WAS CALLED TO ORDER BY CHAIRMAN KNAPP AT 7:30
P.M. AND THE PLEDGE TO THE FLAG WAS LED BY
COMMISSIONER COOK.
Present: Lanning, Knapp, Ripperdan, Cook, Madsen
The ~inutes of December 15, 1976 were approved as presented.
1. Public Hearings
A.
James Quinn, V-17-76
c.
Applicant is requesting a Variance to permit a windscreen on
a balcony in the R-1 Zone at 100 Ocean Avenue. Public Hearing
Opened. The applicant submitted a letter to the Planning
Co~ission requesting that the ~atter be continued until
January 19, 1977. ~Jarren Schulten, 1500 Catalina, Seal Beach,
a member of the Architectural Review Committee for the Gold
Coast, spoke in opposition to the Variance. The Planning
Commission discussed viel'l blockage and blOl'ling sand in the area.

Applicant is requesting a Variance to permit a pool ,"ith less
than required rear yard setback in the R-l zone of 715 Catalina.
Public Hearing Opened. llor, t4cLoon, Aquapride Pools, 2540 v!est
Lincoln, Anaheim, stated that the pool was excavated without
building permits but that final measurements show the pool en-
croaches only 2 inches into the required 4' setback because the
rear fence is 8" in from the rear property 1 i r,e and the pool
water line is 3' 2" from the face of the block ':lall. Keith Jetty,
700 Carmel, asked if the pool fence would be raised to 6' in
height. Secretary stated that the fence would be raised to 6' as
required by City Ordinances. The Planning Commission discussed
various options available. Public Hearing Closed. Cook moved to
approve V-18-76 ,lith a maximum encroachment of 4" and the in-
stallation of a raised planter between the block wall and pool,
seconded by Ripperdan and unamiously approved. Res. 1041.

C. James Watson, CP-11-76
Applicant is requesting a Conditional Use Permit for a walk-up,
take-out, restaurant in the C-l Zone at 101 Main Street. Public
Hearing Opened. Applicant su~itted a letter requesting that
the matter be continued until January 19, 1977 so he could work
out certain problems with the Orange County Health Pepartment.
Joe Endres, 829 Ocean Avenue, stated that he had received no
Public Hearing Notice and that he opposed the restaurant based
on trash in the area. Cook asked about the building setbacks
and stated that he was of the opinion that the building did not
comply with the Planning CommiSsion approval of the origi.nal
Variance. Secretary stated that Staff would listen to the tape
and provide a full report to the Planning Commission on January
19, 1977. Public Hearing Closed. The matter was held over until
January 19, 1977.
D.
Adoption of a Comprehensive Sign Ordinance
Secretary presented a Staff Report indicating that the draft Sign
Ordinance was the result of over one year's work involving the
Planning Co~nission, City Council, Staff, Shopping Center owners,
Oil Companies, Businessmen and the sign industry. Public Hearing
Opened. Jerry Jackson, Sign Users Council, 311 Normandy Ave.,
Los Angeles, spoke in favor of the proposed Planned Sign Program
provisions as well as abatement of inoperative signs. He suggested
that a maintenance provision be added to the Ordinance. Sign Users
Council ~s in favor of larger signs, taller signs, rotating signs,
roof signs and flashing signs. Ken Denny, Western Oil and Gas,
spoke in favor of rotating signs, asked that the sign height be
increased and ~Ias concerned about the City revievling "other govern-
mental agency signs". Public Hearing Closed. Lanning noted that
the Planning Co~ission had been looking into a sign ordinance for
ten years and during that time the sign industry had always wanted
bigger signs and no restrictions, Cook
moved to approve and recommend to City Council adoption of the Sign
Ordinance, including a maintenance provision, and recinding all
provisions in conflice, seconded by Lanning and unamiously approved.

4. New Business
A. Request for a Determining on Proper Zoning for a Theatre
The owners of the Bay Theatre requested a determination
on the proper zoning for a walk-in theatre. The Planning'
Commission discussed the use and zone options. Madsen
moved to find the C-1 Zone as the proper zone for a walk-in
theatre, seconded by Lanning and approved by the following
vote:
Ayes: Lanning, Knapp, Cook, Madsen
Noes: None
Abstain: Ripperdan Minute Order.
Nr, Ripperdan abstained from discussion or voting because of
a slim possibility of a conflict of interest.
The Planning Commission discussed other possible dual uses for
the theatre with the owners.
5. Report from Secretary
A. Secretary reviewed remodeling plans for the building at 311 Main
Street with the Planning Co~ission.
B. Secretary reminded" the Planning Conunission about the upcoming
Planning C~nmission Institute,
6. The Meeting was adjourned at 9:35 p.m.
