The minutes of the September 3. 1980 meeting were approved as subnitted.
Planning Director introduced Vicki Howell, \~ho will be attending the
Planning Commission meetings and taking minutes.

ELECTION OF CHAIRMAN ArlD VICE-CHAIR.'1AN FOR 1980-1981

Chairman Ripperdan opened nominations for Chairman. Covington nominated
Chairman Ripperdan. Chairman Ripperdan declined and nominated Vice-Chair-
man Covington for Chairman. Motion seconded by Leibert and approved by
the fOllowing vote:
AYES: Knapp, Ripperdan. Leibert, Gilkerson
NOES: None
ABSTAIN: Covington
Chairman Covington was seated as Chairman for 1930-1981.
Chairman Covington opened nominations for Vice-Chairman. Gilkerson
nominated Knapp. Knapp declined with the comnent that he has served as
Chairman and Vice-Chairman for a number of terms and the other commission
members should have opportunity to serve as Vice-Chairman. Knapp then
nominated Leibert. Nomination declined. Knapp nominated Gilkerson to
serve as Vice-Chairman. Motion seconded by Ripperdan and unanimously
approved.
2. PUBLIC HEARINGS
A. AMENDMENT TO ZONING ORDINANCE DEALING WITH "HOME OCCUPATIONS".'

Secretary presented a staff report which outlined the continuing problems
encountered by businesses being conducted in residential zones. tlany
businesses are being conducteq without any city knowledge until discovered
in fictitious'name advertisenents in the newspapers. The basic philosophy
of planning provides for land use separations and does not permit businesses
or manufacturing in residences. Other cities severely restrict residential
zone uses; usually to residential, public parks and public schools. Other
uses such as using the home for record keeping or phone messages in con-
junction:with a business are not pennitted unless specifically authorized
by a zoning administrator. Due to the problems encountered by the city
with busi,nesses in residential zones, it is reconrnended that the city amend
its zoning ordinance to include such a provision with the director of plan-
ning acting as the zoning administrator.

Leibert expressed opposition to any businesses in any,residential zone.
Knapp asked about the proposed approval process and appeal 'procedure.
Secretary explained that the proposal would be for the zoning administra-
tor to approve or disapprove a request. This action maybe appealed ,to
the Planning Commission. The action of Planning Commission may be
appealed to City Council.
Covington favored 'having any such regulation apply to all residential
uses. He pointed out that home occupations seem to be the trend of the
future in the interest of energy savings. Covington suggested that the
concept be modified to allow all commercial uses unless denied rather than
prohibit_all uses unless specifically approved. He also favored waiving
the appeal fee. ,
Secretary'outlined the existing 'business license procedures including the
review and inspections by Planning, Building, Fire ,and Police departments.
If this proposed amendment is adopted. staff will continue to review busi-
ness license applications, fictitious name advertisements and violation
complaints. In addition, staff will review all existing business licenses
for compliance with the amendment.
Extensive discussion followed on the concepts of: charging fees for the
initial review of the license application, fees associated with any appeal,
and the possibility of having an appeal fee refunded by action of the
Planning Commission and/or City Council.
Discussion followed on who should review and approve business license
requests in residential zones. Knapp was of the opinion that the Plan-
ning Commission should review and act on each application, rather than
delegating that authority to staff. Other members of the Commission
favored having the zoning administrator revie~1 applications.
Secretary,noted that most applications would'be clear as to their com-
patibility. In cases where there is some doubt as to appropriateness,
the matter would be brought to the Planning Commission (without fee) for
review by the full Commission.
Public Hearing opened. No one spoke on the matter. Public hearing closed.
Ripperdan moved to recommend to City Council adoption of the proposed
amendment with the following conditions:
1. The amendment shall apply to all residential zones.
2. Planning Director shall-determine'if use is comoatible
with residential zones in accordance with the information
contained in the Sept. 11, 1980 staff report.
3. 'Applicant has right of review of decision of the Planning
Director by Planning Commission (with no fee). ,
4. This amendment shall be in force for one year pending
. review by the Planning Commission. .

Motion seconded by Leibert. Knapp stated that he would vo~e against the
motion because:
1. It is unclear who inspects in conjunction with license applications.
,2. This will overburden the Planning DepartQent.
3. He is opposed to no appeal fee.
Motion approved by .the following vote:

Covington asked that minutes be prepared in Much more detail, approaching
verbatum minutes. Staff was directed to report back to the Planning
Commfssion on ways to improve the minutes.

Jim Watson will be at the next Planning Coomission meeting to talk about
changes to the Center.
C. INFOR.'1AL REPORT CONCERNING ZONING REGULATIGrlS
Secretary presented a report on zoning ordinance philosophy, the existing
ordinance, and areas that should be revie\~ed in light of new "state of the
art" techniques. Staff will be preparing infomation on a chapter by chap-
ter basis for Commission discussion and potential amendments.
The formal meeting adjourned to the slide presentation on waterfront develop-
ment. '
