I I I THE CITY COUNCIL OF THE ,CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, DOES ORDAIN AS FOLLOWS: Section 1. Ordinance Number 505 relating to Civil Defense and Disaster is hereby repealed in its entirety. Section 2. Ordinance Ncunber 538 relating to Civil Defense and Disaster is hereby repealed in, its, entirety. Section 3. Chapter 6 of. the Seal Beach City Code shall. read as follows: . c\.... ~ ", Sec. 6-1. Definitions of words and terms used in this chapter. 1. Civil Defense shall include measures for mobilization, organization and direction of. local and city govern- mental organizations, civilian population and necessary support,' agencies to' pre,vent',. or minimize, -', the effect of disasters caused by fire, flood, earth- quake, tidal wave or any subversive activities against th~ populace, community, industrial plants, facilities and other installations. Civil Defense shall also include the term "emergency preparedness", the organization and preparation for carrying out of emergency'planning and disaster operations by govern- ment, business and\the community in "general, but shall not include ~r apply to functions for which military forces are primarily responsible. 2. Disaster shall include, but is not limited to actual or threatened enemy attack, sabotage, extraordinary fire; flood, storm, epidemic, riot, earthquake, explosion, tidal wave or other similar public calamity. 3. Director of Civil Defense and Disaster shall mean the City Manager or his appointed agent. 4. Deputy Director of Civil Defense and Disaster shall, mean the Department Head or other person appointed by the Director of Civil Defense and. Disaster to be the head of various services, functions or sections 'of the City's Civil Defense program. Sec. 6-2. Civil Defense and Disaster Council-Membership. The Seal Beach Civil Defense and Disaster Counci~ is hereby created and its membership shall consist of the following: 1. The Mayor of the City of Seal Beach, who shall be Chairman. 2. The Mayor Pro Tempore of the,_,Cit;y ; o L,S e'al Beach . 3. The City Manager, who shall be Vice-Chairman. 4. The Deputy Directors of Civil Defense and Disaster. Ordinance Number I Sec. 6-3. Civil Defense and Disaster Council-Powers and Duties. It shall be the duty and power of the Seal Beach Civil Defense and Disaster Council to review and recommend to the City Council, civil defense and disaster plans, mutual aid plans, agreements, ordinances, rules and regu1:ations",as may be necessary to provide and to implement a civil defense and disaster program. The Seal Beach Civil Defense and Disaster Council shall meet upon call of the Chairman or in his absence or inability to call such meeting, upon the call of the Vice-Chairman. Sec. 6~4. Director of Civil Defense and Disaster-Powers and Duties. There is hereby created the position of Director of Civil Defense and Disaster which position shall be filled by the City Manager. The Director is hereby empowered 1. To request the City Council to proclaim the existence , or threatened exis~~~ce of a disaster if the Council is in session. 2. To issue a proclamation "of the, existence or threatened existence of a disaster if the,Counci1, is not in session; provided that the Council shall be notified immediately of such proclamation by the Director and such proclamation by the Director maybe nullified by the Council at its next regular, special or adjourned meeting. 3. To request the Governor of the State'of California to proclaim a state of disaster or extreme' emergency when the resources of the City or community are, 'in ,the opinion of the Director, inadequate to cope with the disaster or extreme emergency. 4. To control and direct the efforts and organization of the City to accomplish the purposes of this Chapter under policy established by the City Council. ';5. To cause to be prepared and maintained a disaster and emergency preparedness plan for the City which shall be effective upon approval of the City ,Council by resolution. 6. To have the power in the event of a proclamation of a disaster or state of extreme emergency by the Governor or the State Director of Civil Defense, within limitations provided by the City Charter, ordinances and laws applicable to the City to make and issue rules and regulations on matters related to the protection of life and property as affected by such disaster, such rules arid regu1ation~ to be'va1:id,unless the City Council at its next regular, adjourned or special meeting shall amend, modify or nullify them. The Director shall also be empowered to obtain vital supplies and equipment for protection of life and property at fair market value, to require emergency services of any City employee or officer or citizen volunteers (All persons rendering official emergency services shall be entit1~d to all privileges, benefits and immunities as are provid~d by state law for I I -2- Ordinance Number " I registered civil defense and disaster workers.), to requisition necessary personnel or material from any City Department or agency, to exercise all his ordinary powers as City Manager and all special powers conferred upon him by this Chapter or by resolution adopted pursuant thereto, and to have all powers conferred upon him by any statute, agreement approved by the City Coun~i1 or by any other lawful authority. Sec. 6-5. Basic Plan for Civil Defense and Disaster and Emergency freparedness shall provide for 1. Full utilization of all City resources and shall be consistent with the State of California and National Civil Defense Plans. 2. The assignment of emergency duties and functions for all City agencies and employees. 3. Amendments to the adopted basic plan to be placed on file by the Director with the City Council and for such amendments to become effective thirty (30) days thereafter unless disapproved or;amended by the City Council. 4. Each Deputy Director to formulate operational plans for his service or function, which when approved by the Director, shall become an annex ,to the Basic Plan. Sec. 6-6. Disaster Organization ' 1. All officers and employees of the City of Seal Beach shall be a part of tne Seal Beach Disaster Organization. 2. All members of the Police 'Reserve Corps'of the City of Seal Beach shall be members of the Seal Beach Disaster Organization. . , 3. All members of the Seal Beach Volunteer Fire Department shall be members of the Seal Beach Disaster Organization. 4. All volunteer forces enrolled to aid during a disaster along with such groups, organizations and persons, who by agreement or operation of laws, be charged with duties incident to the protection of life and property in the City during a disaster, shall be members of the Seal Beach Disaster Organization. 5. The Director shall prescribe those positions within the Disaster Organization for which lines of succession are necessary and shall keep a current list of at least three persons as 'successors to each such position. 6. The Director shall arrange for the participation ,of the American Red Cross in civil defense as a part of the mass care service in case of war- caused disaster, and for the relationship between the Red Cross and the civil defense organization in case of natural disaster. If 'any sect~on, subsection, sentence, clause, phrase, or portion of the ordinance, or the application thereof to any person, 'firm, corporation or circum- stance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect, the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this ordinance and each section, subsectlon, sentence, clause, phrase, or portion thereof irrespective of- the fact that anyone or more section, subsection, sentence, clause, phrase, or portion be declared invalid or un- constitutional. Section 5. The City adoption of this ordinance Clerk shall/veri-fy to the passage and ,/ and sha~ cause the same to be posted.
