HomeMy WebLinkAboutCC Res 2658 1977-04-11 RESOLUTION NO. d?6S" r 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, APPROVING LANDSCAPING IMPROVEMENTS INCLUDING LOW DECORATIVE FENCES IN A PORTION OF THE PUBLIC RIGHT-OF-WAY. IvHEREAS, in May of 1975 the City Council of the City of Seal Beach approved a Covenant for landscaping encroachments into a portion of the public right-of-way at 801, 805, 809 Ocean Avenue (Parcel t1ap 68-7, parcel s 1, 2 and 3); and the language contained in the Covenant did not specifically address the issue of construction of low decorative fences; and ' WHEREAS, I WHEREAS, the property owners would like to construct low decorative fences in a portion of the publiC right-of-way; and WHEREAS, the property owners at 801 Ocean Avenue would like to cuild a low decorative fence and landscape a portion of the public right-of-way on 8th Street; and WHEREAS, the City Council finds that because of the location of the above described parcels there are reasons which would warrant the construction of low decorative fences and landscaping in the public right-of-way; including the width of the public right-of-way, the heavy pedestrian traffic on the sidewalk and blowing sand from the beach. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach, California does hereby: 1. Determine that a low decorative fence may be installed as part of the landscaping under the provisions of the Covenants affecting these three parcels. 2. Determine that a new Covenant should be executed between the owners of the property at 801 Ocean Avenue and the City for encroachments into the 8th Street right-of-way and authorizes the Mayor to sign said Covenant on behalf of the City. 3. Determine that landscaping plans for these properties should be reviewed and approved by the City Staff. 4. Determine that a certificate of insurance be on file with the City and a 30 day notice be provided to the City upon cancellation of said insurance. 5,. Determi ne that the Ci ty may resci nd approval for the use of the public right-of-way at any time upon 60 day notification to the property owner. 6. Concur with the Planning Commission's findings in Resolution No. 1052 and the report from the Planning Director dated March 23, 1977 that these properties are located in a unique location and that there are special circumstances which warrant construction of low decorative fences in a portion of the public right-of-way. .1 ~ ' I I I Resolution Number PASSED, APPROVED and ADOPTED by the City Council of the City of Seal Beach, alifornia, at a meeting thereof held on the I/!t day of . , 1977, by the following vote: AYES: Councilmen 4(Z{O~i1A<j hd:f,7fd"L(~. ;;L NOES, C.",,,11,,,. ~ .
