HomeMy WebLinkAboutPC Min 1978-05-17 . \.. . \ . \ MINUTES OF THE PLANNING COMMISSION MEETING OF MAY 17, 1978 THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH MET IN REGULAR 'SESSION ON WEDNESDAY, MAY 17, 1978, IN THE COUNCIL CHAMBERS OF THE CITY ADMINISTRATION BUILDING. THE r~EETING ~JAS CALLED TO ORDER BY CHAIR~'AN KNAPP AT 7:30 PM AND THE PLEDGE TO THE FLAG WAS LED BY VICE- CHAIRMAN COOK. Present: Knapp, Ripperdan, Cook, Covington Excused Absence: Lanning The minutes of the May 3, 1978 meeting were approved as presented. Chairman Knapp announced that Bob Neprud, Planning Director for the City of Seal Beach and Secretary to the Planning Commission would be leaving his post and commended Hr. Neprud for his outstanding work, professionalism and support to the Planning Commission. Commissioners Cook, Covington and Ripperdan each gave a short dissertation commending Mr. Neprud for his past work with the City. Chairman Knapp read a letter from the City Manager, Dennis Courtemarche, also commending Mr. Neprud and his support for success in the future. Mr. Neprud thanked all Commissioners and introduced Hr. Charles Antos as the acting Planning Director and Secretary to the Planning Commission. Chai rman Cook moved to have a forma I reso 1 uti on commendi ng Mr. Neprud. Seconded by Ripperdan and unanimously approved. MINUTE ORDER 1. Discussion of conversion of apartments to condominiums. This would include possible recommendation to City Council for a moratorium. Secretary presented a staff report on the options the Planning Commission would have regarding a moratorium. Discussion followed. Chairman Knapp said he would request a study session on the ratio of small unit conversions to condominiums and its effect on densities. Cook was of the opinion that a study session with public input would allow a broader view of long term' effects on the community if continued conversions were allowed. Covington was in agreement with Knapp and Cook and stated that he was concerned with the request of Solis Jackson of the Seal Beach School District regarding the planning of future student loads within the City. Ripperdan stated his concern of the impact of providing housing for all economic segments of the community. Mrs. Fox, 8D1 Ocean Avenue, Seal Beach, asked what effects the moratorium would have on the 50 day time element on approving Tract Maps as adopted by the Tract Map Act of 1976. Ripperdan moved to continue the applications until such time as the Planning Commission has received additional information on community input as to the impact of conversions. Seconded by Covington. Motion failed due to lack of understanding as to the motion. :. \ ' . i.. - '. \ Mrs. Oliver, 300 Ocean Avenue, Seal Beach, asked if other conversion requests have been made other than those on ,the agenda. Secretary stated that no new applications have been filed at this time. Mrs. Fox, 801 Ocean Avenue, Seal Beach, asked the Planning Commission about the Rossmoor Conversion as compared to their request and requested what additional information was needed fpr the Planning Commission to approve a 6 unit conversion as compared ,to a 260 unit conversion. Knapp reiterated his concern for density'and community impact. Knapp recommended that a study session should include what percentage of apartments, condominiums and new single family residences the City needs. Covington implied that the Planning Commission was a fact finding body to provide planning process by public input and that City Council guidelines should be provided to the Commission for such a study session. 2. Motion by Cook to recommend to City Council that they impose a 60 day moratorium on the processing of all Tentative Tract Maps for multiple family development including conversions of existing multi-family units to condominiums as well as any nel~ construction. Seconded by Covington and unanimously approved by members present. AYES: Knapp, Cook, Ripperdan, Covington Noes: None ABSENT: Lanning RES .1137 PUBLIC HEARINGS A. Gary N. Curtis, V-4-78 Applicant is requesting a Variance to permit construction of a commercial building at 324 Main Street with tandem parking and less than required loading zone. Public Hearing Opened. Applicant has submitted a letter requesting withdrawal of the Variance due to unsolved legal matters on the property. Public Hearing Closed. By consensus, the Chairman accepted the withdrawal. MINUTE ORDER The Planning Commission discussed the advisability of taking items C & D out of context. The Commission determined to follow the Agenda in order. B. Henry Grumet, Moe Fox, Steve Costantino, CP-5-78 Applicants are requesting a Conditional Use Permit to allow conversion of two (2) existing triplexes at 801 and 805 Ocean Avenue into a six unit condominium complex (Tentative Tract Map 10415). Public Hearing Opened. The Planning Commission discussed the advisability of acting on this application in light of their recommending to City Council concern for a moratorium. Public Hearing Closed. Cook moved that with the concurrence of the applicants, further processing of the application be held.wit~out prejudice until the ear~ier of; the.first meeting succeeding the explratlon of the requested moratorlum or the flrst meeting succeeding denial by,Council of the requested moratorium. Motion seconded by Covington. Discussion followed on the intent of the motion and clarification was provided. Any parkland dedication fees charged on this subdivision would be based on the fee schedule in effect at the time of the original application. The applicants agreed to the requested continuance and will provide the City with a letter so stating their concurrence. James Watson, CP~6-78 Applicant is requesting a Conditional Use Permit to allow conversion of an existing duplex at 228 5th Street into a two unit condominium (Tentative Tract Map 10421). Public Hearing Opened: Applicant submitted a letter requesting the matter be continued until June 7th since he is out of the State. Public Hearing Closed. Chairman ordered the matter continued until June 7th. MINUTE ORDER D. James ,Watson, CP-7-78 Applicant is requesting a Conditional Use Permit to allow construction of a unit on property containing one unit and conversion to a blo unit condominium at 310 16th Street (Tentative Tract Map 10422). Public Hearing Opened. Applicant submitted a letter requesting the matter be continued until June 7th since he is out of the State. Public Hearing Closed. Chairman ordered the matter continued until June 7th. MINUTE ORDER E. ' Ba rney Hovle 11, Cp-g- 78 Applicant is requesting a Conditional Use Permit to allow construction of two storage rooms in a nonconforming nine-plex at 313-3J5 8th Street. Public Hearing Opened. Barney Howell, 1120 Stanley Avenue, Long Beach, explained his request. The reason for the request is to prevent further water damage to two ground level apartments and to provide plant storage rooms for two second story apartments. The Planning Commission discussed the application and other possible methods to control water damage. In response to a question, Mr. Howell stated that the two garages on site are being used for storage but will be cleaned out. Public Hearing Closed. Cook moved to approve CP-9-78 subject to a land use agreement stipulating that the storage rooms not be used for habitable purposes and that the garages be cleaned out. Seconded by Knapp and unanimously approved 'by members present. RES. 1138 3. Oral Communications. There were no oral communications. 4. Written Communications All written communications were with specific agenda items. .~ 5. New Business ( A. Phillip and Linda Oliver, Tentative Tract'Map'10428 Applicant is requesting approval of Tentative ,Tract Map 10428 for construction of a three unit condominium at 125 10th Street. Secretary noted that due to a communications error the applicant submitted a Conditional Use Permit application which is not requried for new condominiums. The Planning Commission discussed the application. Cook asked about amenities in the project. Phillip Oliver, 300 Ocean' Avenue noted that in such a small project only sun decks and a courtyard are provided. Linda Oliver, 300 Ocean Avenue noted that no other requests for new construction condominiums are before the Commission and probably no other condominium applications of any type will come to the City due to the new subdivision fees. The Commission discussed the advisability of continuing the matter in light of the moratorium request before City Council. Cook moved that with the concurrence of the applicants, further processing of the application be held without prejudice until the earlier of; the first meeting succeeding the expiration of the requested moratorium or the first meeting succeeding denial by Council of the requested moratorium. Motion seconded by Covington. The applicants agreed to the requested continuance and will provide the City with a letter so stating their concurrence. Secretary reported that the City Council will consider the Issue Identification on May 22, 197R, Staff will prepare the Work Program and provide a copy'to the Planning Commission. MINUTE ORDER 2. Staff has provided the Commission with a copy of both the Iterim Guidelines of the Coastal Commission and the proposed guidelines of the Coastal Commission. 3. Knapp moved to recommend to City Council the imposition of a moratorium on multiple unit construction until a study can be completed on the City desired ratio of apartments to other residential types and the effect of apartments on other housing types.
