HomeMy WebLinkAboutCC Min 2000-05-16 I I I 5-16-00 Seal Beach, California May 16, 2000 The City Council of the City of Seal Beach met in regular adjourned session at 7:00 p.m. with Mayor Yost calling the meeting to order with the Salute to the Flag. ROLL CALL Present: Mayor Yost Councilmembers Boyd, Campbell, Doane, Snow Absent: None Also present: Mr. Till, City Manager Mr. Barrow, City Attorney Ms. Yeo, City Clerk APPROVAL OF AGENDA Boyd moved, second by Doane, to approve the order of the agenda as presented. AYES: NOES: Boyd, Campbell, Doane, Snow, Yost None Motion carried ANNOUNCEMENTS There were no announcements made. PUBLIC COMMENTS Mayor Yost declared Public Comments to be open. Mr. Reg Clewley, asked if the public would be given the opportunity to participate in the choosing of the mayor, can that be done at the time the item is considered, as he said is done in other cities, or under Public Comments, other cities allow comments to any item, the Planning Commission of this City allows the public to speak to items not listed on the agenda at the public comment period and then comments to the specific agendized item. Mr. Clewley claimed that the Public Works Department has received a number of complaints regarding dangerous sidewalks, one in the 700 block of Catalina, they marked the sidewalk with spray paint, said the sidewalk would be removed, but the problem continues to exist. Mr. Clewley said he was awaiting an answer to his question with regard to participation in the selection of mayor. There was an indication that a majority of the Council had no concern with public comments to the mayor selection. Ms. Marilyn Hastings, Old Town, requested that the City Attorney comment to that request. The City Attorney stated that under the Brown Act people are entitled to speak any time before an action is taken, some cities allow comments only at the beginning of the meeting, others at the public comment period, sometimes prior to deliberation, the Act merely requires that comments be allowed before a decision is reached. .MS. Sue Corbin, Seal Beach, offered that a new mayor and councilmember will be a fresh start. She said it is important that the City be kept informed about the lawsuits against the City, workers comp claims, apparently there is a settlement of a workers comp case but the City Council has not been informed, to. not. be informed is wrong. Ms. Corbin encouraged the Council to implement Constitutional training, at this meeting there will be a pledge of allegiance to the Constitution, yet there is apparently no idea of what it meanp or it is deliberately violated, freedom of speech and the right of assembly is part 5-16-00 of the Constitution, to not have Constitutional training sets one up for legal actions. To fail to advise the Council of legal actions is negligent, the expectation is that the Council will approve a settlement in closed session but settlement has already been made, staff has a duty to keep the Council informed and the Council has a duty to find out what is taking place, otherwise this puts the City in peril. There being no further comments, Mayor Yost declared Public Comments to be closed. I RETIRING COUNCIL RECOGNITION Members of the Council commended and thanked Councilman Snow for his services to the City, cited him as an honest, straight forward person of integrity. Mayor Yost read a brief note from a resident of College Park West commending Councilman Snow for the interest he paid to that area of the community. Mayor Yost presented Councilman Snow with a commemorative Seal Beach plaque in appreciation for his services. Councilman Snow stated that his time on the Council has been one of the most informative years of his working career, interesting experiences, and thanked the staff at City Hall and the police Department for their assistance, especially the Recreation and Parks Department for the landscaping beautification of the entry to College Park West subsequent to the repaving of two West streets. He commended the City for the installation of the sidewalk in the area of the North Seal Beach Community Center, something people have requested for a very long time. Councilman Snow mentioned his interest in a very important issue, that being the water situation, reports from the Metropolitan Water District and the Orange County Water District as to what is expected by years 2010 and 2020, last week he made a two day trip, sponsored by the Orange County Water District for a tour of a northern California dam and agricultural area, this date he received a letter from a commissioner of the regional council of Yolo County, inviting the north and south of California to work together on the water issues. Councilman Snow said he would like to see the Council continue their interest in water prOduction, as he too will do, the water reclamation in particular is interesting and important. He said he thinks too of the completion of important projects such as Bixby, the Marina Drive bridge, and the sewer problems. Councilman Snow expressed appreciation for the commemorative plaque. I OATHS OF OFFICE The City Attorney administered the Oath of Office to Joanne Yeo duly elected as City Clerk of the City of Seal Beach for the full term of four years. The City Clerk expressed appreciation to her son, Gary, for traveling to Seal Beach for this occasion. The City Clerk administered the Oath of Office to John Larson, duly elected as a member of the City Council representing Councilmanic District Two, and patricia Campbell, duly elected as a member of the City Council representing Councilmanic District Four, both for the full term of four years. I Mr. Larson and Mrs. Campbell assumed their seats as members of the City Council. Councilmember Campbell expressed appreciation to the voters of College Park East. 5-16-00 RESIGNATION - PLANNING COMMISSION - DISTRICT TWO Doane moved, second by Boyd, to accept the resignation of Mr. Larson as the District Two representative to the Planning Commission, and declared the position to be vacant. I AYES: NOES: Boyd, Campbell, Doane, Larson, Yost None Motion carried COUNCIL REORGANIZATION Mr. Reg Clewley, Seal Beach, expressed his objection to the selection of a freshman member of the Council as Mayor, and offered his personal evaluation of other members of the Council and their qualifications to hold the title of Mayor. Ms. Sue Corbin, Seal Beach, said she hoped the next Mayor will try harder, reach higher, and follow the Constitution, free speech and demonstration is a right, the Council does not have to like what is said, the City is improving but could be better, when power is abused the officials are corrupted and the City destroyed, a recent case relating to the 14th Amendment declares that there can not be two sets of rules and standards, the City needs to be conducted properly or it will not exist. SELECTION OF MAYOR Mayor Yost nominated Councilman Doane for the position of Mayor. Councilman Boyd nominated Councilmember Campbell for the position of Mayor. I Vote for selection of Councilman Doane: AYES: NOES: Doane, Yost Boyd, Campbell, Larson Motion failed Vote for selection of Councilmember Campbell: AYES: NOES: Boyd, Campbell, Doane, Larson, Yost None Motion carried Mrs. Campbell was declared Mayor of the City of Seal Beach for the year 2000/2001. SELECTION OF MAYOR PRO TEM Councilman Yost nominated Councilman Doane for the position of Mayor ProTem. Mayor Campbell nominated Councilman Boyd for the position of Mayor ProTem. Vote for selection of Councilman Doane: AYES: NOES: Doane, Yost Boyd, Campbell, Larson Motion failed I Vote for selection of Councilman Boyd: AYES: NOES: Boyd, Campbell, Doane, Larson Yost Motion carried Mr. Boyd was declared Mayor ProTem of the City of Seal Beach for the year 2000/2001. Mayor Campbell mentioned again her appreciation to the voters of College Park East, also thanked her husband and children 5-16-00 for their caring and support. Councilman Larson as well thanked his wife of many years for her support, and introduced long time friends present in the audience. Mayor Campbell presented Councilman Yost with a gavel plaque commemorating his service as Mayor since January, 1999. Councilman Yost expressed appreciation for the opportunity to serve as Mayor, one of the most educational of his experiences, his intent is to continue to be involved citywide, water quality of great importance, will continue with the public education/awareness programs relating to melanoma and the dangers of sun exposure, continue efforts to obtain the DWP property as open space for a park, and serve his district to the best of his ability. I COUNCIL COMMENTS Councilman Yost announced his 'Half Way There' town hall meeting on May 23rd at the Mary wilson Library Senior Center at 7:00 p.m., and on May 25th he will be speaking at the Historical Society meeting.regarding the DWP property, its past, present, and future, the status, political ramifications, etc., also at the Senior Center. Councilman Boyd announced a public information workshop on Thursday, May 18th at 7:00 p.m. relating to the proposed sewer rate adjustment. Councilman Yost inquired if that is an adjourned meeting, to that Mayor Campbell.responded that her understanding is that it will be Councilman Boyd and herself in that it was understood that he and Councilman Doane were not interested in a workshop, to that Councilman Yost said their interest was in moving the item along without incurring additional costs. The City Attorney advised that it may be well to adjourn then if three members of the Council attend there is no violation. The City Manager agreed to attend the workshop and reported that the Director of Public Works would not be available. Mayor Campbell requested a copy of the State Controllers Report for the City and .the Agency by the following.day, also, provided Councilman Boyd with a letter for signature, a letter of recommendation for the former Director of Administrative Service, to avoid further legal actions. I At the request of a member of the audience, Yost moved, second by Boyd, to amend the agenda to allow that person to make a comment. AYES: NOES: Boyd, Campbell, Doane, Larson, Yost None Motion carried PUBLIC COMMENT Mr. Frank Boychuck, Trailer park, mentioned having become involved in the City government since the purchase of the Park by the new owner, he has been impressed by the members of the Council, and defended against the personal attack on former Mayor Yost by declaring his honesty, integrity, a person who tries to help people. He noted that people address the Council with remarks relating to people being evil and conspiracies with nearly everything, he has personally not seen that, and in his opinion it would be better to have people go on record as to the good things that are happening, and the time and effort that good people spend to help this community of Seal Beach. Mr. Boychuck offered congratulations and best wishes to Mayor Campbell during her term as Mayor. Ms. Sue Corbin, Seal Beach, noted the envelope the Mayor passed on to Councilman Boyd and asked if the letter of reference was a requirement of the settlement. I 5-16-00 / 5-18-00 / 5-22-00 I Ms. Corbin was advised that the settlement is a public record and speaks for itself. Councilman Yost questioned if the settlement did not require that people refrain from comment other than the official comment from the City, the response was that that is the memory. Mayor Campbell thanked all in attendance, welcomed Mr. Larson, wished Mr. Snow good fishing, good luck to Dr. Yost and Mr. Doane, and best wishes to Mr. Boyd as Mayor ProTem. There being no further comments, Mayor Campbell declared Public Comments closed. ADJOURNMENT It was the order of the Chair, with consent of the Council, to adjourn the meeting until Thursday, May 18th, should three or more members of the Council attend, for a public workshop relating to the proposed sewer charge.
