AN EMERGENCY ORDINANCE OF THE CITY OF SEAL BEACH,
CALIFORNIA, A CHARTER CITY, ESTABLISHING REGULA-
TraNS ON BOATING AND USE OF VESSELS IN CERTAIN
DESIGNATED AREAS OF ANAHEIM BAY HARBOR AND STAT-
ING THE FACTS CONSTITUTING THE URGENCY.

The City Council of the City of Seal Beach, California, a charter
city, does ordain as follows:
Section 1. Designation of Special-Use Area
Anaheim Bay Harbor.
(a) Description:
The area shown on Exhibit A and consisting of the waters of the
inner and outer harbors of the U. S. Naval Weapons Station, Seal
Beach, California, and the contiguous tidal channel and basin as far
east as Pacific Coast Highway - 101 Bridge is declared to be danger
and controlled zones and is hereby designated as a special-use area
subject to military operations within said area and subject to
special regulations herein contained.
(b) Regulations:
(1) All vessels and boats entering or passing through the
aforesaid special-use area shall be regularly documented vessels or
boats having a Certificate of Number assigned by the State of
California, Department of Harbors and Watercraft; they shall also
have a permit to use the waters from the Commanding Officer, U. S.
Naval Weapons Station, Seal Beach, Ca1iformia.
(2) All boat operators shall heed and obey all posted
signs and/or instructions.
(3) All traffic shall be confined to the established
route as shown on Exhibit A, and except, for emergencies, boats may
not stray from nor be anchored outside of this designated area.
(4) Maximum speed for all boats and vessels in the
inner harbor shall be five (5) miles per hour.
(5) Maximum speed for the outer harbor shall be
eight (8) miles per hour.

(7) Sailing vessels shall use auxiliary power in the
inner harbor area.
(8) Rowboats, canoes, kayaksl, surfboards, water skis,
etc. are specifically prohibited within the aforesaid special-use
area.

(9) Smoking in boats or vessels is prohibited.
(10) Fishing by civilian boats is prohibited.
(11) Radio, radar, or other electronic transmissions
are prohibited.
Section 2. Severability. If any section, subsection, sentence,
clause, phrase, or portion of this ordinance, or the application
thereof to any person, firm, corporation, or circumstance, is for any
reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The Council
of the City of Seal Beach hereby declares that it would have adQPted
this ordinance and each section, subsection, sentence, clause, phrase,
or portion thereof irrespective of the fact that anyone or more
section, sub-section, sentence, clause" phrase, or portion be declared
invalid or unconstitutional.
Section 3. Effective Date. This ordinance shall take effect
and be in force immediately upon its adbption as an emergency

ordinance and facts constituting its urgency are as follows: It is
necessary that this ordinance be effective immediately to preserve
the public health, safety, and general welfare in that the Anaheim
Bay Harbor is used by the U. S. Naval W~apons Station, Seal Beach,
California, for military operations. The opening of certain boat
launching facilities at Sunset Aquatic Regional Park to the public
will increase the boat traffic in this area which requires special
regulation.
Section 4. Posting. The City Clerk shall certify to the passage
and adoption of this ordinance and shall cause the same to be posted
as required by law.

the City Council of the City of Seal Beach at a meeting thereof held
on the 5th day of August, 1968, by the 'following vote:
