' THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALI~ORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Ordinance 628 (Zoning) of the City!of Seal Beach is hereby amended by addition of the following sections. I Article 2. Definitions Sec. 203A. AdvertisinR Device. Any balloon; flag; pennant; propeller; oscillating, rotating, pulsating light; or other contrivance cept a sign used to attrsct attention for the purpose of ptomoting (either directly or indirectly), the sale of products of'any person. , I Sec. 203B. Advertisinlt Display. I Any device, contrivance, statue or strUcture other than a sign used as a display, regardless of size and shape, for the purposes of attracting attention or making anything known, the origin or place of sale of which is on the property with such advertising display. Open Space and Bulk. Notwithstanding ~he requirements of any district, the following performance and development standards shall apply to the establishment, maintenance and operation of automobil. service stations in the C-2 and C-3 Zones. I (A) Purpose and Intent I' ,< The Automobile Service Station Standards are established to allow the construction, operation and maintenance of service stations so as to be compatible with other permitted uses in the zone. It is recognized that service stations warrant special consideration because of several important elements of design and operation that are unique and significant such as: total dependence on vehicular traffic, distinctive physical appearance, unenclosed nature of activities, and long hours of operation. The standards are intended to liberalize some of the zone re~~irement8 that might otherwise create a hardship on service station operation, and to minimize any adverse effect on neighboring use by the application of standards for s~gns, landscaping, screening and the location and nature of operating activities. < " ,'. ~ (B) Uses Permitted , ' An automobile service station sha 1 be a retail place of business engaged in the sale of motor fuel and in supplying goods and services generally required in th operation and maintenance of automotive vehicles and fulfilli of motorist needs. These may include sale of petroleum products; sale and servicing of tires, batteries, automotive~accessoriesland replacement items; washing and lubrication services; the performance of minor automotive " " 'i " , r I , ' " .; I r '\ " i' I '," I: " I :, . Major automotive repairs, painting, body and fender work, and any other use permitted in the zone is prohibited. (C) Building Line Regulations Building setback line for all structures: 18 feet from the ultimate street right of way line, or as otherwise provided in subsection (G) of this Section, except canopy rOlfS over pump islands may be cantilevered to within five feet f the ultimate street right of way line. (D) Minimum Lot Area and FrontagT' I (1) The minimum lot area shall be 22,500 square feet. " " ,r.{ (2) The minimum lot frontage upon any street shall be 125 feet. (E) Exterior Displays and Trash and Storage " Displays of merchandise shall not be located further than five feet from the service station building. However, oil products necessary for daily direct service to automobiles may be stored on the pump island. This display, shall not be greater than six (6) feet in height. ,'" ~ :' .,. , . Storage of parts or trash shall be within a building or area enclosed by a wall and gate at le,st six (6) feet in height. . j , i 'I " (F) Signs Business signs are permitted in conformance with the regulations of the Seal Beach Sign Code and the provisions of the Zoning Ordinance subject to the fOllowin$ limitations: " " (1) The total area of all s~gns shall not exceed an aggregate of 200 square feet on the premises as follows: I .~ (a) One free-standing identification sign located no ,- closer than 50 feet from any parcel used or zoned,' , residential. " (b) For corner lots, two free standing price signs, not exceeding 20 square, feet each, may be located no closer than 100 feet from the point of intersection of the ultimate street rig~t of way lines of the abutting streets. " 5 (c) For interior lots, 'one free standing price sign not exceeding 20 square feet may be located within the middle one-third of the'frontage. '. I . ., ."; (d) Advertising signs not related to motor vehicles shall not exceed 75 square feet in total area, and shall be affixed to a building or permanently mounted sign structure. (b) The maximum height of the price sign structure shall not exceed 15 fe~t. (c) Within the front and exterior side setback, there shall be no sign below,seven (7) feet that would obstruct vision. (5) Advertising devices an4 advertising displays are prohibited outside the building except~ng dispiays of merchandise as provided unde~ paragraph (E) above. (G) Lighting All lighting shall be designed and located so as to confine direct rays to all premises. (H) Outside Activities Vebicle repairs and adjustments, 'wheel alignment, tune-ups, and all activities other than^sa1e of motor fuels and services inci- dental to such sale of motor fue~s, are prohibited outside the main building. (I) Screening " I,,: " , ", A masonry wall shall be installed and maintained along property lines where tbe premises abut areas zoned for residential uses. Said wall shall have a total height of not less than six nor more tban seven feet, except within 20 feet of any ultimate street right of way line, where tbe height shall not be less than three and not more than three and one-half fee~. Where there is a difference in elevation on opposite sides of the wall, the height shall be measured from the highest elevation. No signs or sign supports shall be permitted upon any screen wall. Notwithstanding tbe requirements :listed above, wbere tbe finisbed elevation of the property is lower, at the boundry line or within five feet inside the boundry line, than an abutting property elevation, such change in elevation may be used in!lieu of or in combination with a wall to satisfy the screening requirements for this zone. (J) Landscaping " Landscaping, consisting of evergreen trees, shrubs, vines, ground cover or any combination thereof,' shall be installed and maintained subject to the following standards: (1) A minimum of five (5) per cent of the site shall be landscaped. -, ......... , .. , (2) Boundry landscaping is required for a minimum depth of four feet along all property' lines abutting streets except 'for;tbe area"~equired"for"street 'openings: and ,the area,. within five feet on either side of street openings. ...' .. . (4) Intersections: Landscaping along all streets and boundaries shall be limited to a height of not more than 3 1/2 feet within 10 feet of the point of intersection of (a) A vehicular trafffcway or driveway and a street; I (b) A vehicular traff1cway or driveway and a sidewalk; and (c) Two or more vehicular trafficways, driveways or streets. I I (5) Watering: Permanent watering facilities shall be provided for all landscaped lareas (6) Maintenance: Required Ilandscaping shall be maintained I in a neat, clean and hea1th~ condition. This shall include proper pruning, mowing of lawns, weeding, removal of litter, I fertilizing, replacement of 'plants when necessary, and the regular watering of all p1~tings. i , , (K) Architectural Design . All service station buildings and facilities shall be architecturally designed for the conditions of e~ch specific site and neighborhood. Section 2. Severability. If any section, sub-section, clause, phrase or portion of this Ordinance or the application thereof to 'any person, firm, corporation, or circumstance is for any reason held to be invalid or unconstitutional by the decision of any' court of competent juriSdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.
