THS CITY CLERK'S O;:;:ICE I I ORDINANCE NUMBER 785 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, PROHIBITING THE FEEDING OF WILD BIRDS. The city Council of the City of Seal Beach, california, does hereby ordain as follows: Section 1. It is the purpose of this ordinance to diminish the defacement, deterioration, and littering of property in the City caused by the feeding of wild birds. Section 2. Definitions. "Person" means natural person, firm, corporation, or association. "Wi~d'Bird" means any bird of the family Columbidae and includes pigeons and doves. "Public Street" means a public thoroughfare, avenue, road, highway, boulevard, parkway, way, drive, lane, alley or court, including the right-of-way for vehicular traffic, gutter, curb, parking, and sidewalk. Section 3. Feeding on Public Streets. It is hereby declared to be a nuisance and no person shall feed any wild bird upon any public street or upon any publicly-owned property within the City of Seal Beach. Section 4. Feeding on Private Property. It is hereby declared to be a nuisance and no person shall feed any wild bird which is not in his custody or control, and which is not confined within an enclosure, upon any private property, not owned or controlled by him in the City of Seal Beach. Section 5. Depositing Feed upon Public Street or Public Place. It is hereby declared to be a ~uisance and no person shall throw, deposit, or place any seed, grain, nuts, crumbs, scraps, or other feed or any substance intended as feed for any bird or animal upon any public street or upon any publicly-owned property in the City of Seal Beach. Section 6. Penalties. Any person violating any of the prov1s1ons of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than $500.00: or by imprison- ment for a period of not more than 6 months: or by both such fine and imprisonment. I Section 7. Severability. If any section, subsection, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person, firm, corporation, or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentence, clause, phrase, or portion be declared invalid or unconstitutional.
