AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
THE SEAL BEACH CITY CODE, CHAPTER 7, SECTION 37:
DELETING CHAPTER 7, SECTION 38, BASIC PAY PLAN:
AND ADDING THERETO SECTION 38, HOLIDAYS AND DAYS
OFF.

The City council of the city of Seal Beach does ordain as follows:
Section 1. Chapter 7, Section 7-37, Seal Beach City Code is hereby
amended to read as follows:
I
(a) vacations - Police Department
Every full-time employee of the Police Department who is
classified as a safety member of the Public Employees Retire-
ment System, who shall have one year of continuous service
immediately preceding, shall be given a vacation of fifteen
(15) working days with pay each year in addition to regular
days off and days off in lieu of holidays. After one year
of continuous service, such employee shall earn one and
one-fourth (l~) days of vacation per month, and after ten
(10) years of continuous full-time service such employee
shall earn one and two-thirds (1 2/3) vacation days per month
(20) days per year).

(b) vacations - Other Employees
Every full-time employee of the city, except an employee
of the Police Department, who is classified as a safety mem-
ber of the Public Employees Retirement System, who shall have
one year of continuous service immediately preceding, shall
be given a vacation of fourteen (14) working days with pay each
year in addition to regular days off and holidays, or days off
with pay in lieu of holidays. After one year of continuoup
full-time service, such a full-time employ~e shall earn l.l6667
days of vacation with pay each month os full-time employment,
and after ten (10) years of continuous full-time employment,
immediately preceding, such employee shall earn 1.5833 days
of vacation with pay each month of such full-time employment.
For the purpose of computation of vacation privileges for
full-time employees of the Fire Department who are assigned
to fire suppression, fire fighting, dispatching, or similar
duties, and who are on duty fifty-six (56) hours per week,
one on-duty shift of twenty-four (24) hours shall constitute
the equivalent of two (2) days.
(c) Vacation - Emplovees Not Eliqible
An employee of the city classified as a provisional
employee, hourly employee, part-time employee, or seasonal
employee shall not be eligible for paid vacation.

(d) Accumulation of Vacation Time
The times during a calendar year at which an employee
may take his vacation shall be determined by the department
head with due regard for the wishes of the employee and
particular regard for the need of the service. If the require-
ments of the service are such that an employee must defer part
or all of his annual vacation in a particular calendar year,
the department head or appointing authority may permit the
employee to take such deferred vacation during the following
calendar year.

(d) Accumulation of vacation Time (continued)
No employee may accumulate more than the number of days
of vacation earned in the prior year. Any eligible employee,
with the consent of the head of his department or appointing
authority, may defer five (5) working days of his annual
vacation to the succeeding calendar year, subject to the
provisions of this subsection. A written report of each
deferred vacation, signed by the proper department head,
noting the details, shall be kept on file with the Personnel
Office. In the event one or more holidays fall within an
annual vacation leave, such holidays shall not be charged
as vacation leave, and the vacation leave shall be extended
accordingly.
Employees who terminate employment shall be paid in a lump
sum for all accrued vacation leave earned prior to the
effective date of termination. Such payment shall be on
the next regular pay day following termination. No such
payment shall be made for vacation accumulated contrary to
the provisions of the civil Service Rules and Regulations,
Resolution Number 1348, as it now exists or may hereafter
be amended, or Chapter 7 of the Seal Beach City Code as it
now exists or may hereafter be amended, or the Charter of
the city of Seal Beach.
(e) Vacation - Effective Date
For the purpose of computing vacations this ordinance
shall be considered as being effective on July 1, 1969.
This section shall repeal Section 1, Rule Xl of the Civil
Service Rules and Regulations contained in Resolution No.
1348.
Section 2. Chapter 7, Section 7-38, Seal Beach City Code, shall
read as follows:
(a) Holidays and Days Off - Police Department
Every full-time employee of the Police Department who
is classified as a safety member of the Public Employees
Retirement System shall be granted $ix (6) days off each
calendar year in lieu of holidays. The Chief of police,
in conformance with this ordinance and any supplementary
regulations of the Personnel Officer, shall schedule such
days off in lieu of holidays consistent with department
work load and the best personnel practices and scheduling
practices. Such days off with pay in lieu of holidays
shall be in addition to One Hundred and Four (104) days
off each year, and in addition to vacation with pay as
specified in this ordinance.

(b) Holidays and Days Off - Other Employees
Every full-time employee of the city, except employees
of the police Department and the Fire Department who are
classified as safety members of the public Employees Retire-
ment System, shall be granted the following holidays with
pay:
New Years Day (January 1)
Memorial Day (May 30)
Independence Day (July 4)
Labor Day (first Monday in September)
Veteran's Day (November 11)
Thanksgiving Day (fourth Thursday in November)
Christmas Day (December 25)
A total of seven (7) holidays annually.
In the event one of the afore-mentioned holidays falls on
a Saturday, the preceding Friday shall be observed as a
holiday: in the event one of the afore-mentioned holidays
falls on a Sunday, the following Monday shall be observed
as a holiday. Not withstanding the provisions of this sub-
section, an employee of the city who generally is assigned
to an eight (8) hour day on a five day per week basis, or
other similar schedule of work, and when it is necessary for
such employee to be scheduled for work on holidays, such
employee shall be granted seven (7) days off with pay each
calendar year in lieu of the above-designated holidays.
Such holidays off with pay as designated herein shall be
in addition to Saturdays and Sundays or 104 days in lieu
thereof, and shall be in addition to vacation with pay
as specified in this ordinance.

(c) Holidays and Days Off - Fire Department
Every employee of the Fire Department, who is classi-
fied as a safety member of the Public Employees Retirement
System, and who is assigned to fire suppression, fire
fighting, dispatching or similar duties, who is on duty
fifty-six (56) hours per week, shall be granted three and
one=half (3~) shifts of twenty-four (24) hours each off
with pay in lieu of holidays. The Fire Chief, in confor-
mance with this ordinance and any supplementary regulation
of the Personnel Officer, shall schedule such days off in
lieu of holidays consistent with departmental work load
and the best personnel and scheduling practices. Such
days off with pay in lieu of holidays shall be in addition
to regularly scheduled days off (in lieu of Saturdays and
Sundays) and vacation with pay as specified in this
ordinance.

(d) Holidays - Employees Not Eligible
An employee of the city classified as a provisional
employee, hourly employdd. part-time employee, or
seasonal employee shall not be eligible for holidays or
days off in lieu of holidays with pay.

(e) Holidays - Effective Date
For the purpose of computing and granting holidays
with pay, this section of this ordinance shall become
effective January 1, 1~70. This section shall repeal
Section 7, Rule Xl, of the civil Service Rules and
Regulations contained in Resolution Number 1348.
Section 3. Severability. If any section, subsection, sentence,
clause, phrase, or portion of this ordinance, or the application
thereof to any person, firm, corporation, or the application thereof
to any person, firm, corporation, or circumstance, is for any rea-
son held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The Council
of the City of Seal Beach hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause, phrase
or portion thereof, irrespective of the fact that anyone or more
sections, subsections, sentence, clause, phrase, or portion be
declared invalid or unconstitutional.
Section 4. The city Clerk shall certify to the passage and adoption
of this ordinance and shall cause the same to be posted as required
by law.
