RESOLUTION NO. .:?7 () S-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA, 'ESTABLISHING A RELOCATION
APPEALS BOARD PURSUANT TO HEALTH AND SAFETY CODE
SECTION 33417.5.
WHEREAS, as provided in California Health and Safety Code Section 33417.5,
there is in each City having a Redevelopment Agency, a Relocation
Appeals Board composed of five members; and
WHEREAS, the members of said board are to be appointed by the Mayor and
approved by the City Council;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION ONE: The Relocation Appeals Board shall carry out its duties and
activities pursuant to the By-Laws attached to this Resolution
as Exhibit A and made a part hereof. Said By-Laws shall be
adopted at the first meeting of said Relocation Appeals
Board and shall not thereafter be amended without the prior
approval of the City Council.
SECTION TWO: The City Clerk shall certify to the passage of this Resolution.

BY-LAWS
ARTICLE I.
SECTION 100. THE BOARD
Section 101. Name of the Board
The name of the Board shall be "Seal Beach Relocation Appeals
Board" .
Section 102. Board Members
The Ci~ Council of the City of Seal Beach has by Resolution
No. ~~~ declared that a Relocation Appeals Board be created.
The Members of the Board shall be resident electors of the City
of Seal Beach and shall be appointed by the Mayor.
ARTICLE II.
SECTION 200. OFFICERS OF THE BOARD

Section 203. Duties of Officers
The Chairman shall preside at the Board meetings and perform
such other duties as are appropriate.
The Vice Chairman, in the absence or incapacity of the Chairman,
shall perform the duties of the Chairman. Should the office of
the Chairman become vacant, the Vice Chairman shall perform the
duties of the Chairman until the,Board members elect a new
Chairman.
The Secretary shall keep and maintain records of the Board and
'minutes of the Board meetings. The Secretary shall give
written notice of Board meetings whenever such notices are
required by these by-laws or by the law. The Secretary shall
also perform all other duties incident to the office of
Secretary.
Section 204. Compensation of Officers
The members of the board shall serve without compensation, but
each of the members shall be reimbursed for his necessary
expenses incurred in performance of his duties, as determined
by the City Council.

SECTION 300. EMPLOYEES AND AGENTS
Section 301. Appointment of Employees and Agents
Subject to the prior approval of the City Council, the members
of the Board may from time to time establish such positions
and select and appoint such counsels and agents, permanent and
temporary, as it may require and determine their qualifications,
duties, and compensation.

Section 4.03 ~pecial Meetings
A special meeting may be called at any time by the Chairman or
upon the written request of two of the members of the Board by
delivering, personally or by mail, written notice to each member
and to each local newspaper of general circulation, radio or
television station requesting notice in writing. Such notice
must be delivered personally or by mail at least 24 hours before
the time of such meeting as specified in the notice. The call
and notice shall specify the time and place of the special
meeting and the business to be transacted. No other business
shall be considered at such meetings by the Relocation Appeals
Board. Such written notice may be dispensed with as to any
member who at or prior to the time the meeting convenes files
with the Secretary of the Board a written waiver of notice. Such
waiver may be given by telegram. Such written notice may also
be dispensed with as to any member who is actually present at
the time it convenes.
Section 404. Executive Sessions
Nothing contained in these by-laws shall be construed to prevent

regular or special meeting concerning any matter permitted by
law to be considered in an executive session.
Section 405. Public Hearings
All public hearings by the Board members required or permitted
to be held by law shall be held during a regular or special
meeting of the Board members. The Board shall after a public
hearing, transmit its findings and recommendations to the
Redevelopment Agency of the City of Seal Beach.
Section 406. Adjourning Meetings and Continuing Public
Hearings to Other Times or Places
The Board members may adjourn any meeting to a time and place
specified in the order of adjournment. Less than a quorum may
so adjourn from time to time. If all members are absent from
any regular meeting or adjourned regular meeting the Secretary,
or Acting Secretary of the Board, may declare the meeting
adjourned to a stated time and place and shall cause a written
notice of the adjournment to be given in the same'manner as pro-
vided for special meetings. A copy of the order or notice of
adjournment shall be conspicuously posted on or near the door
of the place where the meeting was held within 24 hours after
the time of adjournment. When a regular or adjourned regular
meeting is adjourned as provided in this section, the resulting
adjourned regular meeting is a regular meeting for all purposes.
When an order of adjournment of any meeting fails to state the
hour at which the adjourned meeting is to be held, it shall be
held at the hour specified for regular meetings.
Any public hearing being held; or noticed or ordered to be held
at any meeting may by order or notice of continuance be continued
or recontinued to any subsequent meeting in the same manner and
to the same extent set forth for the adjournment of meetings;
provided, that if the hearing is continued to a time less than
24 hours after the time specified in the order or notice of
hearing, a copy of the order or notice of continuance of hearing
shall be posted immediately following the meeting at which the
order or declaration of continuance was adopted or made.
Section 407. Meetings to be Open and Public
All meetings of three or more Board members to take action or

be open and public. All persons shall be permitted to attend
any such meetings except as otherwise provided by law.
Section 408. Quorum
Three members of the Board shall constitute a quorum for the

for all other purposes. A smaller number of Board members may
adjourn a meeting from time to time until a quorum is present.
Section 509. Order of Business
The following shall be the general order of business at Board
meetings:
(1) Roll Call
(2) Approval of Minutes
(3) Relocation Appeals
(4) General
(5) Adjournment
At any meeting, the Board members, by a vote of three of the
members, may change the order of business.
ARTICLE V.
SECTION 500.
'AMENDMENT OF THE BY-LAWS
The By-Laws shall be amended only with the approval of the City
Council and at least three members of the Board at a Board
meeting, but no amendment shall be adopted unless at least seven
days' written notice of the general nature thereof has been sent
previously to all members of the Board.
