THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH MET IN REGULAR SESSION ON
WEDNESDAY, OCTOBER 5, 1977 IN THE COUNCIL
CHAMBERS OF THE CITY ADMINISTRATION

PLEDGE TO THE FLAG WAS LED BY VICE CHAIR-
MAN COOK.

The Minutes of September 21, 1977 were approved as corrected.
Commissioner Cook moved to amend the Agenda to consider Item K
(CP-13-77) after Item B (CP-4-77), seconded by Lanning and unamiously
approved. Secretary pointed out a typographical error on Items D & E
of the Agenda.
1, Public Hearings
A.
David L. Young, CP-3-77
Applicant is requesting a Conditional Use Permit for on sale beer
and wine in conjunction with an existing deli at 321-D Seal Beach
Boulevard. Pt;blic Hearing Opened. David L. Young, 321-0 Seal
Beach Boulevard stated that he agrees with the Staff conditions.
No one else spoke. Public Hearing Closed. Cook moved to approve
CP-3-77 with Staff conditions, seconded by Ripperdan and unamiously

Lawrence A. Leombruno, CP-4-77
Applicant is requesting a Conditional Use Permit for on sale beer
and wine in conjunction with an Italian pizza parlot at 13932 Seal
Beach Boulevard, Public Hearing Opened. Lawrence Leombruno,
13932 Seal Beach Boulevard stated that he agrees with the Staff
conditions. No one else spoke. Public Hearing Closed. Ripperdan
moved to approve CP-4-77 with Staff conditions, seconded by

Applicant is requesting a Conditional Use Permit for on sale beer
and wine in conjunction with a restaurant at 311 Main Street.
Secretary stated that there was one written communication opposing
the CUP. Public Hearing Opened. Leonard Landrum, 3391 Cortese,
Los Alamitos, stated that he agrees with the Staff conditions. No
one else spoke. Public Hearing Closed. Lanning moved to approve
CP-13-77 with Staff conditions, seconded by Cook and unamiously

Secretary recommended that the Planning Commission consider Items
C,D,E,F,G,H,I and J together during a concurrent public hearing
since the items are similar and related and submitted by one
applicant. Planning Commission concurred.
C - J, Montecito Eight, CP-5-77, CP-6-77. CP-7-77, CP-8-77, CP-9-77,
CP-10-77, CP-11-77, CP-12-77. Tentative Tract Maps No. 10077,
10078, 10079, 10080, 10081, 10082, 10083 and 10084.
Applicant is requesting Conditional Use Permits for conversion of
apartments to condominiums on eight separate lots of record in the
R-3 zone in the Rossmoor Business Center, Each lot contains a
9 unit apartment bUilding(presently under construction). The
street addresses of the buildings are 12510, 12520, 12530, 12540,
12550, 12560, 12570, and 12580 Montecito Road. In addition to
the request for eight Conditional Use Permits, the applicant is
also requesting approval for eight Tentative Tract Maps: 10077,
10078, 10079, 10080, 10081, 10082, 10083, and 10084.

Secretary presented ,an extensive Staff Report on the proposal
including a summary of past actions on the property. Public
Hearings Opened on all eight Conditional Use Permits to be con-
sidered during concurrent Public Hearings. Alex Bellehumeur,
9461 Grindlay Street, Cypress, stated that due to recent changes
in the housing market, there is now a demand for condominiums
and therefore, the proposal for conversion to condominiums has
been submitted. The applicants have met with surrounding property
owners and residents and only eight of 270 persons contacted were
opposed to the proposal. In conjunction with the conversion,
approximately $303,000 will be spent to upgrade the 72 units and
add amenities.

Jeffrey Oderman of Rutan and Tucker, presented a letter to the
Planning Commission on the subject of parkland dedication and in
lieu fee payment. Mr, Oderman stated that, in their opinion,
there should be no additional parkland in lieu fee for the con-
version since the fee was previously paid. Secretary noted that
the City Attorney had rendered the opinion that,the City's Sub-
division Ordinance requires the payment of in lieu fees,
The Planning Commission discussed the parkland in lieu fee require-
ment and reached the conclusion that the subject tract maps should
be considered on their own merits and if the Ordinance requires in
lieu fees, such fees should be required. The question of previous
actions or previous in lieu fees on the property should be the
subject of separate discussions between the applicant and the City
Council or between the app 1 i cant I s Attorney and the City Attorney.
George Gearhart of Utility Piping Desigp, spoke about the advantages
of providing one master water heater and a master water meter for
each tract (building), He said the proposed 85 gallon water heater
will serve the need of 11 units according to HUD. If the master
meter-heater system is used, the buildings can be retrv fitted for
solar heating when solar heating becomes economical. The Planning
Commission discussed'the efficiency and reliability of master
systems.

Lester Eagle, 1240D Montecito Road, stated that he opposed the
apartment project but supported the proposed conversion. He
said all the residents of the Rossmoor Chateau favor the
conversion. Ed Barberry, of the Rossmoor Regency, stated that
he favored the conversion. In response to a questions, he
described the amenities in the Regency.
Covington suggested that the matter be continued to October 19th
to obtain additional information, Al Moline, who is not a resi-
dent of the area, spoke in favor of the project. He would like
to buy a condominium in this area, He noted that his'present
condominium has a successful central water heater/meter system,
Alex Bellehumeur requested that the Planning Commission act
tonight on the applications and not hold the matter over until
October 19th. He said that delays would be very costly due to
construction schedules and the time still necessary for City
Council actions on the project. Mr, Bellehumeur said that in
order to remove some of the Planning Commission's concerns, he
would agree to the payment of the in lieu fee and would use separate
water meters and heaters if the Planning Commission wished. Mr.
Bellehumeur also noted that the Subdivision Ordinance had a pro-
vision allowing partial credit for private recreational facilities.
This would be discussed with City Council. Public Hearing Closed.

Covington stated that he favored the condominiums but wanted a
two week continuance and the City Attorney present, Cook was
concerned about the proposal for one association rather than
eight associations. Knapp was of the opinion that all questions
has been answered and favoted requiring in lieu fees for parkland.
Lanning and Ripperdan agree with Knapp's position. Cook asked
Alex Bellehumeur for more information on the homeowners association.
Mr. Bellehumeur said that the Title Insurance and the Department
of Real Estate assured him that a single association may be used
for all eight tracts, and, if it was not possible, State Wide
would add more amenities and use eight associations.
Covington asked about the status of the lawsuit. Bernard Solomon
asked to address the Planning Commission. Mr. Solomon said that he
previously opposed the apartments but does favor the conversion. He
will drop the lawsuit if State Wide Development makes every reasonable
effort to convert the apartments to condominiums. In response to a
question, he said that if State Wide makes the attempt to convert
the apartments to condominiums but is unsuccessful, the lawsuit
will be dropped.
Cook moved to delay action on all the items until October 19th so
that a number of questions could be answered, seconded by Covington.

Chairman called a 5 minute recess at 10:00 p,m. Meeting reconvened at
10:05 p.m.
l. Public Hearing to Consider Increasing the Permitted Lot Coverage
in College Park East and College Park West to 45% and 5% for
Patio Covers in College Park East
Public Hearing Opened. The Planning Commission held some general
discussion on options, Public Hearing Closed. Matter continued
to October 19th in order to provi de resi dnets in the area an
opportunity to provide written information to the Planning
Commission,

M. Public Hearing on Fourth Year H.C.D.A."Projects, Priorities to be
Established and Forwarded to City Council
Public Hearing Opened. Frank McGill from Orange County E.M.A. said
that he would answer questions the Planning Commission might have.
Extensive discussion followed on the types of projects which might
be eligible, Public Hearing Closed. Ripperdan moved to recommend
to City Council the following priorities:
1. Three, Year Project for alley resurfacing and water line im-
provement with $175,000 requested each year, The City should
attempt to obtain funds from other sources to finish the alleys
in three years.
2. Three Year Project for purchase of the D.W.P. for a park with
$175,000 requested each year. The City should attempt to
obtain other funds so the land can be purchased in three years.
Seconded by Lanning and unamiously approved.

4, Unfinished Business
A. Discussion of Revised Fee Schedule for Subdivision In Lieu
Park Fees

The matter was continued from September 21, 1977. The Planning
Commission discussed the various options including establishing a
set land value fee and conducting an appraisal of the subject land.
By consensus the Planning Commission favored an appraisal.
Covington moved to recommend to City Council the use of an appraisal,
, seconded by Ripperdan and unamiously approved. Res, 1101
