Bret Nelson, 1621 Seal Hay, spoke in opposition to the zone change stating that his new nursery business is the reason for the Council's request for a zone change. If "Growing Hy Way Nursery goes out of business. I plan to enlarge my nursery and the zone change ,I~oul d prevent this expansion_I> Terry KYle, 624 Beachcomber, spoke in opposition to the proposed zone change stating that this would be a step toward eliminating local businesses in favor of large chains. . Dom Bebec, 114 Ocean Avenue, spoke in opposition to the zone change stating that nothing had changed since the City adopted the General Plan to warrant, such a change. Except for the nursery, there have been no changes in tha~ block for years. He also said the City's action in proposing a change in the zone may be illegal since he did not receive a notice of public hearing and his business was not described in the report. Secretary stated that the notice of public hearing contained the legal description of each lot in the subject block and 1'12S properly mailed to all property o',~ners within .300 feet of the block. tt Covington noted that one major change that has taken place sinc.e 1973 is traffic generation and a large increase in land price~ which places an ever increasing demand on vacant land for potential development. Debbie Vanden~ay, Ocean Avenue Hair Studio, spoke in opposition to the :7.On<: change. stating she relies on the commercial vacant parking lot. {or parkin~! through verbal agreements. The Commission is looking at the maximum impact potentjals on the ,area by retaining the existing zoning as opposed to the eventual impacts of a 7.orr~ change. Knapp stated that the zone change is a logical step if the existing: business can remain. The Commission 11as not in favor of removing th~ existing businesses but to ultimately provide the zoning to achieve a compatible neighborhood. Secretary stated that l'lhile those provisions are currently contained in the zoning ordinance. all existing land uses would retain their right to exist until destroyed by an act of God, by accident, or by choice of owner. Only expansions and new com",ercial develop~ent would be denied under a zone change. After discussion, Knapp moved to hold the matter over in an effort to obtain more information on the possible effects of this proposal. and to determine if the proposed zone change would receive full council support. Res. .1203 5. NEW BUSINESS None. 6. REPORT FROM SECRETARY A. Secretary reported' that the EQCB held a public hearing cm fcbruary 14. 1980 on the DWP EIR. The draft EIR was declared as final with amen(omcnts.
