispose of sanitary sewage for all of the inhab- itants of the community. Section 3. The City Council of the City of Seal Beach finds and deter- mines that the first comprehensive review in over five years of the General I I I Ordinance Number . '. . Plan of the City has just been undertaken, and that the objectives and pur- poses of that comprehensive review of the General Plan include the attain- ing of unity in the construction and development of the City along lines which tend to promote the health, safety, morals and general welfare of the entire community, and that any further substantial implementation of the Project Plan pending completion of such comprehensive review of the General Plan would tend to defeat and frustrate the very objectives and purposes of such a comprehensive review and of the General Plan itself. Section 4. Commencing on November 2, 1970 and continuing through I.. 4J~ 'V' ,19:;1-' both dates inclusive, no building permit shall be issued for the construction of any new structures or for any other major improvements of any property situated within the Project Boundaries of the Riverfront Re- development Project of the Redevelopment Agency of the City of Seal Beach, ("Project Boundaries" as used herein refer specifically to the real property situated in Seal Beach, California, which is specifically described and set forth in Section 300 of the Redevelopment Plan For The Riverfront Redevelop- ment Project, which plan was approved and adopted by reference in Seal Beach City Ordinance No, 780, entitled "A n Ordinance of the City of Seal Beach, Calif- ornia, Approving and Adopting The Redevelopment Plan, as Modified, For The Riverfront Redevelopment Project" adopted March 3,1969,) Section 5, Nothing in this Ordinance prohibits the issuance of building permits for the purpose of making repairs or minor alterations to structures within said Project Boundaries which were in existence upon the date of the adoption of this Ordinance. Section 6. If any section, subsection, sentence, clause, phrase, or por- tion of this Ordinance, or the application thereof to any person, firm, corpor- ation or circumstance, is for any reason held to be invalid or unconstitutional (2) J I I Ordinance Number . '. by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Seal Beach hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that anyone or more section, subsection, sentence, clause, phrase or portion be declared in- valid or unconstitutional. Section 7, This Ordinance shall take effect and be in force immed- iately upon its adoption as an emergency ordinance and the facts constituting its urgency are as follows: A ny further, substantial implementation of the Project Plan, without first completing an environmental study and evaluation thereof, threatens, endangers and jeopardizes the immediate health, safety and general welfare of the community and of its inhabitants by the further pollution and contamination of the air, water and land and by making excess- ive demands upon the existing public facilities furnishing public services, police and fire protection, public utilities, water and sanitary sewage facilities for all of the inhabitants of the community, Section 8. The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council and shall cause the same to be posted as required by law. - ATTEST: (3) I I I Ordinance Number .' " .'
