HomeMy WebLinkAboutCC Res 2707 1977-10-25 I I I " " RESOLUTION NO. d7 n 7 / A RESOLUTION OF THE CITY COUNCIL OF SEAL BEACH APPROVING APPEAL A-3-77 FILEO BY FOREST CHURCHILL ON PLANNING COMMISSION DENIAL OF VARIANCE V-12-77 FOR A ROOM ADDITION WHICH EXCEEDS THE MAXIMUM PERMITTED LOT COVERAGE IN THE R-l ZONE. WHEREAS, an application was duly filed by Forest R. Churchill, 4817 Dogwood, Seal Beach, for Variance V-12-77; and WHEREAS, the property is described as Lot 47, Tract 6173, and is more commonly known as 4817 Dogwood; and WHEREAS, the proposal was for a room addition which exceeds the maximum permitted lot coverage in the R-l zone; and WHEREAS, on July 20, 1977, the Planning Commission denied Variance V-12-77 by Resolution No. 1070 on the basis that no hardship has been demonstrated; and WHEREAS, the applicant appealed the Planning Commission's denial of V-12-77 by Appeal A-3-77; and WHEREAS, on August 22, 1977, the City Council held a public hearing on A-3-77 and referred the matter back to the Planning Commission with findings that: 1. A second story addition would have a negative effect upon the neighborhood. 2. 23% of the homes in College Park East area presently exceed 40% lot coverage; and WHEREAS, on September 7, 1977, the Planning Commission considered the City Council's referral of A-3-77 and determined that no new information was presented that had not already been considered in conjunction with V-12-77 and the Planning Commission, by Resolution No. 1077, recommended that Appeal A-3-77 be denied; and WHEREAS, on October 10, 1977, City Council considered the Planning Commission's recommendations and determined to approve Appeal A-3-77 based on the following findings: 1. A second story addition would have a negative impact on the neighborhood. 2. 23% of the homes in the College Park East area presently exceed 40% lot coverage, which is a right substantially enjoyed by most neighbors. 3. The subject house is a Model 12 which is the smallest one-story model in the tract. 4. The location of the parkway strip behind the sidewalk gives the impression of a larger lot. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby grant Appeal A-3-77. , .
