AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA,
AMENDING SECTIONS 10-20 and 10-21 OF ARTICLE Ill,
CHAPTER 10 OF THE SEAL BEACH CITY CODE, RELATING TO
MONTHLY SERVICE CHARGES BY CITY FOR REFUSE COLLECTION.
The City Council of the City of Seal Beach does ordain as follows:
Section 1. Section 10-20, Article Ill, Chapter 10 of the Seal Beach
City Code is hereby amended to read as follows:
A monthly charge for the collection of garbage and
rubbish from a single-family dwelling shall be
One Dollar and Thirty Cents ($1.30) per month.
The monthly charge for the collection of garbage
and rubbish from multiple-residential dwellings
shall be One Dollar ($1) for each dwelling unit
per month.
Section 2. Section 10-21, Article Ill, Chapter 10 of the Seal Beach
City Code is hereby amended to read as follows:
A monthly charge for collection of garbage and
rubbish by the contractor for commercial establish-
ments shall be calculated on the basis of the
following commercial rate schedule:

For each additional unit of twenty (20) 50-gallon cans, or any part
thereof, there shall be an additional charge of Seven Dollars and
Eighty Cents ($7.80) per month of each such unit.
The commercial rate is applicable to all those activities and
occupancies for which a license is required under Chapter 11, or
which are not permitted in residential districts under prevailing
land use and zoning code provisions.

The monthly consumer price index figure (all items using 1957-59) for
the Los Angeles-Long Beach Metropolitan area for the month of October
of each year commencing in 1970 shall hereafter be ascertained from
bulletins issued by the United States Department of Commerce, Bureau
of Labor Statistics: and if said index figure is greater or less than
the said index figure for the month ending October 31, 1969, then the
rate charged by the City for collection of rubbish, garbage, and other
refuse from residential, commercial, or industrial users as herein
provided shall be increased or decreased by that percentage which the
index figure for the month of October of such year is to the October
31, 1969, index figure, provided that such increase or decrease shall
be rounded to the nearest five cents (.05), and shall be effective
the following January First.
In the event the Director of Public Works determines, and/or provides
a bin at a commercial establishment for regular collection of refuse,
rubbish, and/or garbage, the charge for collection and use of such
bin shall be Twenty-Three Dollars and Forty Cents ($23.40) per month,
or based upon the schedule of charges indicated above, whichever
amount is greater.
Section 3. Severability.
If any section, subsection, sentence, clause, phrase, or portion of
this ordinance, or the application thereof to any person, firm,
corporation, or circumstance, is for any reason held to be invalid
or unconstitutional by the decision of any court of competent juris-
diction, such decision shall not affect the validity of the remaining
portions of this ordinance. The Council of the City of Seal Beach
hereby declares that it would have adopted this ordinance and each
section, subsection, sentence, clause, phrase, or portion thereof
irrespective of the fact that anyone or more sections, subsections,
sentence, clause, phrase, or portion be declared invalid or
unconstitutional.
Section 4. Effective Date.
This ordinance shall become effective September 1, 1969.
Section 5. Certification and Posting.
The City Clerk shall certify to the passage and adoption of this
ordinance and shall cause the same to be posted as required by law.
