I RESOLUTION NO. d?6~$" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, EST.L\BLISHING EXPRESS F!NDINGS FOR ADOPTING MODIfICATIONS TO THE BUILDING REGULATIONS OF TilE CITY OF SEAL BEACH. IIHE REAS , Health and Safety Code Section 17958.5 provides for the City to make changes or modifications in the Uniform Building Regulations as are reasonably necessary because of local conditions; and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modifications in the Uniform Building Regulations before adopting such changes; NOH, THEREFORE, BE IT RESOLVED that the modifications recommended ~y the Building Official of the City of Seal Beach are hereby found to be necessary on the basis of local conditions as follows: I Section 5-30 lb), amends Unifo~ Building Code, 1976 Edition, Section 1306(b) for the purpose of maintaining minimum yard dimensions for fire protection for small lot sizes within the City confines. Section 5-31, amends Uniform Building Code, 1976 Edition, Section 1501, Division 2, for the purpose of having all fences \~ithin the City uniformly constructed and consistent with Planning Departrn,ent regulations. Section 5-32, amends Uniform Building Code, 1976 Edition, Section 1601(fj for the purpose of clarification of fire zones, Section 5-33, (a), (b), (c), adds to the Uniform Building Code, 1976 Edition, Section 450H, allows for unique local design of eave and marquee projections beyond property lines, for the purpose of retaining old town character. I Section 5-34, a~ends Uniform Building Code, 1976 Edition, Section 4409, for the purpose of establishing Guidelines for all demolition work and proper' maintenance of debris and dust control. Section 5-35, adds to the Uniform Building Code, 1976 Edition, Chapter 55, which uniformly controls the construction and consistent design of all fences within the City. Section 5-36, adds to the Uniform Building Code, 1976 Edition, Chapter 56, which provides for minimum standards of construction for security and resisting unlawful entry into all buildings within the City. Section 5-37, amends Uniform Plumbing Code, 1976 Edition, for all piping placed in soils within t~e City, due to local corrosive soils conditions. Section 5-39, amends Uniform Swimming Pool Code, 1976 Edition, Section 208, for the purpose of protection of street erosion while discharging pool waste water. Section 5-4D and 5-41, a~ends ,Uniform ,S".'i~ming Pool Code, 1!J76 Edition, by adding Chapter 5, for the purpose of allowing for unique local design conditions oennitting the construction of swimminQ pools in the City where expansive soils conditions exist. ... Resolution NumBer Section 5-42, specific area is a planned adult community for the aged, amends strict interpretation of the Uniform Building Code, 1976 Edition, for requirements of patio covers, exit facilities, light and ventilatfon, repair provisions to non-conforming existing dwelling units, for the purpose of permitting the existing community to maintain its integrity and life styles, within the original design concept without hazardous conditions occuring from implementations of these amendments. BE IT FURTHER RESOLVED that a copy of this Resolution, which rescinds Resolution No. 2643, together with Ordinance ~o. 994 adopting the Uniform Building Codes and the National Electric Code as amended, be filed with the State Department of Housing and Community DevelolJ!1ent in complaince with State Law.
