THE MEETING WAS CALLED TO ORDER BY VI CE CHAI RNAN COOK AT 7:30 P.M. AND THE PLEDGE TO THE FLAG lIAS LED BY VICE CHAIRMAN COOK. Present: Lanning, Ripperdan, Cook Excused Absence: Knapp, Madsen The minutes of June 1, 1977 were approved as presented. The Secretary reviewed the method of receiving testimony at Public Hearings. 1. Public Hearings . t.. Ralph Hanson, V-11-77 (continued) Applicant is requesting a Variance to permit the addition of a living room, enlargement of a bathroom and bedroom on the second floor and enlargement of a living room and dining ro~ on the ground floor in a nonconforming duplex in the R-3 z~ne at 1621 Seal Way. Public Hearing Opened. Ralph Hanson, 1621 Seal Way, stated that the proposal eliminated the second bed- room in the upstairs unit, would provide a full bathroom on the second ,floor and would generally upgrade the building. No one else spoke on the matter. Public Hearing Closed. Ripper- dan moved to approve V-l1-77, seconded by Lanning and una:niously approved by members present. Res. 1067. 2. The Planning Commission received a letter of resignation from Pete Madsen to be effective after the July 20, 1977 Pla~ning Commi ss i on meeti ng. Lanni ng cOnJnended Pete' Madsen's work and contribution to the Planning Commission and expressed regret on his leaving. New Business By concensus, the Planning Commission amended the Agenda to hear Appeal Item B, A-2-77 before Appeal, A-1-77. B. City Council referral of Appeal, A-2-77, filed by Owen Kupfer. The matter of Appeal, A-2-77 was referred back to the Planning Commission by City Council for consideration of additional in- formation contained in a letter from the applicant's attorney. The Appeal was on the Planning Commission's denial of V-8-77 for a fence in the public right-of-way which exceeds maximum permitted height and does not comply with the vision clearance provisions at alley and street intersections. A. Owen Kupfer, 112 11th Street, stated that his attorney had oral comments on the City's Ordinances but was not present. The Planning Commission discussed the option of holding the matter over for two weeks. Cook moved to report back to City Council that all questions and points raised in the June 10, 1977 letter have been satisfactorily answered by Staff. There were in 1974, Ordinances regulating improvements in the public right-of-way and limiting fences in the front yard setback to forty-two inches in maximum height and requiring vision clear- ance at alley and street intersections. The Planning Commission affirms it's recommendations in Resolution 1059 and recommends to City Council that Appeal A-2-77 be denied. Motion was seconded by Ripperdan and unamiously approved by members present. Res. 1068. Ripperdan asked the applicant what problem there would be in relocating the fence at the required six foot setback. Owen Kupfer stated that he did not wish to lose a portion of his yard. City Council referral of Appeal, A-1-77 filed by Ronald Smith The matter of Appeal, A-1-77 was referred back to the Planning Commission by City Council for consideration of plans submitted by the applicant to relocate a gas heater from the Surfside leased land into the garage, The Appeal was on Planning Commission denial of V-4-77 for a pool equipment structure on the leased land, structural encroachments into a side yard and mechanical pool equipment closer than ten feet from a neighboring residence. Secretary noted that the applicant was not present at the meeting, even though he has been notified by mail of the Hearing before the Planning Commission. At the conclusion of the Staff Report, the Planning Commission discussed the matter. Ripperdan moved to re- c~end to City Council that the Appeal be denial on the basis that the proposal by the applicant to place the gas heater in the garage would eliminate one required parking space. In the opinion of the of the Planning Commission there is no hardship, based on size, shape, topography, location or circumstances, to warrent eliminating one required parking space. Motion was seconded by Cook and unamiously approved by members present. Res. 1069. . . . 5. Report from Secretary A. Determination of Uses in the S-P Parking Zone Staff requested the Planning Commission to make a determination regarding the placement of spas on the S-P Parking Zone. The Planning Commission discussed the various options and by con- , census determi ned to hold the matter over for two weeks and directed Staff to: 1. Contract Surfside Board of Directors for their input. 2. Look into the requirement for covers on the spas. 3. Provide the Planning Commission with a typical plot plan. 4. Provide language which insures that all "requi red parking" is maintained. 6. The meeting was adjourned at 8:15 p.m. tY~~ Recording Secretary
