I I r.~ '- '1-_.... ~..-r:--- ~ - 681 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CA:ri.IFORNIA, AMENDING ORDINANCE NUMBER 628 AS I AMENDED (THE ZONING ORDINAl9'CE) OF THE CITY OF SEAL BEACH, CA~IFORNIA, BY ADDING THERETO NEW PROVISIONS I RELATING TO ISSUANCE OF SPECIAL USE I PERMITS FOR CERTAIN USES I~ THE COM- MERCIAL AND INDUSTRIAL ZONES IN SAID CITY. : I The City Council of the City of SeJl Beach, California, I does ordain as follows: ' i Section 1100 of ArticlJ II shall be ammended to I , , : I In the C-2 zone, the following uses only are permitted and I I Section l. read as follows: I herein after specifically provided and Jllowed by this article, I subject to the off-street parking requi~ements and the general I I provisions and exceptions set forth beg~nning with Article 17. i (1) Any use permitted in either tne c.o or the C-l zone, i (2) Automobile sales, new and useq, I I (3) Automobile house trailer sale~, new and used, (4) Auto laundries during daYligh~ hours, (5) I I Automobile repairing, but not I including body and fender work, (6) Boat sales (no repairing), (7) Gymnasiums, public or commerc~al, (8) Mortuaries, (9) Motels, auto courts, and tour~st courts, I (10) Pet Shops, (11) Photo engraving, --(12~- Service stations catering (13) Swimming pool displays, sol~ly to motor vehicles, , I I , , onl~ retail custom work, (14) Upholstering shops, doing (15) Retail or service businesses catering directly to con- , surners, when interpreted by the Plannini Commission as to per- ! In addition, the requirements of Article 20 of this 6rdinance, the Planning ! If any section, subsection, sentence, clause, I phrase, or portion of this ordinance isifor any reason held to I be invalid or unconstitutional by the d~cision of any court of , I competent jurisdiction, such decision shall not effect the I validity of the remaining portions of this , I hkve I ordinance, The City Council hereby declares that it would adopted this ordinance and each section, sentence, clause, phr~se, or portion thereof, I irrespective of the fact that one or mo~e sections, subsections, I sentences, clauses, phrases, or portionibe declared invalid or unconstitutional. Section 3. The City Council I I hereby , declares: (a) An increase in the use of commercial and industrial : I areas for on-sale alcoholic beverage us~ within the City would I tend to create an undue policing problem. I I (b) The limited commercial and in~ustrial areas of the I City, to provide necessary commercial ahd industrial services , within the City require due considerati~n of the compatibility , and extent of use of said limited area ~o the purpose that an , over concentration of on-sale liquor es~ablishments shall not destroy the economic health of the ret~il and service uses of the commercial and industrial zones. (c) The predominate residential character of the City and the shallow depth of commercial and indvstrial zones and areas , adjacent to the residential zones require special consideration in the location of on-sale liquor estab+ishments to preserve the , I property rights of residents in adjoining zones that might enjoy i their homes and property and to preserve the residential land I I values and the morals, safety, and welfare of the general public.
