HomeMy WebLinkAboutCC Ord 799 1970-01-05 I I I - . , " .< ORDINANCE NUMBER 7f/q AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, BY THE ADDITION OF PROVISIONS , REGULATING THE CONSTRUCTION OF SWIMMING POOLS, PROVIDING FOR PERMITS AND FEES. : The City Council of the City of Seal Beach does hereby ordain as follows: The Code of the by the addition swimming pools: City of Seal Beach, California, is hereby amended of the following relating to the construction of I Section 1. Permit Required. No person shall construct or cause to ~e constructed a swimming pool in the city of Seal Beach without first having obtained a permit. Section 2. Public Works Permit and Cash Bond. Prior to application and issuance of any building permit for the construction of a swimming pool, therelshall first be obtained from the Director of Public Works a permit to use the public street, sidewalk and curb for the temporary storage and deposit of con- struction material. I , Said permit shall be issued upon appli6ation, payment of Ten Dollars ($10) permit fee to cover costjand inspection, and the deposit of a cash bond in the sum of $150. Said cash bond shall guarantee that all construction materi~l shall be removed from public streets. All streets, sidewalk~, curbs and driveways (public and private) shall be left clean and free of any damage or debris as a result of any pool construction. In the event said streets, sidewalks, ~d curbs are not clean or have been damaged and not repaired wit~in thirty (30) days of com- pletion of pool, said cash bond shall be forfeited. Any reason for which the issuance of a permit could have been refused. I 2. Any material misrepresentation in the application for said permit. I 3. Failure to comply with the pr0visions of these codes, or other state or city regulation~. 4. Failure to correct a violation of the provisions of these codes after due notice of s~ch violation, provided that the time specified for corre~tion of such violation has expired. I I I I I ~ Ordinance Number , : No provisions of this code shall be coAstrued to relieve from or lessen the responsibility of any perso~ who owns, operates, main- tains, or installs any facilities contrary to the provisions of this Code for damages to persons or prbperty caused by any defect therein, nor shall approval or certifi~ate of inspection as herein provided, or by reason of the adoptionlof this ordinance. Permit fees not specifically provided for within any adopted ordinance may be specified by resoluti6n adopted by the City Council. The Building Official upon notificatioA from the permit holder or his agent shall make the following inspections of swimming pools, and shall either approve that portion 9f construction as completed, or shall notify the permit holder or his agent wherein the same fails to comply with the law. I The following inspections are required: 1. Steel, Main Drain and Bond InSpection: To be made after all reinforcing steel is inlplace, main drain roughed in and all water pipes are bonded. 2. Gas Line Inspection: To be mlde when gas line is I completed,up to the heater and pu~ped up to hold ten (10) pounds pressure for thirty (30) minutes. 3. Underground Electric: To be lade when underground conduit is in place and before s~e is covered. 4. pre-plaster Inspection: To Je made when all fences gates are installed. 5. Final Inspection: To be made when all work pertaining to pool is complete. Where pool decking or walk abuts a prop'erty line fence, provision shall be made to seal that portion of ihe fence to a height of I twelve inches (12") above the decking or walk so that no water shall drain through to adjoining property. I If re-inspections are required due to the fault or error on the part I of the installer or his employees, an additional fee of $5.00 may be required of the installer for each Such additional inspection. Additional fees shall be paid to the D~partment of Building and Safety before re-inspection will be made. Any person who shall commence any work for which a permit is required without first having obtained said permit therefore, shall, if subsequently permitted to obtain a p'ermit, pay the required per- mit fee for such work and ad additional penalty fee in an amount equal to the required permit fees, pro~ided that no penalty fee shall be less than Ten Dollars ($10), and provided that this provi- sion shall not apply to emergency work IWhen it shall be shown to the satisfaction of the Building Official that such work was urgently necessary and that it was not Ipracticable to obtain a permit therefor before the commencemenu of the work. In all cases a permit must be obtained within fortY1eight (48) working hours of the commencement of such work, and if uhere be an unreasonable delay I in obtaining such permit, the penalty flee as herein provided shall be imposed. I I I Ordinance Number . , . " .. . " Section 3. Effective Date. This ordinance shall take effect thirty (30) days from its adoption. The City Clerk shall certify to the passage of this ordinance and shall post same in accordance with law, Section 4. Severance. If any section, subsection, paragraph,: sentence, clause, or phrase of this ordinance is for any reason heid to be unconstitutional or invalid, such decision shall not affect the validity or constitu- tionality of the remaining portions of, this ordinance. The city council hereby declares that it would ~avejpassed this ordinance and each section, subsection, paragraph, sentence, clause, or phrase thereof irrespective of the fact that one or more of the sections, subsections, paragraphs, sentences, clauses or phrases thereof be declared unconstitutional or invalid.
