RESOLUTION NO. ':;7 / ~
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, A CHARTER CITY,
REQUESTING THAT THE SOLID WASTE MANAGEMENT
PLAN ENFORCEMENT AGENCY AS MANDATED BY THE
STATE OF CALIFORNIA BE COMPOSED OF MEMBERS
AS RECOMMENDED BY SOLID WASTE MANAGEMENT
TECHNICAL ADVISORY COUNCIL.
ImEREAS,
the County of Orange has heretofore adopted a comprehensive
Solid Waste Management Plan as mandated by the State of
Cal Hornia; and
the mandate calls for establishment of an Enforcement Agency to
enforce the provisions of the Plans as well as compliance with
State standards; and
the Orange County Board of Supervisors has designated an
Enforcement Agency comprised of a staff member from each of
the following: General Services Agency, Environmental Management
Agency, and Human Services (County Health Department), and one
member each from Vector Control and the Orange County Chapter of
the League of Cities; and
WHEREAS, the majority of the Supervisor's designees would not have the
background or expertise to detennine the proper methods or equip-
ment required both for economical and efficient operation of the
landfills and transfer stations and for compliance with State
standards; and
WHEREAS,

WHEREAS, there would seem to be a conflict of interest situation with
County employees enforcing standards of operation by County
personnel of County facilities, and without benefit of advice
of elected city officials; and
WHEREAS, the County employees designated above have their regular duties, and
serving as Enforcement Agency members would detract from their job
performance; and
WHEREAS, the County has recommended an initial staff, including two engineers
for the Enforcement Agency, with an initial budget of almost $60,000;
and
WHEREAS, the County has suggested that trash disposal fees be imposed to
finance the Agency; and
WHEREAS, it has long been the position of the City Council of the City of
Seal Beach that all County costs for trash disposal including
operation of transfer stations be defrayed from general funds; and
WHEREAS, the addition of two engineers does not seem necessary to enforce
trash disposal regulations; and
WHEREAS, there are people other than County employees who are very knowledge-
able in the field of Solid Waste Management who would be available
to serve as members of the Enforcement Agency without cost to the
County; and
I~HEREAS, the Solid Waste Management Technical Advisory Council, who put
together the Solid Waste Management Plan adopted by the Board of
Supervisors, submitted the names of seven of its members who fit
the qualifications of the previous paragraph and are willing to
serve; and

WHEREAS. it is the opinion of the City Council of Seal Beach that the
interests of the taxpayers of the County would be better
served if the Enforcement Agency were comprised of other than
County employees, if they were expert in the field of Solid
Waste Management and if they served without cost to the County;
and
WHEREAS, the Solid Waste Management Technical Advisory Council was
established by the County Board of Supervisors to advise the
Supervisors on all matters pertaining to solid waste management;
and
WHEREAS. this Council has over a period of years. developed the Solid
Waste Management Plan and in the process. has gained experience
and expertise in this field; and
WHEREAS, it would seem appropriate for the Supervisors to approve the
recommendations of the Solid Waste Management Technical Advisory
Council concerning the Enforcement Agency; and
WHEREAS. approximately 90% of the solid waste in the County is generated
within the cities of the County and the cities. therefore. should be
entitled to proportionate representation on the agency which will
have a large measure of authority over the operation of the land-
fills and transfer stations.
NOW, THEREFORE. BE IT RESOLVED
1. That the Board of Supervisors give full and serious
consideration to recommendations of the Solid Waste
Management Technical Advisory Council in all matters
pertaining to solid waste management.
2. That the Enforcement Agency be composed of members
as recommended by Solid Waste Management Technical
Advisory Council. which included representation from
cities, sanitary districts. the Orange County Chamber
of Commerce and the Refuse Disposal Association, with
the majority coming from the cities as voting members,
and representatives from County Sanitation Districts
of Orange County, GSA/So1id Waste Management.
HSA/Environmenta1 Health, and Orange County Vector
Control Agency as technical advisory members.
